ÐÌÓ€ÓAt€the€conclusion€of€the€February€10€hearing,€the€trial€judge€made€the€followingÏstatement€from€the€bench:ÌÓ€Óà8 Ø àà N àIððm€going€to€grant€his€motion€mainly€because€this€side€of€theÏroom€was€not€honest€with€The€Court,€and€Iððm€very€much€madeÏaware€of€that.€€Iððm€going€to€be€cognitive€of€it€from€this€point€on.€ÏIððm€going€to€order€that€this€child€will€remain€temporarily€in€theÏcustody€of€the€[F]ather,€until€school€ends,€and€then€the€child€will€beÏreturned€to€the€[M]other.Ð Ø ü!Ø ü! Ðà8 Ø àà N àShe€will€be€awarded€a€judgment€of€$9,840€in€back€childÏsupport.€€Iððll€reserve€any€payment€on€that€until€the€child€is€returnedÏto€the€[M]other€the€first€of€June.€€He€will€have€every€other€weekendÏand€30€days€in€the€summer,€which€can€be€the€month€of€July.€€IððllÏentertain€attorney€fees€and€sanctions€in€this€regard.Ð Ø ü!Ø ü! ÐÌÌÓ€Óà Ø àWith€all€deference€to€the€trial€court,€this€adjudication€subordinates€theÏinterest€of€the€child€to€the€trial€courtððs€revulsion€to€the€dishonest€conduct€of€theÐ k9.3 ÐFather.€€The€trial€court€very€properly€took€offense€when€allegations€of€theÏamended€petition€of€the€Father,€made€under€oath€and€forming€the€basis€for€theÏtrial€courtððs€issuance€of€a€temporary€restraining€order,€were€established€by€theÏproof€to€be€essentially€false€allegations.€€However,€it€is€well€established€that€theÏwelfare€and€best€interests€of€the€child€are€the€paramount€considerations€inÏdetermining€custody.€€òòWhitaker€v.€Whitakeróó,€957€S.W.2d€834,€837€(Tenn.€App.Ð ã  Ð1997).ÌÌà Ø àThe€standards€under€which€the€adjudication€should€be€made€have€beenÏstated€by€this€court.ÌÓ€Óà8 Ø àà N àIn€recognition€of€the€importance€of€stability€and€continuity,Ïcustody€and€visitation€decisions,€once€made€and€implemented,€areÏres€judicata€upon€the€facts€in€existence€or€reasonably€foreseeableÏwhen€the€decision€was€made.€òòóóÐ DØ ü!Ø ü! Ðà8 Ø àà N àNotwithstanding€the€importance€of€stability€and€continuity,Ïintervening€changes€in€a€childððs€circumstances€may€requireÏmodifying€an€existing€custody€and€visitation€arrangement.€ÏTenn.Code€Ann.€ðð€36„6„101(a)(1)€(Supp.1997)€empowers€the€courtsÏto€change€custody€ð ðas€the€exigencies€of€the€case€may€require,ðð€andÏcourts€will€change€custody€when€the€party€seeking€to€changeÏcustody€proves€(1)€that€the€childððs€circumstances€have€materiallyÏchanged€in€a€way€that€could€not€have€been€reasonably€foreseen€atÏthe€time€of€the€original€custody€decision,òòóó€and€(2)€that€the€childððsÐ Â'æ  Ðbest€interests€will€be€served€by€changing€the€existing€custodyÏarrangement.€€òòóóÐæ) "Ø ü!Ø ü! ÐòòÌÓ€ÓAdelsperger€v.€Adelspergeróó,€970€S.W.2d€482,€485€(Tenn.€App.€1997)€(citationsÐ  ,.!$ Ðomitted).€€Accordingly,€we€must€first€determine€from€this€record€whether€theÏcircumstances€of€the€child€have€materially€changed€in€a€way€that€could€not€haveÏbeen€reasonably€foreseen€at€the€time€of€the€final€decree€of€divorce€and€custody,ÏJune€22,€1993.ÌÌà Ø àThe€great€majority€of€the€testimonial€record€consists€of€the€testimony€ofÏthe€Father€and€of€the€Mother,€who€was€called€as€a€witness€by€the€Father.€€FromÏthe€record,€it€was€established€that€the€child,€Bridget,€six€years€old€at€the€time€ofÐ â8.4 Ðthe€hearing,€had€very€little€stability€in€her€life€between€the€time€of€the€divorceÏdecree€of€June€22,€1993€and€the€period€immediately€preceding€the€hearing€inÏJanuary€and€February€of€1998.