ÐWife€further€acknowledged€that€when€she€was€in€Tampa,€she€always€stayed€at€Barclayððs€home.€Ð  _ ÐÌà  àThroughout€her€testimony,€Wife€characterized€her€trips€and€extended€stays€in€Tampa€asÐ á 1  Ðð Ðprovided€for€termination€of€his€support€in€the€event€of€alternative€areas€of€support.€€However,Ð Ï ÐHusband€did€not€attach€ð ðsupportðð€as€a€condition€of€cohabitating€without€benefit€of€marriage.€€ItÐ ¸ Ðappears€to€the€Court€that€Husband€was€not€adverse€to€providing€support€for€Wife,€except€when€theÐ ¡ñ Ðupon€cohabitation€with€any€third€party,€such€as€family€members€or€girlfriends.€€That€said,€we€findÐ k» Ðthat€the€parties€explicitly€contracted€for€the€termination€of€Husbandððs€alimony€obligations€in€theÐ T¤ Ðevent€Wife€cohabits€with€an€unrelated€male,€regardless€of€whether€said€male€was€providing€WifeÐ =  Ðwith€financial€assistance€or€support.€€We€therefore€find€that€the€trial€court€erred€in€denyingÐ & v ÐHusbandððs€petition€on€the€basis€that€he€failed€to€introduce€proof€that€Wife€was€receiving€financialÐ  _ Ðassistance€from€Barclay.Ð ø H ÐÌà Ðdetermine€whether€Wife€in€fact€cohabited€with€Barclay€as€said€term€is€defined€in€common,€plainÐ œì  Ðlanguage.€€The€evidence€in€this€case€is€undisputed€that€Wife€began€an€exclusive€romanticÐ …Õ  Ðrelationship€with€Barclay€in€August€1999.€€The€parties€entered,€as€a€collective€exhibit,€calendars€forÐ n¾  Ðthe€years€1999,€2000,€and€2001,€to€which€Wife€stipulated.€€According€to€the€1999€calender,€WifeÐ W§  Ðspent€41€consecutive€days€in€Barclayððs€home€from€October€3,€1999€through€November€13,€1999.€Ð @ ÐThe€2000€calender€reveals€that€Wife€stayed€with€Barclay€in€his€Tampa€home€for€206€days€duringÐ )y Ða€period€spanning€January€2000€through€September€2000.€€Collective€Exhibit€3,€the€2001€calender,Ð b Ðindicates€that€Wife€stayed€in€Barclayððs€Tampa€home€for€175€days€from€January€1,€2001€throughÐ ûK ÐSeptember€8,€2001.׃×Ý ƒ#ÃÝòòÚ  Ú6Ú  ÚóóÝ  Ý×  ×€€Additionally,€Wife€acknowledged€that€she€and€Barclay€took€several€tripsÐ ä4 Ðtogether,€including€vacations€to€New€England,€Europe,€Disney€World,€Atlanta,€Lake€Tahoe,€andÐ Í ÐNorth€Carolina.€€Wife€testified€that€she€and€Barclay€took€these€trips€as€a€couple,€sharing€hotel€roomsÐ ¶ Ðor€bedrooms.Ð Ÿï ÐÌà  àWife€admits€to€engaging€in€sexual€relations€with€Barclay€during€her€ð ðvisitsðð€to€Tampa,€andÐ qÁ Ðfurther€acknowledges€that€while€in€Tampa,€she€always€stayed€with€Barclay,€and€shared€his€bed.€Ð Zª ÐWife€testified€that€she€kept€clothing€in€the€closets€at€Barclayððs€Tampa€home,€stating:Ð C“ ÐÐ ,| Ðà8  àà8` Ð Ð àà ¸ àQ.€€Okay.€€And€now,€again€so€we€can€be€crystal€clear€on€this,Ð ° Ðyou€kept€clothing€down€at€4309[,€Barclayððs€Tampa€residence,]€thatÐ ™é Ðjust€stayed€there;€am€I€correct?ЂÒ` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€It€depended€on€if€I€needed€it€in€Memphis.€€Iððm€sure€I€leftÐ T¤ Ðclothing€behind,€in€all€honesty.