WilliamJoneshasanextensivecriminalrecord.InMarch1976,hewasconvictedinaShelbyCountyCriminalCourtofsevencountsofgrandlarcenyandreceivedsevenconcurrentthreetofiveyearsentences.HewasparoledtoaHaywoodCounty_detainer_ԀinApril1977andapparentlyescapedwhileinHaywoodCountyscustody.HewasrecapturedandreturnedtostatecustodybutwasapparentlyreleasedonparoleinJuly1977.Twomonthslater,Mr.Jonesandaconfederate_kidnapped_ԀawomaninHaywoodCounty.Duringthenextmonth,Mr.JonesparticipatedinastringofarmedrobberiesinShelbyCounty,resultinginthedeathofoneperson. OnMay1,1978,Mr.JoneswassentencedinHaywoodCountytoservetentofifteenyearsforsimplerobberyandthirtyyearsforkidnapping._ @   _ԀOnNovember30,1978,hereceivedanotherfivetotenyearsentencein_Fayette_Countyforsimplerobbery.OnDecember18,1978,hewassentencedinHaywoodCountytotwoyearsforescapeandtwoyearsforpetitlarceny.Finally,onJanuary22,1979,Mr.JoneswassentencedinShelbyCountytoconcurrent62yearsentencesforseconddegreemurderandsixcountsofarmedrobbery.Mr.JonesisnowincarceratedattheTurneyCenterservinganindeterminatesentenceof47to62years. Since1992,Mr.Joneshasfiledfiveseparateactionsinthreedifferenttrialcourtschallengingvariousaspectsofhissentence.TheproceduralconfusioncausedbythesedifferentsuitshasbeencompoundedbytheimprecisionofMr.JonessnumerousprosepapersandbytheDepartmentspreferencefordilatorypleadingsratherthandirectresponsestoMr.Jonessassertions.Inordertoavoidaddingtotheconfusion,wefinditnecessarytopointoutatthisearlystagewhatthiscaseisaboutand,ofequalimportance,whatitisnotabout. ThiscaserelatessolelytothemannerinwhichtheDepartmentofCorrectionhascalculatedMr.Jonessgoodconductsentencecredits.ItdoesnotinvolvehishabeascorpuspetitionassertingthatthepassageoftheTennesseeCriminalSentencingReformActof1989reducedhissentence._ A   _ԀItdoesnotinvolveeitherhispetitionfordeclaratoryjudgmentassertingthathehadbeenwrongfullyexcludedfromconsiderationforearlyrelease B   ׀orhismotionintheCircuitCourtforHaywoodCountytocorrecthiskidnappingsentence._ C   _ԀFinally,itdoesnotinvolvehishabeascorpuspetitionattackingthevalidityofhiskidnappingsentence._ D   _ InJune1992,Mr.JonesrequestedadeclaratoryrulingfromtheDepartmentconcerningthecomputationofhissentencecredits.Heassertedthathewasentitledto5,086daysofcreditforgoodandhonortimepriortoJuly1,1981,incentivetimeunderTenn.CodeAnn.4121228(1982)(Repealed1985),andgoodconductsentencecreditsunderTenn.CodeAnn.4121229(1982)(Repealed1985).AftertheDepartmentdidnotrespond,Mr.JonesfiledapetitionfordeclaratoryjudgmentintheChanceryCourtforDavidsonCounty.Thetrialcourtsummarilydismissedthepetition;however,thiscourtvacatedthesummaryjudgmentandremandedthecasetotheDepartmentwithdirectionstoconsiderMr.Jonessrequestforadeclaratoryorder.Jonesv.Reynolds,App.No01A019302CH00055,1993WL166925(Tenn.Ct.App.May19,1993),perm.app.denied,(Tenn.Sept.7,1993). Onremand,theDepartmentslawyerdeniedMr.Jonessrequestforadeclaratoryruling,statingformulaicallythathispetitionwas notwelltakenandis,therefore,denied.OnFebruary28,1994,Mr.Jonesfiledanotherpetitionfordeclaratoryjudgmentinthetrialcourt.TheDepartmentmovedforsummaryjudgment,relyingonaffidavitsoftwoemployeesresponsibleforcomputingsentencecreditsandparoleeligibilitydates.OneemployeestatedthatMr.Joneshadbeenawarded