Assoonashewasparoledthesecondtime,Mr.KeyfiledadeclaratoryjudgmentactionintheChanceryCourtforDavidsonCountychallengingtheBoards1992decisiontorescindhisoriginalparoleandthecalculationofhissentencereductioncredits.ThetrialcourtdismissedMr.KeyspetitiononthegroundthattheBoardsactionscouldonlybereviewedusingacommonlawwritofcertiorari. ThepowertopardonorparolerestsintheExecutiveBranch.SeeTenn.Const.art.III,6.Accordingly,theBoardis_wielding_Ԁexecutivepowerwhenitmakesparoledecisions,andthesedecisions,ifmadeaccordingtolaw,arenotreviewablebythecourts.SeeTenn.CodeAnn.4028115(c)(1997);Flowersv._Traughber_,910S.W.2d468,470(Tenn._Crim_.App.1995).Prisonersseekingtochallengethefundamentallegalityofaparoledecisionmaydosousingacommonlawwritofcertiorari,seePowellv.ParoleEligibilityReviewBd.,879S.W.2d871,873(Tenn.Ct.App.1994),butmaynotobtainjudicialreviewbydeclaratoryjudgment.SeeWatsonv.Tennessee_Dept_ԀofCorrection,No.01A019707CH00360,1998WL4707,at*2(Tenn.Ct.App.Jan.9,1998),perm.app.denied(Tenn.May26,1998).Accordingly,theportionofMr.Keyspetitionchallengingtherecisionofhisfirstparolefailstostateaclaimuponwhichreliefcanbegranted. Likewise,theportionofMr.Keyspetitionchallengingthecalculationofhissentencecreditsfailstostateaclaim.TheTennesseeDepartmentofCorrection,nottheBoard,isresponsibleforadministeringtheprisonersentencereductionprogram.Accordingly,Mr.KeyhassuedthewrongagencyandisentitledtonorelieffromtheBoard.
