àà0 àà à2.à àThe€trial€court€erred€in€requiring€the€defen‚dant/appellant€to€dissipate€her€share€of€the€maritalÏestate€in€order€to€pay€her€attorney's€fees.ÌÌà8 àà0 àà à3.à àWife€would€request€the€court€to€award€her€attor…ney's€fees€for€prosecuting€this€appeal.ÌÌÓÓÌà àWe€enter€upon€our€review€of€this€case€òòde€novoóó€upon€the€re…cord,€with€a€presumption€of€correctness€of€the€findings€of€fact€byÏthe€trial€court.€€Unless€the€evidence€preponderates€against€theÏfindings,€we€must€affirm,€absent€an€error€of€law.€€See€Rule€13(d),ÏTennessee€Rules€of€Appellate€Procedure.€€No€presumption€attachesÏto€conclusions€of€law.€€òòAdams€v.€Dean€Roofing€Co.óó,€715€S.W.2d€341,Ï343€(Tenn.€Ct.€App.€1986).ÌÌà àThe€court€awarded€to€the€wife€all€equity€in€the€parties'Ïhouse.€€Additionally,€the€court€decreed€that€the€husband,€pendingÏthe€sale€of€the€property,€would€pay€the€monthly€payments€on€theÏhome€in€the€amount€of€$1,548.00€for€the€months€of€May,€June€andÏJuly,€1997.€€He€was€further€ordered€to€pay€$725.00€per€monthÏdirectly€to€the€wife€for€support€and€alimony.€€Beginning€in€AugustÍ1997€or€upon€the€sale€of€the€house,€whichever€occurred€first,€heÏwas€ordered€to€pay€$1,500.00€per€month€as€alimony€in€futuro€to€theÏwife€and€further€providing€for€termination€of€the€alimony€contin…gent€upon€circumstances€not€material€to€this€appeal.€€The€courtÏalso€ordered€the€husband€to€maintain€health€insurance€on€the€wifeÏfor€a€period€of€24€months€beginning€in€June€of€1997.ÌÌà àUpon€appellant's€motion€to€alter€or€amend€the€judgment,€theÏcourt€ordered€the€husband€to€pay€spousal€support€in€the€amount€ofÏ$2,150.00€per€month€until€the€sale€of€the€parties€home.€€Upon€theÏsale€of€the€home,€the€œhusband's€obligation›€to€pay€œalimony›€inÏfuturo€œwas€reduced€to€the›€sum€of€œ$1,500.00€per€month.›ÌÌà àT.C.A.€ðð€36„5„101(d)(1)€provides:ÌÒ ` ÒÒ ` ÒÓÓÌÌÒ ° ÒÒ ° Òà8 àà àIt€is€the€intent€of€the€general€assembly€that€aÏspouse€who€is€economically€disadvantaged,€relative€toÏthe€other€spouse,€be€rehabilitated€whenever€possible€byÏthe€granting€of€an€order€for€payment€of€rehabilitative,Ïtemporary€support€and€maintenance.€€Where€there€is€suchÏrelative€economic€disadvantage€and€rehabilitation€is€notÏfeasible€in€consideration€of€all€relevant€factors,Íincluding€those€set€out€in€this€subsection,€then€theÏcourt€may€grant€an€order€for€payment€of€support€andÏmaintenance€on€a€long„term€basis€or€until€the€death€orÏremarriage€of€the€recipient€except€as€otherwise€providedÏin€subdivision€(a)(3).€€Rehabilitative€support€andÏmaintenance€is€a€separate€class€of€spousal€support€asÏdistinguished€from€alimony€in€solido€and€periodic€alimo…ny.€€In€determining€whether€the€granting€of€an€order€forÏpayment€of€support€and€maintenance€to€a€party€is€appro…priate,€and€in€determining€the€nature,€amount,€length€ofÏterm,€and€manner€of€payment,€the€court€shall€considerÏall€relevant€factors,€including:ÌÌà8 àÌà8 à(K)€The€relative€fault€of€the€parties€in€cases€where€theÏcourt,€in€its€discretion,€deems€it€appropriate€to€do€so;€ÏandÌÌà8 à(L)€Such€other€factors,€including€the€tax€consequencesÏto€each€party,€as€are€necessary€to€consider€the€equitiesÏbetween€the€parties.ÌÌÓÓÌà àUpon€consideration€of€all€the€above€factors,€as€applied€toÏthe€facts€of€this€case,€we€are€of€the€opinion€the€trial€court'sÏaward€of€alimony€is€appropriate.