TheSupremeCourt,in_Crabtree_,acknowledgedthattheTennesseelegislaturehad,inthe q rehabilitativealimonystatute, demonstratedapreferenceforanawardofrehabilitativealimony Z torehabilitateaneconomicallydisadvantagedspouse.16S.W.3d357,358.Inrelevantpart,the C SupremeCourtheldasfollows: ,|   8  8`   Ifanawardofrehabilitativealimonyisjustifiedbytheparties N circumstances,atrialcourtinitiallyshouldawardrehabilitative  7 alimony only .Anawardofre_habilitative_Ԁalimonypursuantto !   _Tenn.Code_ԀAnn365101mustbepredicateduponafindingthat " ! therecipientcanbeeconomicallyrehabilitated.Onceawarded, #" rehabilitativealimonymaybemodifiediftherecipientsprospects $# foreconomicrehabilitationmateriallychange. Ifrehabilitationis u% $ notfeasible ,thetrialcourt maythen makeanawardofalimonyin _&!% futuro. Accordingly,aconcurrentawardofbothtypesofalimony I'"& isinconsistent .Atthetimeofthedecree,atrialcourtmust 3(#' necessarilyfindthattherecipientofalimonyeithercanbeorcannot )m$( berehabilitatedalthoughthatdeterminationissubjecttolater *V%) modification.Allowingconcurrentawardsofalimonyinfuturoand *?&* rehabilitativealimonywouldrequireatrialcourttoengageinanact +('+ ofclairvoyance.Thetrialcourtwouldnotonlyberequiredto  anticipatethedurationnecessaryforrehabilitationbutwouldalsobe  requiredtoanticipatethefutureneedsofaspousewho,ithasbeen  determined,canberehabilitated.k` x` x 5f8  8`    Id. at360(emphasisadded).= ` x` x   UndertheSupremeCourtsholdingin_Crabtree_andtheplainlanguageof_T.C.A._Ԁ365  ` 101(d)(1)(2001),thetrialcourterredinmakingaconcurrentawardofbothrehabilitative  I alimonyandalimonyinfuturo.ThequestionnowbecomeswhetherMrs._Hochhauser_Ԁiscapable  2  ofbeingeconomicallyrehabilitated.Ifso,anawardofrehabilitativealimonyaloneiscorrect.If    not,thenanawardofalimonyinfuturoaloneiscorrect.Weturntotherelevantfactsinrecord.     Fromourreadingoftherecord,itappearsthatWifecanbeeconomicallyrehabilitated.   Shehasabachelorsdegreeinaccounting,shehasbeenabletoprocureemploymentwiththe o  accountingfirmofBean_Ison_Ԁand,fromallfactsinrecord,sheappearstobemotivatedto X  continuehereducationandtositforherCPAexam.TherealissueishowlongitwilltakeMrs. A _Hochhauser_Ԁtoachievethesegoals.HusbandarguesthatWifecouldbefullyrehabilitatedwithin *z two(2)years.Specifically,HusbandarguesthatMrs._Hochhauser_Ԁcouldcompletethenineteen c (19)additionalhoursnecessarytoallowhertositforherCPAexambytakingthreehoursper L semesterfortwoyears.WedisagreewithHusbandsargumentforseveralreasons.Although 5 Mrs._Hochhauser_Ԁcouldcompletehercourseworkintwoyears,ifsheattendsclassesinthefall,  spring,andsummersemesters,thisyearroundacademicschedulewouldbedifficultatbest  consideringthatsheistheprimaryparentofatwelveandafourteenyearold.Thisfact,coupled  withMrs._Hochhauser_sparttimeworkwithBean_Ison_Ԁwouldmakesuchanacademicschedule  verydifficultatbest.Realistically,itwilltakeMrs._Hochhauser_Ԁatleastthreeyearstocomplete r herhours,ifsheattendsclassesduringtwosemesterseachyear.Also,itisamatterofcommon [ knowledgethattheCPAexamisdifficult.Mrs._Hochhauser_Ԁtestifiedthatshesatforthetest D previouslyin1981or1982.Atthattime,shepassedoneofthefourpartsbutreceivednocredit -} forthatpartsincetherequirement,atthattime,wasthatthetakerhadtopassatleasttwopartsin f ordertobegivenanycredit.Consequently,whenshedoessitfortheCPAexam,Mrs. O _Hochhauser_Ԁwillbeatsquareone.Mickey_Ison_,managingpartnerofBean_Ison_Ԁ_CPAs_Ԁ&  8 Consultantstestifiedthatonlyaveryfewpeoplepassallfourpartsthefirsttimetheysitandthat !!  passingtheexamoftentakes two,threefoursittings.Fortheforegoingreasons,wefindthat " ! thetrialcourtdidnoterrinawardingWiferehabilitativealimonyforaperiodoffive(5)years. #"   Turningtotheamountofrehabilitativealimonyawarded,wenotethatthereisnodispute u% $ intherecordthatMr._Hochhauser_ԀhasagreaterearningcapacitythanMrs._Hochhauser_,afact ^&!% whichheadmits,towit: G'"& 8  8`   Q.Youwouldagree,Dr._Hochhauser_,thatyourearningcapacityis )i$( considerablygreaterthanthatofyourwife;correct?*R%)` x` x 8  8`   A.Ithinkitsgreaterthanhers.+$'+` x` x Ї  ItisalsoundisputedthatWifecurrentlyearnsapproximately$25,000peryearandthat  Husbandcurrentlyearns$150,000peryear.Giventhediscrepancyinthepartiesincomes,the  discrepancyintheircurrentlevelsofeducationandtheirrespectiveearningcapacities,wefind  thattheamountofrehabilitativealimonyshouldberaisedto$2,000permonth. k WifesAttorneyFees =    Husbandassertsthatheshouldnothavebeenorderedtopayseventy(70%)percentof  _ WifeslegalfeesItiswellsettledthatanawardofattorneyfeesconstitutesalimonyin_solido_.
