OnOctober31,1990,aftersixteenyearsofmarriage,Appellantfiledsuitfordivorceongroundsofirreconcilabledifferences.AlthoughAppellantreceivesamilitaarayrebtirementbenefit,nbcNceitherpartytothedivorcewasatthattimeamemberofthearmedservicesandtherewerenochildrenofthemarriageundertheageofeighteenyears.  Inprayersforreliefplaintiffsought:1."ThatthePlaintiffbeawardedanabsolutedivorce";2."ForapprovalofaMaritalDissolutionAgreement"and,3."ThatthePlaintiffbegrantedsuchother,further,differentandgeneralrelieftowhichhemaybeentitled."  Simultaneously,withthefilingofthedivorcecomplaint,AppellantfiledaswornmaritaldissolutionagreementexecutedbythepartiesonSeptember28,1990.  Themaritaldissolutionagreementprovided,inpart:B ( / X,X4XB8   / Whereasitisthedesireofbothpartiestodetermineandsettletheirpropertyrightsandallotherrightsarisingfromthemaritalrelationship;...      ...  8   / 7.ThatthePlaintiffagreestopaytotheDefendantFifty(50%)ofhismilitarycheckhereceiveseachmonth.      ...  8   / 10.AnnetteCarolJenkinswaivesserviceofprocessintheupcomingdivorceasattestedtobyhersignatureonthisMaritalDissolutionAgreement.    8   / ThepartiesunderstandandagreethatthisMaritalDissolutionAgreementisintendedtobeafullandfinalsettlementoftheirpropertyrightsandeachherebywaivesandrelinquishestotheotherallrightsorclaimswhicheachmayhaveoracquireunderthelaworlawsofanyjurisdictionintheother'spropertynowownedbyeitherpartyoranypropertyacquiredinthefuture.     9 5: 8   / Eachpartyagreestoexecuteanydocumentnecessarytocomplywiththetermsofthisagreement.    8   / ThisagreementshallbeincorporatedinanydecreeofdivorcebetweenthepartiessubjecttotheapprovaloftheCourtinwhichsuchdivorceisheard.      InthisdissolutionagreementAppellee,AnnetteCarolJenkins,waivedserviceofprocessandallowedappellanttoproceedwithoutcontest.ThefinaldecreeofdivorcewasenteredJanuary16,1991,whereinAppellantwasgrantedadivorceonirreconcilabledifferencesgroundswiththedecreeproviding,inpart:8   / UponthereadingoftheComplaint,examinationofthewitnessesinopenCourtaccordingtolaw,andfromalltheproof;    8   / ItappearingtotheCourtthatthepartieshavenominorchildrenbornofthismarriage.    8   / ItfurtherappearingtotheCourtthatthepartieshaveenteredintoaMaritalDissolutionAgreementcontainingthedispositionoftheirrealandpersonalproperty.    8   / ItisTHEREFOREORDERED,ADJUDGEDandDECREEDthatthebondsofmatrimonyheretoexistingbetweenthepartiesbeandthesameareherebyandperpetuallydissolvedandthePlaintiffisvestedwithalltherightsandprivilegesofanunmarriedperson.    8   / ItisFURTHERORDERED,ADJUDGEDandDECREEDthattheMaritalDissolutionAgreementheretoforeenteredintobyandbetweenthepartiesbefiledaspartofthisrecord,andshallbeherebyadoptedandfiledinallrespectsandincorporatedinandmadeapartofthisdecree. OnJune9,1997,Appelleeansweredthepetitiontomodifydenyinganybasisthereforeandseekingjudgmentofdismissal. 847 Ї  ThepetitiontomodifywasheardbythetrialjudgeonSeptember19,1997,andafterconsideringthememorandumoflawfiledbytheappellantandtheargumentofcounselthetrialcourtdismissedthepetition,holding:8   / ThatthepaymentsetoutintheFinalDecreeofthedivorceofthePartieswasthePlaintiff'smilitaryretirementforwhichthewifewasentitledtoonehalfthereofasmaritalproperty,andPlaintiffshouldnotbeentitledtomodifythisCourt'sFinalDecreeconcerningthedivisionofthatmaritalproperty.    8   / ITISTHEREFORE,ORDERED,ADJUDGEDANDDECREED,thatthePlaintiff'sPetitionisdismissedwithprejudice,andallcostsaretaxedtothePlaintiff,forwhichexecutionmayissueifnecessary.      Theonlywaytheappellantcansucceedinanattempttomodifythefinaldecreeatthislatedateistoestablishthattheprovisionsofparagraph7ofthemaritaldissolutionagreementconstitutealimonyinfuturoratherthaneither h alimonyinsolidoordistributionofmaritalproperty. Themaritaldissolutionagreementinthiscaseisdevoidofanymentionofobligationsforfuturesupportoralimonyofanykind.Itispurelyacontractualagreementdisposingofmaritalassets.Themaritaldissolutionagreementthusdoesnotloseitscontractualnaturebymergerintothedecreeofdivorce.Assuch,themaritaldissolutionagreementdoesnotfallwithinthecontinuingjurisdictionofthecourt.