atotalof1,872daysinIncentiveCreditsand_PPSC_andthathisprobationaryparoledatewasFebruary18,2002.TheotheremployeestatedthatMr.JonessprobationaryparoledatewasDecember30,2002. E    ThedifferencebetweenthetwoprobationaryparoledateswascompoundedtendayslaterwhenMr.JonesreceivedaletterfromadifferentDepartmentemployeeonanothermatterstatingthathisinitialparolehearingwouldbein1996._ F   _ԀMr.JonescounteredtheDepartmentsaffidavitswithhisownaffidavitcontainingayearbyyearcalculationofhissentencecredits.AccordingtoMr.Jones,hewasentitledto4,298daysofsentencecredits,andhisprobationaryparoleeligibilitydateshouldhavebeenin1992.OnNovember9,1994,thetrialcourtdeniedtheDepartmentssummaryjudgmentmotionwithoutprejudiceonthegroundsthattheDepartmenthadnotaddressedwhetherMr.JoneswaseligibletocontinuetoearnTenn.CodeAnn.4121228incentivecreditsandhadnotexplainedtheearliercorrespondenceandemailmessagestatingthatMr.Jonessinitialparolehearingwouldbein1996. InJanuary1995,theDepartmentreneweditsmotionforsummaryjudgmentandprovidedtwonewsupportingaffidavits.OneaffidavitaddressedtheearliercorrespondenceaboutMr.Joness1996paroledate.ThesecondaffidavitcontainednewcalculationsconcerningMr.Jonesssentencecreditsandprobationaryparoledate.Contrarytotheearlieraffidavits,thesecondaffidavitstatedthatMr.JonessprobationaryparoledatewasnowDecember20,2001andthathehadbeenawarded 2,247days_PPSC_,whichincludesanyIncentivetimeearnedandmaintainedpriortoSeptember1,1980.NeitheraffidavitofferedanexplanationforthedifferencesintheDepartmentspreviouscalculationsofMr.Jonesssentencecreditsandprobationaryparoledate. Inanefforttotraversethisfactuallabyrinth,thetrialcourtdirectedthepartiestoaddressthequestionofwhethercalculatingMr.JonesssentencecreditspursuanttostatutespassedafterhewasconvictedviolatedtheexpostfactoclauseinU.S.Const.art.I,10,cl.1.Afterreceivingthepartiesresponses,thetrialcourtagaingrantedtheDepartmentsmotionforsummaryjudgment.Whenthetrialcourtdeniedhispetitionforrehearing,Mr.Jonesagainappealedtothiscourt.@ II.  Prisonersdonothaveaninherentrighttosentencereductioncredits.Thesecreditsarecreaturesofstatute,andthustherighttoreceiveoraccruecreditsdependsonthestatutesauthorizingthem.TheDepartmenthasadministeredseveraldifferentsentencecreditprogramssinceMr.Joneswasfirstincarcerated.Thus,asourfirstorderofbusiness,wemustidentifythesentencecreditlawsapplicabletoMr.JonesbeforewecanbegintodeterminewhethertheDepartmenthascorrectlycalculatedhissentencereductioncredits.@ A. @ GoodConductSentenceCredits  WhenMr.Joneswasfirstincarceratedforhiscurrentconvictions,prisonerswereentitledtoreceivecreditsforgoodbehavior,seeTenn.CodeAnn.41332(1975)(repealed1985) G   ׀andadditionalcreditsforhonortime.SeeTenn.CodeAnn.41334(1975)(repealed1985). H   ׀Tenn.CodeAnn.41332providedthatprisonerscouldearnonemonthofgoodtimecreditforthefirstyearofincarceration,twomonthsofcreditforthesecondyear,threemonthsforthethirdyear,andfourmonthsforeverysubsequentyearofimprisonment.Inadditiontothesegoodtimecredits,Tenn.CodeAnn.41334authorizedtwomonthsofhonortimecreditforeachyearoftheprisonerssentence. In1980theGeneralAssemblyenactednewsentencecreditstatutesthatwereintendedtocompletelyreplaceTenn.CodeAnn.41332and41334beginningonJuly1,1981. I   ׀Tenn.CodeAnn.41359(laterdesignatedasTenn.CodeAnn.4121229)establishedasystemof