€€In€August€1993,€the€Mother€gave€the€child,€thenÏless€than€two€years€of€age,€to€the€Father€and€moved€to€Texas€for€six€months.€ÏFortunately,€the€paternal€grandmother€was€available€to€care€for€the€child.€The€ÏMother€then€returned€from€Texas€and€resided€with€a€man€named€Dedmon€for€aÏshort€period€of€time.€€Then€she€resided€with€the€Father€for€a€period€of€time€beforeÏmoving€into€an€apartment€with€a€female€co„worker.€€After€moving€in€withÏanother€man€for€a€short€period€of€time€with€the€minor€child,€the€Mother€removedÏthe€child€from€Tennessee€to€Orlando,€Florida€to€live€with€another€man.€€She€thenÏbegan€dating€Brian€Swain,€whom€she€married€in€November€1996,€after€givingÏbirth€to€his€child€in€September€1996.€€On€November€17,€1996,€while€the€MotherÏwas€intoxicated€in€the€presence€of€the€minor€child,€Swain€was€arrested€for€assaultÏupon€the€Mother.€ÌÌà Ø àDuring€most€of€the€time€between€the€divorce€decree€and€the€custodyÏhearing€in€early€1998,€the€Mother€worked€in€a€series€of€establishments€in€theÏadult€entertainment€business.€€While€in€the€custody€of€the€Mother,€the€child€neverÏsaw€a€dentist€and€the€Mother€could€not€recall€how€many€separate€day€careÏfacilities€the€child€had€attended.€€Also,€while€in€the€Motherððs€custody,€the€childÏattended€J.€E.€Moss€Elementary€School€for€kindergarten,€receiving€poor€grades,Ïhaving€excessive€absenteeism€and€having€behavioral€problems.ÌÌà Ø àAbout€March€1,€1997,€Bridget€went€to€live€with€the€Father.€€While€theÏforegoing€recitation€of€facts€indicating€instability€in€Bridgetððs€life€caused€by€theÏaction€or€inaction€of€the€Mother€is€serious,€this€is€somewhat€counter„balanced€byÏthe€less€than€ideal€conduct€of€the€non„custodial€Father.€€He€was€badly€delinquentÏin€his€child€support€and€he€had€his€own€live„in€companions.€€The€apparentÏperiodic€haven€of€refuge€for€Bridget€was€her€paternal€grandmother.ÌÐ k9.: ÐÓ<€ü(‚XN ¦˜‘X€ü(‚XN ˜‘X<Óà Ø àWhen€Bridget€moved€in€with€the€Father€around€March€1997,€he€was€livingÏwith€Karen€Peterson.€€Two€months€after€Bridget€moved€in€with€the€Father,€heÏfiled€his€petition€and€amended€petition€for€change€of€custody€seeking€and€gettingÏa€restraining€order€against€the€Mother.€€The€allegations€he€made€to€justify€aÏrestraining€order€consisted€of€nothing€except€a€detailed€recitation€of€matters€thatÏhe€had€known€about€for€months.€€Had€the€trial€judge€known€the€truth,€doubtlessÏthe€restraining€order€would€not€have€been€issued.€€Likewise,€the€FatherÏconveniently€forgot€to€tell€the€trial€judge€at€the€time€he€asked€for€the€restrainingÏorder€that€he€was€living€with€the€child€and€Ms.€Peterson€without€the€benefit€ofÏmarriage.€€ÌÌà Ø àIn€spite€of€these€shortcomings€of€the€Father,€it€is€clear€from€the€testimonyÏof€school€teachers€and€school€personnel€of€the€Rutherford€County€School€SystemÏthat€Bridget€experienced€a€complete€turnabout€in€school€once€she€started€livingÏwith€the€Father.€€Her€teacher,€Denise€Reed,€testified:ÌÓ€Óà8 Ø àà N àQ.à ¦ àMs.€Reed,€how€is€she€doing€in€school?Ðñ"Ø ü!Ø ü! Ðà8 Ø àà N àA.à ¦ àShe€was€what€I€would€consider€a€solid€student.€€SheÐ $' Ðwas€always€prepared€for€class.€€She€always€had€her€homework€a€dayÏearly.€€Her€reading,€she€was€on€level€for€reading€and€on€level€for€allÏof€her€subjects.Ð Ø ü!Ø ü! Ðà Ø àà N àA.à ¦ àVery€well€taken€care€of.Ð î  ÐÌÓ€ÓSubsequent€to€May€30,€1997,€the€Father€and€Karen€Peterson€married€and,€at€theÏtime€of€trial,€they€were€living€with€Bridget€at€180€Stones€River€Lane€inÏMurfreesboro,€Tennessee.