OnNovember16,1994,thehusband,ThomasHoraceJoiner,filedsuitforabsolutedivorce. OnNovember1,1995,thewife,DoraBellTaylorJoiner,filedananswerandcounterclaim. OnJuly18,1996,thepartiesfiledwiththeTrialCourtamaritaldissolutionagreement. OnSeptember27,1996,theTrialCourtenteredadecreeofdivorcefrombedandboardwhichprovided:   `  TheCourtfurtherfindsandgrantsaBedandBoardDivorcebetweenthepartiestobeconvertedtoanAbsoluteDivorceeffectiveNovember1,1996. ITIS,THEREFORE,ORDERED,ADJUDGEDANDDECREEDBYTHECOURTTHAT: 1. ABedandBoardDivorceisherebygrantedbetweenThomasHoraceJoiner,PlaintiffandDoraBellTaylorJoiner,Defendantonthegroundofirreconcilabledifferences.EffectiveNovember1,1996,thisBedandBoardDivorceshallbeconvertedtoanAbsoluteDivorceandonNovember1,1996thepartiesshallbegrantedanAbsoluteDivorcefromeachotherwithThomasHoraceJoinerandDoraBellTaylorJoinerbeingrestoredtoalloftherights,privilegesandimmunitiesofanunmarriedperson,theCourtdeclaringthemtobedivorcedonthegroundofirreconcilabledifferences. Onappeal,thewifepresentsasingleissueasfollows:   `  I. DidtheTrialCourterrbyoverrulingthedefendantsmotiontosetasidethefinaldecreeofdivorcefiledpursuanttoRule60.02oftheTennesseeRulesofCivilProcedure?     ThedecreeofdivorcefrombedandboardenteredonSeptember27,1996,wasafinal,appealablejudgmentastothedivorcefrombedandboard.However,thepeculiarwording(shallbe)preventeditfrombeingafinal,appealablejudgmentofabsolutedivorcewhichhadnot,atthattime,beengranted.UntiltheTrialCourtentersanordergrantinganabsolutedivorcewhichiseffectiveuponentry,thematterofthegrantingofanabsolutedivorcewillnotbethesubjectofafinal,appealablejudgmentandtheTrialCourtwillbefreetoreviseitstentative,prospective,prospectivedecisiontograntanabsolutedivorceonafuturedate.TRCPRule54.02. Theauthorityofdivorcecourtstoconvertadivorcefrombedandboardintoanabsolutedivorcehaslongbeenrecognized.Hackneyv.Hackney,28Tenn.,9Humph450.InLingerv.Linger,165Tenn.525,565S.S.2d749(1933),theSupremeCourtrecognizedtheunfairnessof enforcedcelibacyandorderedadivorcefrombedandboardconvertedintoanabsolutedivorcewheretherewasnohopeofreconciliation. T.C.A.364102readsinpartasfollows:   ` (b) Thecircuit,chanceryorsuchothercourtspeciallyempoweredtograntdivorcesalsohasthepowertograntabsolutedivorcestoeitherpartywheretherehasbeenafinaldecreeofdivorcefrombedandboard,orofseparatemaintenanceformorethantwo(2)years,uponapetitionbeingfiledbyeitherpartythatsetsforththeoriginaldecreefordivorcefrombedandboard,orseparatemaintenance,andthatthepartieshavenotbecomereconciled.Thecourtgrantingtheabsolutedivorceshallmakeafinalandcompleteadjudicationofthesupportandpropertyrightsoftheparties.However,nothinginthissubsectionshallprecludethedivorceforumfromgrantinganabsolutedivorcebeforethetwo(2)yearshasexpired.(Emphasissupplied)     InAbneyv.Abney,61Tenn.App.531,456S.W.2d364,(1970),thisCourtheldthatitisnotmandatorythattheabsolutedivorcebegrantedonthesolegroundoftwoyearsseparationwithoutreconciliation,withoutpleadingandproofofothergrounds.Thesameauthorityheldthatthepolicyofthelawistoencouragereconciliationratherthantorewardarefusaltobereconciled.Riggsv.Riggs,181Tenn.633,184S.W.2d9(1945).SeealsoMatthewsv.Matthews,24Tenn.App.580,148S.W.2d3,(1941). Boththestatuteandtheauthoritiesappeartorequireafurtherpetitionofapartyandfurtherconsiderationbythedivorcecourtasaprerequisitetotheconversionofadivorcefrombedandboardintoanabsolutedivorce. Sincetherecordcontainsnosuchsupplementalpetition,theSeptember27,1996,anticipatorygrantofanabsolutedivorceeffectiveNovember1,1996,wasineffective.The shallbeverbiageoftheSeptember27orderwasconfirmationofthisproceduralomission.TheanticipatorygrantofanabsolutedivorcecannotbeconsideredafinaljudgmentfromwhichreliefcanbegrantedunderRule60.02whichprovidesthatitisapplicableonlytofinaljudgments. Inviewoftheforegoing,theargumentsofthepartiesastothecorrectnessofthedenialofRule60.02becomemoot.ThatpartofthejudgmentoftheTrialCourtwhichdeniedreliefunderRule60.02isaffirmed. ThatpartofthejudgmentoftheTrialwhichgrantedanabsolutedivorceisvacatedwithoutprejudicetofurtherhearing,considerationandactionbytheTrialCourtuponthesubjectofanabsolutedivorce.Thecauseisremandedforfurtherproceedings.Costsofthisappealaretaxedagainsttheappellant.