goodconductsentencecreditsthatprisonerscouldearnbyproperbehavior,andTenn.CodeAnn.41361(laterdesignatedasTenn.CodeAnn.4121231)providedamechanismforconvertingTenn.CodeAnn.41332and41334creditsearnedpriortoJuly1,1981to goodconductsentencecredits.TheGeneralAssemblyenvisionedthatthenewgoodconductsentencecreditprogramwouldapplyacrosstheboardtoallprisonersandthusdidnotprovideawaiveroroptinsystemtoprisonerswhocommittedcrimespriortoJuly1,1981. TheGeneralAssemblyenactedanothersentencereductionprogramin1985thatestablisheda prisonersentencereductioncreditprogram. J   ׀PrisonerswhocommittedfeloniespriortoDecember11,1985couldnotparticipateinthisprogramunlesstheysignedawrittenwaiverinaccordancewithTenn.CodeAnn.4121236(c)(3),236(g)(1990).Prisonerselectingnottosignawaivercontinuetoaccruesentencereductioncreditsinaccordancewiththeapplicablepreexistingsentencecreditstatutes.SeeTenn.CodeAnn.4121236(g).@ B.@ IncentiveSentenceCredits  InadditiontobeingabletoearnthesentencecreditsauthorizedbyTenn.CodeAnn.41332and41334,prisonerswerearealsoabletoearneducationalandjobperformancecreditswhenMr.Joneswasincarceratedforhispresentoffenses.SeeTenn.CodeAnn.41358(1975)(repealed1985). K   ׀ThisstatutepermittedprisonerstoearnincentivecreditsforparticipatingineducationalprogramsapprovedbytheDepartmentorforperforming aboveaverageinjobplacements.Thesecreditsaccruedattherateofonedayofcreditforeachsixdaysofparticipationduringthefirsttenyearsofaprisonerstermandthereafterincreasedtotwodaysofcreditforeverysixdaysofparticipation.Prisonerscouldnotearnmorethanthirtydaysofincentivecreditduringthefirstyearoftheirsentence;theycouldearnnomorethansixtydaysperyearduringthesecondthroughtenthyearsoftheirsentence;andtheycouldearnnomorethanninetydaysperyearthereafter. In1980,theGeneralAssemblyenactedanotherincentiveprogramoffering prisonerperformancesentencecredits(commonlyreferredtoas _PPSC_).SeeTenn.CodeAnn.41360(Supp.1981)(repealed1985). L   ׀Thisprogrampermittedprisonerstoearnbetweenoneandfifteendaysofincentivecreditpermonthdependingontheprogramtowhichtheywereassigned.WhilethisstatutedidnotexpresslyrepealTenn.CodeAnn.41358,itslanguagepermitsnootherresult._ M   _ TheGeneralAssemblyrepealedthe_PPSC_Ԁprogramin1985inthesamelegislationthatestablishedtheprisonersentencereductioncreditprograminTenn.CodeAnn.4121236. N   ׀The1985statutepermitsprisonerswhocommittedtheiroffensespriortoDecember11,1985tooptintothenewsentencereductioncreditprogram.PrisonersoptingintothenewprogramaccrueprisonersentencereductioncreditsinaccordancewithTenn.CodeAnn.4121236(a).PrisonerselectingnottooptintothenewprogramcontinuetoearnprisonerperformancesentencecreditsunderTenn.CodeAnn.4121230.SeeTenn.CodeAnn.4121236(g).@ C.  Mr.JonescommittedhisoffensespriortoDecember11,1985.Accordingly,heisnotentitledtoearncreditsunderTenn.CodeAnn.4121236(a)unlesshesignedawrittenwaiverinaccordancewithTenn.CodeAnn.4121236(c)(3),236(g).SincethereisnoevidenceinthisrecordthatMr.Joneshassignedthiswaiver,_ O   _ԀheisentitledtoearngoodconductcreditsinaccordancewithTenn.CodeAnn.4121229andtoaccrueprisonerperformancesentencecreditsinaccordancewithTenn.CodeAnn.4121230.Withtheselegalconclusionsinmind,wewillnowproceedtoexaminetheDepartmentsmotionforsummaryjudgment.@ III.  