ThecomplaintallegesthatdefendantRicerefusedHerrons /   ׀requesttocriminallyprosecutedefendantHarrisonforfailuretocomplywith4851201;4853101and4853102(18)(19)oftheTennesseeCodeAnnotated.ApparentlythecorporationoverwhichHerronpresidessoughtandwasrefusedpermissionfromWardenHarrisontooperatecertainbusinessventureswithinthepenalinstitution.Althoughnotspecified,itwouldappearfromexhibitstothecomplaintthatoneoftheseventuresincludedtheoperationofapopcornpopper. ThestatutesunderwhichMr.HerronrequestedGeneralRiceprosecuteWardenHarrisonarenotcriminalstatutes.T.C.A.4851201containsdefinitionspertainingtononprofitcorporations.Section4853101pertainstothepurposeofcorporationsand4853102(18)(19)allowsacorporationtocarryonbusinessanddoallthingsnecessaryorconvenient,notinconsistentwithlaw,tofurtheritsactivitiesandaffairs. EvenifHerronsoughttorequireGeneralRicetoprosecuteWardenHarrison,forviolationofcriminalstatutes,prosecutorshaveagreatdealofdiscretionindeterminingwhethertopursuecriminalcharges. SeeUnitedStatesv.Davis ,15F.3d526(6thCir.1994).Mandamusagainstapublicofficialwilllieonlytorequireperformanceofaministerialnondiscretionaryactoftheofficial. ThecomplaintalsoallegesthatHarrisonutilizedDepartmentofCorrectionadministrativepoliciesandprocedurestodepriveplaintiffofthestatutorypowersgrantedthecorporation.Itwasclearlynotthelegislativeintentinpassingstatutesgoverningcorporations,andvestingthemwithcertainpowers,toallowaninmatetocreateacorporationandthuscircumventpoliciesandproceduresoftheDepartment. Thecomplaintfurtherseekstorecoverdamages,presumablyfrombothdefendants,forwithholdingtherightsguaranteedtohimundertheaforementionedcorporatestatutes.Stateofficersandemployeesareabsolutelyimmunefromliabilityforactsoromissionswithinthescopeoftheirofficeoremployment,exceptforwillful,maliciousorcriminalactsorforactsoromissionsdoneforpersonalgain.T.C.A.98307(h).Therearenoallegationsofwillful,maliciousorcriminalactsoromissionsorforactsoromissionsdoneforpersonalgain.Stateemployeeincludesonewhoisemployedintheserviceofandwhosecompensationispayablebythestate.T.C.A.842101(3)(A).ThecomplaintfurtherallegesthatdefendantRice,byherfailuretocriminallyprosecuteWardenHarrison,violatedMr.HerronsrightsundertheFirstandFourteenthAmendmentstotheConstitutionoftheUnitedStatesandArticleI3and8andArticleXI8oftheConstitutionoftheStateofTennessee.We,likethetrialcourt,failtoseehowthefailureoftheDistrictAttorneyGeneraltoaccedetoMr.HerronsrequesttocriminallyprosecuteWardenHarrisonconstitutesaviolationofanyoftheaforementionedconstitutionalguarantees.
