IrespectfullydissentfromthemajoritysaffirmationofthetrialcourtsgrantofsummaryjudgmenttodefendantTiptonCounty.IbelievethattheallegationsintheComplaint,togetherwiththeplaintiffsaffidavits,aresufficienttosurvivethedefendantsmotionforsummaryjudgment. Intheircomplaint,theJonesesavergenerallythata defectiveunsafeordangerousconditionexistedwithrespecttotheroadinquestion.Themajorityrightlynotesthattheonlyspecificfactcitedinsupportofthisallegationisthepurportedexistenceofa largepotholeorsinkholeintheroad....Theplaintiffshaveproducednoevidencethatthedefendantshadactualorconstructiveknowledgeofthepotholeorsinkhole.Therefore,ifthepotholeorsinkholeweretheonlyallegeddefectintheroad,summaryjudgmentwouldbeappropriate. However,Mr.JonesalsofiledanaffidavitinresponsetotheCitysmotiontodismissinwhichhestatedthathe wentoverahillataspotwheretheroadcurvestotheleft.Atthispointintheroad, therewerenosignswarningofahillorcurvesatthisspot.Heallegesthatinadequatesigns,a dangerousdropoffandlackofguardrailscreatedadangerouscondition.Obviously,thedefendantswouldhavenoticeofthesignage,thecurveintheroadandthelackofguardrails. InTennessee,apleading which,byfairandnaturalconstruction,showsasubstantialcauseofaction,issufficient,andeveryreasonablepresumptionmustbemadeinitsfavor,notagainstit. Wheelerv.CityofMaryville ,203S.W.2d924,926,29Tenn.App.318,32122(1947).Here,thecomplaintgenerallyallegesadangerousconditionandcitesonlythepotholeorsinkholeasaspecificfactsupportingtheallegation.However,theplaintiffsaffidavitcitesadditionalspecificfactstofurthersupporttheComplaintsgeneralallegationofadangerouscondition.' AlthoughthisCourthasnodutytocreateaclaimthepleaderdoesnotspelloutinitscomplaint, seeDonaldsonv.Donaldson ,557S.W.2d60,62(Tenn.1977),wewillgiveeffecttothesubstanceratherthantheformandterminologyofapleading.