Mr.Jonesspapers,construedintheirmostfavorablelight,appeartoclaimthattheDepartmenthasincorrectlycalculatedhissentencereductioncreditsfortworeasons:firstbecauseithasunconstitutionallyappliedlaterenactedsentencecreditstatutestohimandsecondbecauseitscalculationscontainmistakes.TheDepartmentsaffidavitspurporttoprovideundisputedfactsdemonstratingthatitisentitledtoajudgmentasamatteroflawonbothclaims.@ A. TheexpostfactoclausesinbothU.S.Const.art.I,10,cl.1andTenn.Const.art.I,11prohibittheenactmentoflawsthatretroactivelydisadvantageprisonersbyincreasingtheirpunishment._Lynce_Ԁv._Mathis_,___U.S.___,___,117S.Ct.891,896(1997);California_Dept_ԀofCorrectionsv.Morales,514U.S.499,___,115S.Ct.1597,1601(1995);Statev._Ricci_,914S.W.2d475,480(Tenn.1996).Theypreventlegislaturesfromincreasingcriminalpunishmentsbeyondthoseprescribedwhenthecrimewascommitted.SincethesentencereductioncreditstatutesinexistencewhenMr.Jonescommittedhiscrimeswereinherentlypartofhissentence,_Gilliam_Ԁv.State,174Tenn.388,391,126S.W.2d305,306(1939),anylaterenactedsentencecreditstatutesthatretroactivelyreducetheamountofsentencecreditsMr.Jonesmayearnviolatetheexpostfactoclauseofthestateandfederalconstitutionsiftheyimposegreaterpunishmentafterthecommissionoftheoffense.SeeWeaverv.Graham,450U.S.24,36,101S.Ct.960,968(1981). Mr.Jonessclaimsinthiscasedonotimplicatethe1985statutesestablishingtheprisonersentencereductioncreditprogrambecausehehasneveroptedintothisprogram.Therefore,hisexpostfactoclaimscanonlyrelatetothetransitiontothegoodconductsentenceprogramunderTenn.CodeAnn.4121229in1981andtothetransitiontothe_PPSC_ԀprogramunderTenn.CodeAnn.4121230in1980. WecanfindnoexpostfactoproblemwithincludingMr.JonesinthegoodconductsentencecreditprogramunderTenn.CodeAnn.4121229.BasedonourunderstandingoftheoperationofTenn.CodeAnn.41332and41334andTenn.CodeAnn.4121229,Mr.JonesearnsmoresentencecreditsunderTenn.CodeAnn.4121229thanhedidunderthepriorlaw. P   ׀SinceTenn.CodeAnn.4121229decreasesratherthanincreaseshispunishment,itisnotsurprisingthatMr.JonesstronglyinsiststhatheisentitledtosentencecreditsunderTenn.CodeAnn.4121229ratherthanunderthestatutesexistingatthetimeofhisoffense. ThesamereasoningappliestoMr.Jonessparticipationinthe_PPSC_program.TherecordcontainsnoevidencethatthechangefromtheincentiveprogramunderTenn.CodeAnn.4121228tothe_PPSC_ԀprogramunderTenn.CodeAnn.4121230hadtheeffectofdecreasingMr.Jonessabilitytoaccrueincentivecredits.Onitsface,Tenn.CodeAnn.4121230permitsprisonerstoearnmoreincentivecreditsthantheycouldpreviouslyearn._ Q   _ԀAccordingly,placingMr.JonesunderTenn.CodeAnn.4121230doesnotamounttoanexpostfactoviolation. R    Mr.JonessabilitytoearnsentencereductioncreditsisgovernedbyTenn.CodeAnn.4121229and4121230.Inlightoftheevidenceinthisrecord,applyingthesestatutestoMr.Joneshasnothadtheeffectofincreasinghispunishmentbeyondthatinexistenceatthetimehecommittedhisoffenses.Accordingly,thetrialcourtproperlygrantedthesummaryjudgmentdismissingMr.Jonessexpostfactoclaims.@ C.