Ð= ` x` x ÐÌò òó óà8  àà8` Ð Ð à******************************************************Ð _` x` x ÐÌà8  àà8` Ð Ð àà ¸ Ðof€the€closet€in€the€bedroom€that€you€share€with€Mr.€Barclay?Ð@` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€A€large€part€of€it?Ðb` x` x ÐÌà8  àà8` Ð Ð àà ¸ àQ.€€Yes,€of€the€closet.Ðä4` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€No.ж` x` x ÐÌà8  àà8` Ð Ð àà ¸ àQ.€€Okay.€€And€is€it€true€that€you€also€have€clothes€on€aÐ ˆØ Ðhanging€rack€or€have€had€clothes€on€a€hanging€rack€because€it€[sic]Ð qÁ Ðwasnððt€room€in€the€bedroom€for€all€of€your€clothes?€€Isnððt€that€true?ÐZª` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€I€had€a€rack,€yes.Ð,|` x` x ÐÌà8  àà8` Ð Ð àà ¸ àQ.€€That€was€in€addition€to€the€clothes€that€you€kept€in€theÐ þN Ðbedroom€closet,€is€that€true?Ðç 7` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€I€have€quite€a€few€clothes€there.й" !` x` x ÐÌà8  àà8` Ð Ð àà ¸ àQ.€€Okay.Ћ$Û#` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€I€mean,€I€wouldnððt€say€that€I€have€more€than€two€suitcasesÐ ]&­!% Ðfull€of€clothes.ÐF'–"&` x` x ÐÌò òó óIn€addition€to€clothing,€Wife€also€admitted€to€keeping€toiletries€at€Barclayððs€home,€although€sheÐ )h$( Ðinsisted€that€she€normally€ð ðtook€all€my€toiletries€back€and€forth€[from€Memphis€to€Tampa].ðð€€WifeÐ *Q%) Ðâ âfurther€conceded€that€she€kept€her€automobile€in€Tampa€from€January€1,€2001€through€SeptemberÐ ê*:&* Ðor€October€2001.€€The€evidence€is€moreover€undisputed€that€Wife€had€a€key€to€Barclayððs€home,€andÐ ° Ðwould€have€had€free€run€of€the€home€even€on€occasions€when€Barclay€was€away.Ð ™é Ðâ âÓÓÌÓX‘Óà  àThere€is€no€evidence€in€the€record€to€indicate€that€Wife€paid€rent€or€utilities€during€her€stayÐ T¤ Ðin€Barclayððs€home,€nor€is€there€any€evidence€that€Barclay€provided€her€with€financial€support.€€WifeÐ =  Ðacknowledged€that€she€and€Barclay€both€contributed€to€the€purchase€of€groceries€and€toiletries.Ð & v ÐÌà  àWhen€questioned€as€to€whether€she€and€Barclay€held€themselves€out€as€a€couple€to€friendsÐ ø H Ðand€acquaintances€in€Florida,€Wife€testified:Ð á 1  ÐÌà8  àà8` Ð Ð àà ¸ àQ.€€Were€there€any€other€ð!ð€or€can€you€remember€any€instancesÐ ³  Ðwhere€you€held€yourself€out€or€represented€to€third€parties€that€youÐ œì  Ðand€Mr.€Barclay€were€a€couple?Ð…Õ ` x` x ÐÌà8  àà8` Ð Ð àà ¸ àA.€€All€of€our€friends€knew€we€were€a€couple.ÐW§ ` x` x Ðà8  àà8` Ð Ð àà ¸ àIs€that€what€youððre€asking€me,€sir?Ð@` x` x ÐÌò òó óThe€evidence€additionally€indicates€that€Wife€had€her€mail€forwarded€to€Barclayððs€Tampa€residenceÐ b Ðfor€an€extended€period€of€time€in€2000.€€Further,€during€examination€by€Husbandððs€counsel€at€trial,Ð ûK ÐWife€acknowledged€that€she€had€given€an€answer€during€an€earlier€deposition€admitting€that€she€had,Ð ä4 Ðon€at€least€one€occasion,€represented€her€address€as€Barclayððs€Tampa€home.Ð Í ÐÓÓÌÓƒ—Óà  àIn€light€of€these€facts,€we€find€that€the€evidence€in€the€record€establishes€that€Wife€cohabitedÐ ˆØ Ðwith€Barclay€at€his€Tampa€home.€€òòò òCf.ó óóó€€òòò òHarris€v.€Corleyó