€€œWhile€all€of€the€above€circum…stances€must€be€considered€by€the€court,€in€this€case,€some€criti…cal€attention€must€be€given€to€the€physical€and€mental€conditionÍof€the€wife€and€the€degree€of€fault€attributable€to€her€in€theÏbreakup€of€the€marriage.ÌÌà àThe€record€reflects€that€the€wife,€in€general,€met€her€shareÏof€the€marital€responsibilities€until€she€was€seriously€injured€inÏan€accident.€The€accident€resulted€in€an€onset€of€illness€includ…ing€fibro›„myalgia€and€narcolepsy.€€Thereafter€she€took€substantialÏdoses€of€pain€medication€but€asserts€that€she€was€neverthelessÏunable€to€obtain€complete€relief€from€the€pain.€€She€asserts€thatÏshe€began€taking€alcohol€in€conjunction€with€the€pain€medicationÏin€an€effort€to€obtain€relief.€€It€seems€clear€that€the€combina…tion€of€pain€medication€and€the€excessive€use€and€abuse€of€alcoholÏand€the€wife's€erratic€behavior€as€a€result€thereof,€contributedÏto€the€deterioration€of€the€marriage.€€This€fact€alone,€however,Ïwas€not€the€entire€cause€of€the€failure€of€the€marriage.€€The€wifeÏalso€engaged€in€extramarital€affairs€including€one€of€some€sevenÏyears€duration€with€the€husband's€former€œboss.€€While€the€husbandÏdid€not€become€fully€aware€of€the€affair€between€his€wife€andÏformer€boss€until€after€this€action€was€instituted,€this€circum…stance,€nevertheless,€does€not€detract€from€the€wife's€misconductÏin€engaging€in€the€affair.›ÌÌà àThe€court€granted€an€absolute€divorce€to€the€husband€on€theÏgrounds€of€inappropriate€marital€conduct.€€Suffice€it€to€say€thatÏthe€court€was€justified€in€so€doing€and€we€do€not€deem€it€neces…sary€to€set€out€in€detail€the€conduct€of€the€wife€which€was,Ïwithout€question,€inappropriate.€We€have€briefly€discussed€theÏwife's€misconduct€solely€for€the€purpose€of€showing€that€T.C.A.€ððÏ36„5„101(d)(K)€relating€to€the€relative€fault€of€the€parties€as€aÏfactor€in€determining€an€award€of€alimony€is€a€proper€consider…ation.€In€view€of€the€wife's€physical€condition,€it€seems€clearÏthat€this€is€an€appropriate€case€for€alimony€in€futuro.€€It€isÏlikewise€clear€from€the€record€that€some€of€the€wife's€conductÏabout€which€the€husband€complains€is€responsible€for€at€least€aÏpart€of€the€wife's€poor€physical€condition.€While€the€trial€courtÏapparently€made€no€finding€nor€reference€to€fault€in€awardingÏalimony,€we€find€that€the€record€would€justify€a€finding€that€thisÍis€an€appropriate€case€œin€which€consideration€to€fault€should€beÏgiven.ÌÌà àIn€any€event,€the€record€does€not€support€a€finding€that€theÏtrial€court€abused€its€discretion€is€making€an€award€of€alimony.€ÏIt€is€well„settled€that€in€awarding€alimony,€the€most€importantÏfactor€to€consider€is€the€need€of€the€spouse€who€is€awarded€alimo…ny€followed€by€the€ability€of€the€obligor€spouse€to€pay.€òòCampanaliÏv.€Campanalióó,€695€S.W.2d€193,€197€(Tenn.€App.€1985).€Here€theÏrecord€is€clear€that€the€Wife€has€the€need€for€alimony€and€theÏHusband€has€the€ability€to€pay.€In€awarding€alimony,€the€facts€andÏcircumstances€of€each€case€must€govern.€€òòRush€v.€Rushóó,€33€Tenn.ÏApp.€496,€232€S.W.2d€333€(1949).€Fault,€need,€and€ability€to€payÏare€essential€considerations.€€òòGilliam€v.€Gilliamóó,€776€S.W.2d€81,Ï(Tenn.€App.€1988).€€The€award€of€alimony€is€in€the€sound€discre…tion€of€the€trial€court€and€will€not€be€disturbed€on€appeal€absentÏa€manifest€showing€of€an€abuse€of€discretion.€òòIngram€v.€Ingramóó,Ï721€S.W.2d€262,€264€(Tenn.€App.€1986).ÌÌà