@ TheDepartmentsCalculationErrors  TheonlyremainingissueconcernsMr.JonessclaimsthattheDepartmentscalculationofhissentencereductioncreditscontainserrors.Fouryearsago,weremandedthiscasefortheexpresspurposeofobtainingarecordthatwouldfacilitateproperreviewofMr.Jonesspetition.Unfortunately,neithertheDepartmentsdenialofMr.Jonesspetitionforadeclaratoryrulingnoritssubsequentaffidavitscontainthesoughtafterinformation.Thus,thetrialcourtandthiscourthavestillnotbeenprovided thebenefitoftherecordmadeintheagency.Jonesv.Reynolds,supra,1993WL166925,at*1. ThereexistatleastfiveopportunitiesforerrorinthecalculationofsentencecreditsforprisonerslikeMr.Jones.TheDepartmentcouldbeusingthewrongstatutestocalculatehissentencecredits,ortheDepartmentcouldhaveoverlookedcreditstowhichheisentitled.TheDepartmentcouldalsohaveerredinitsconversioncalculationsunderTenn.CodeAnn.4121231orinitscalculationofMr.JonesscreditsunderthestatutesthatreplacedthesentencecreditstatutesineffectwhenMr.Jonescommittedhisoffenses.Finally,theDepartmentcouldhavemadeimproperorerroneousdeductionsfordisciplinaryorotherreasons. Asweunderstandtherecord,Mr.JonesisnotassertingthattheDepartmentisapplyingthewrongsentencecreditstatutestohim.Infact,bothMr.JonesandtheDepartmentappeartoagreethathissentencecreditsshouldbecalculatedinaccordancewithTenn.CodeAnn.4121229.Inaddition,Mr.JonesdoesnotappeartobeassertingthattheDepartmentoverlookedanyofhiscredits,thattheDepartmentsconversioncalculationswereincorrect,orthattheDepartmenthaserroneouslytakencreditsawayfromhim.Thus,theonlydisputedissueappearstoinvolvethemannerinwhichtheDepartmentcalculatedhissentencecreditsunderTenn.CodeAnn.4121229. Mr.Jonesprovidedthetrialcourtwithhisownyearbyyearcalculationsofhissentencecredits.Inresponse,theDepartmentfiledaffidavitscontainingtheresultsofitscalculationswithoutprovidingthecalculationsthemselves.TheDepartmentsmostrecentaffidavit,forexample,statesthatMr.Jonesreceived 2,247days_PPSC_,whichincludesanyIncentivetimeearnedandmaintainedpriortoSeptember1,1980.ThisresponseisinadequatebecauseitdoesnotenablethecourtstoreviewinanymeaningfulwayhowtheDepartmentarrivedatthe2,247dayfigure.Inordertoreviewissuesofthissort,theDepartmentshould,ataminimum,providethecourtswithyearbyyearcalculationsshowing(1)thestatutesunderwhichtheprisonerisearningcredits,(2)thenumberofgoodconductsentencecreditsearnedpursuanttoeachstatute,(3)thenumberofincentivecreditsearnedpursuanttoeachstatute,and(4)anycreditsdeductedandthereasonsforthededuction.   TheDepartmenthasmademuchofthefactthatMr.Jonesssentenceswillbereducedbymorethanthirtyfiveyearsbasedonitscalculationofhissentencecredits.Thisargumentisnotresponsivetotheissue.ThemerefactthattheDepartmenthasreducedMr.JonesssentencebyastatednumberofyearsdoesnotresolvewhetherMr.Joneshasreceivedallthecreditsduehimunderthelawproperlyapplicabletohim.ThecourtsinterestisnotinhowmuchMr.Jonesssentenceisreducedbutratherinseeingtoitthatthelawisproperlyapplied. Boththiscourtandthetrialcourtare,inreality,inasmuchneedofanadequaterecordtodayaswewerefouryearsago.TherearesimplytoomanyvariablesinthecalculationofMr.JonesssentencecreditsforthecourtstoaccepttheresultsoftheDepartmentscalculationsontheirface.OurconcernisunderscoredbythefactthattheDepartmentscalculationsofMr.Jonesssentencecredits,andinfactMr.Jonessowncalculations,haveproduceddifferentandunexplainedresults.Accordingly,wevacatetheportionsofthesummaryjudgmentnotpertainingtoMr.JonessexpostfactoclaimswithoutprejudicetothepartiessubmittingproperevidenceandrecordsdemonstratingthepropercalculationandapplicationofallapplicablecreditstoMr.Jonesssentence.@ IV.