€€Karen€Peterson€is€a€Middle€Tennessee€StateÏUniversity€graduate€working€as€an€administrative€assistant€at€Audio€VideoÏConcepts.ÌÌà Ø àThe€Father€has€carried€his€burden€of€proof€to€establish€a€material€changeÏof€circumstances€involving€Bridget€that€could€not€have€reasonably€been€foreseenÏat€the€time€of€the€June€22,€1991€custody€decision.€€òòMcDaniel€v.€McDanielóó,€743Ð ê ÐS.W.2d€167,€169€(Tenn.€App.€1987).€€Now€it€must€be€determined€if€it€is€in€theÏchildððs€best€interest€that€custody€be€changed€to€the€Father.€€The€observations€ofÏthe€trial€court€about€the€immaturity€and€instability€of€both€of€these€parents€areÏclearly€born€out€by€the€record€in€this€case.€€In€this€comparative€fitness€analysis,Ïwe€must€seek,€as€did€the€court€in€òòGaskill€v.€Gaskillóó,€936€S.W.2d€626€(Tenn.€App.Ð ñ" Ð1996).€€We€are€not€faced€with€a€choice€between€parents€who€have€displayedÏsound€parenting€judgment€in€the€past,€but€rather€a€comparison€between€twoÏyoung€parents€who€have€displayed€the€imperfections€of€people€lacking€inÏmaturity€and€stability.€€The€record€shows€that€the€Father,€despite€all€of€his€faults,Ïis€comparatively€a€more€fit€custodial€parent€for€Bridget.€€Since€the€child€was€anÏinfant,€the€Mother€has€moved€from€place€to€place€and€from€companion€toÏcompanion€with€less€than€adequate€regard€for€the€welfare€of€Bridget.€€In€soÏdoing,€she€has€failed€to€provide€Bridget€with€a€stable,€consistent€environment.€ÏòòóóThe€Father,€on€the€other€hand,€seems€to€have€finally€settled€into€a€marriage€andÐ d1ˆ&/ Ðenvironment,€bringing€the€kind€of€stability€and€continuity€that€is€so€essential€toÏthe€well€being€of€a€small€child.€€òòSee€Taylor€v.€Tayloróó,€849€S.W.2d€319,€328Ð š4¾)3 Ð(Tenn.€1993).€€This€stability€is€manifested€by€the€change€in€BridgetððsÏperformance€in€school,€both€academically€and€behaviorally.ÌÐ k9.9 Ðà Ø àIt€is€noted€that€this€case€was€decided€below€on€a€Rule€41.02(2)€motion€andÏthus€dismissed€at€the€conclusion€of€the€Fatherððs€proof.€€It€is,€however,€concededÏby€counsel€for€the€Mother,€that€the€Mother€would€have€offered€no€additionalÏproof€since€the€Father€called€the€Mother€as€a€witness€in€the€case.€€The€judgmentÏof€the€trial€court€with€regard€to€custody€is€reversed,€and€custody€of€Bridget€isÏgranted€to€the€Father,€Joseph€Larry€Keasler.€€ÌÌà Ø àThe€evidence€in€the€case€supports€the€child€support€arrearage€judgment€inÏfavor€of€the€Mother€in€the€amount€of€$9,840.00,€and€this€is€not€seriouslyÏcontested€on€appeal.€€The€action€of€the€trial€court€in€this€respect€is€affirmed.ÏFinally,€the€Father€complains€of€the€attorney€fees€award€in€the€amount€ofÏ$2,500.00€made€by€the€trial€court.€€In€view€of€the€finding€by€this€court€that€theÏFatherððs€petition€for€change€of€custody€is€well€taken,€the€judgment€for€attorneyÏfees€will€be€reversed.ÌÌà Ø àThe€judgment€of€the€trial€court€is€reversed€as€to€the€custody€award,Ïaffirmed€as€to€the€judgment€for€child€support€arrearage€against€the€Father€andÏreversed€as€to€the€award€of€attorney€fees.€€The€case€is€remanded€for€such€otherÏproceedings€as€are€needed€consistent€with€this€judgment.€€Costs€of€appeal€areÏassessed€against€the€appellee,€the€Mother.€ÌÌÓ?€ü(‚XN ¦ÍðX€ü(‚XN ¦˜‘X?ÓÓ€Óà Ø àà N àà ¦ àà Í à__________________________________Ìà Ø àà N àà ¦ àà Í àWILLIAM€B.€CAIN,€JUDGEÌÌÌÌÌÌÌÌÌCONCUR:ÌÌÐ k9.6 Ð___________________________________ÌBEN€H.€CANTRELL,€P.J.,€M.S.ÌÌÌ___________________________________€ÌWILLIAM€C.€KOCH,€JR.,€JUDGE
