PlaintiffRickHollowayworkedatandontheMauryRegionalHospitalconstructionprojectforCentexRogersConstructionCompanyseveralmonthspriortoJune1995. 5. InMayand/orJune1995,DefendantJohnR.Collier,Jr.contactedoneormoreindividualsatCentexRogersConstructionCompanyregardingPlaintiffRickHolloway. 6. DefendantJohnR.Collier,Jr.communicatedtoCentexRogersConstructionCompanyinMayand/orJune,1995thatPlaintiffRickHollowayhadimproperlyreroofedaMauryRegionalHospitalemployeeshome,andindoingso,hadviolatedthetrustofMauryRegionalHospitalmanagement. 7. ThestatementscommunicatedtoCentexRogersConstructionCompanybyDefendantJohnR.Collier,Jr.assetforthintheprecedingparagraphwerenottrue,andDefendantJohnR.Collier,Jr.eitherkneworshouldhaveknownthatsaidstatementswereuntrue. 8. ThestatementscommunicatedbyDefendantJohnR.Collier,Jr.toCentexRogersConstructionCompanyassetforthintheprecedingtwoparagraphsweremademaliciously,andweremadeintentionallyorrecklessly,withtheintenttoprocuretheterminationofPlaintiffRickHollowaysemploymentwithCentexRogersConstructionCompany. 9. IncommunicatingtheaforementionedstatementstoCentexRogersConstructionCompany,DefendantJohnR.Collier,Jr.did,byinducement,persuasion,misrepresentation,and/orothermeans,wrongfullyinterferewiththeatwillemploymentbetweenCentexRogersConstructionCompanyandPlaintiffRickHolloway.DefendantJohnR.Collier,Jr.isthereforeliableforPlaintiffslostwagessincehisterminationonJune11,1995.   `       Thedefendantanswered,denyingthematerialportionsofthecomplaintandstating:      `   `     14. TheComplaintfailstostateaclaim.15. TheDefendantisimmunefromsuitundertheprovisionsofTennesseesGovernmentalTortLiabilityActbecauseatalltimesmaterialtotheComplaint,hewasactingwithinthecourseandscopeofhisemploymentasAssistantAdministratoratMauryRegionalHospital.16. ThePlaintiffsComplaintisbarredbytheapplicablestatuteoflimitations.17. TheDefendantscommunicationstoCentexRogersConstructionCompanyconcerningthePlaintiffareprotectedbyaqualifiedprivilege. WHEREFORE,havingfullyanswered,theDefendantdemandsajuryoftwelve(12)totrythecaseagainsthim;praysthattheComplaintfiledagainsthimbedismissed;andpraysthathebeawardedhisdiscretionarycostsincurredinconjunctionwiththedefenseofthismatter.        Thecausewastriedtoajurywiththeresultstatedabove. UponappealtothisCourt,thedefendantappellantpresentsasingleissueasfollows:      `   `      1. Whethertheplaintiffpresentedmaterialevidencetosupportthejurysverdictthatthedefendantisliableunderthetheoryofintentionalinterferencewithanemploymentrelationship. Averdictmaybereversedonappealif,aftertakingthestrongestlegitimateviewoftheevidenceinfavorofthesuccessfulparty,theappellatecourtfindsthatareasonablemindcouldreachonlyoneconclusionandthatconclusioniscontrarytotheverdict.WhartonTransportv.Bridges,Tenn.App.1980,606S.W.2d521;Holmesv.Wilson,Tenn.App.1977,551S.W.2d682;Flynnv.ShoneysInc.,Tenn.App.1992,850S.W.2d458. InForresterv.Stockstill,Tenn.App.1994,869S.W.2d328,theemployeeatwillsuedhiscorporateemployeranditsdirectorswhomadethedecisiontodischargehim.TheSupremeCourtheldthattheemployeehadnocontractualrighttocontinuedemploymentandthusnoclaimforprocurementofbreachofcontractandthatthedirectorswerenotliableforintentionallyinterferingwithplaintiffsemployment. Thereisastatutorytortofinducementorprocurementofbreachofcontract.T.C.A.4750109.Theelementsofthecauseofactionare,knowledgeofthewrongdoerofalegalcontract,maliciousintentofwrongdoer,andaresultantbreachofthecontractwithdamages.TSCIndus.Inc.v.Tomlin,Tenn.App.1987,7432d169. Thereisevidencefromwhichareasonablejurymightfindthefollowing: 1. CentexRogersConstructionCompanywasengagedasgeneralcontractortoconstructabuildingforMauryRegionalHospital. 2. JohnR.Collier,assistantadministratorofthehospitalhadoversightofsecurityofthehospitalandtheconstructionbeingperformedbyCentex. 3. InSeptember1994,MickyJenkins,jobsuperintendentforCentex,hiredplaintifftemporarilytoworkasacarpenteronthejobasan atwillemployeeofCentex. 4. InFebruary1995,whilestillemployedbyCentexonthesameproject,plaintiffagreedwithDougJohnston,ahospitalsecurityguardunderthesupervisionofCollier,theassistanthospitaladministrator,torepairaroofforJohnston,thesecurityguard. 5. Thiswas sparetimework,anddidnotinterferewithplaintiffsworkonthehospitalbuilding. 6. Johnstonbecamedissatisfiedwiththedelayincompletionoftheroofjobbyplaintiffand,onseveraloccasions,Johnstoncomplainedaboutthedelaytohissupervisor,CharlesPerkins,chiefofsecurityofthehospital. 7. BothplaintiffandJohnstonhadvolatilepersonalities,andJohnstonssuperiorswereconcernedaboutthepossibilityofanaltercationbetweenthetwoonhospitalpremises. 8. HospitalauthoritiesinformedaCentexsupervisoroftheirconcernaboutthedifficultybetweenplaintiffandJohnston,butdidnotsuggestthatanyactionbetaken. 9. OnJune9,1995,plaintiffwasdischargedbyCentex. Moreover,thereisnoevidencethatdefendantpublishedanystatementthattherewasdangerofanaltercationonthejobbetweenplaintiffanddefendant.Thiswasaconclusionreachedfromreportsreceivedfromothersbythehospitalauthoritieswhointurnreportedtheirconcernstotheplaintiffsemployer.Thereportoftheirconcernsbythehospitalauthoritieswastheobviouscauseofplaintiffsdischarge,andnoneofthehospitalauthoritiesisapartytothisaction. Noevidenceisfoundinthisrecordtosupportaverdictforplaintiffagainstdefendant.TheverdictandjudgmentoftheTrialCourtarethereforevacatedandreversedandplaintiffssuitisdismissed.Costsofthisappealaretaxedagainsttheplaintiffappellee.ThecauseisremandedtotheTrialCourtforfurtherproceedingsinconformitywiththisopinion.
