àThe€parties€were€married€on€November€11,€1990.€€The€houseÏwhich€became€the€marital€residence€was€originally€owned€by€theÏplaintiff,€Ann€C.€King,€(wife).€€On€December€3,€1991,€the€partiesÏexecuted€a€warranty€deed€creating€a€tenancy€by€the€entirety€in€theÏmarital€residence€which€converted€the€property€into€marital€prop…erty.€€The€warranty€deed€states:ÌÓÓÌà8 àà àIt€is€the€express€intention€of€[the€wife]€to€createÏa€tenancy€by€the€entireties€in€herself€and€her€husband,ÏDavid€M.€King€in€and€to€the€above€described€real€proper…ty€[the€marital€residence]€in€accordance€with€the€provi…sions€of€T.C.A.€ðð€66„1„109.ÌÌÌÓÓà àIn€January€of€1992,€the€parties€refinanced€their€home.€€AtÏthat€time€the€property€was€encumbered€by€a€mortgage€in€the€princi…pal€amount€of€approximately€$100,000.00.€€The€parties'€new€mort…gage€was€in€the€principal€amount€of€$120,000.00.€€Thus,€the€in…debtedness€on€the€marital€residence€was€increased€by€an€additionalÍ$20,000.00.€€The€additional€funds€were€spent€by€the€parties€toÏrenovate€the€house.€€The€renovation€resulted€in€an€increase€in€theÏvalue€of€the€property.ÌÌà àAt€the€time€of€the€marriage,€the€husband€was€employed€by€aÏcompany€called€Nichisu€America,€Inc.€€The€company€œterminated€itsÏAmerican›€workers€during€1993€and€1994,€resulting€in€the€husband'sÏloss€of€his€job.€€The€husband€filed€suit€against€Nichisu€forÏwrongful€discharge,€and€this€lawsuit€is€apparently€still€pendingÏin€federal€court.€€After€he€was€œterminated€by€Nichisu,›€the€husbandÏstarted€his€own€company€called€Total€Production€Resources.€€HisÏnew€business€began€operation€in€August€or€September€of€1994.ÌÌà àOn€February€15,€1995,€the€parties€borrowed€$15,000.00€to€helpÏfinance€the€husband's€new€business.€€This€loan€was€secured€by€aÏsecond€mortgage€on€the€marital€residence.€€The€business€had€cashÏflow€problems,€and€in€early€1995,€the€parties€jointly€signed€aÏnote€payable€to€the€husband's€business€partner,€Bill€Smith,€forÏ$25,000.00.€€The€money€was€also€used€to€help€finance€Total€Produc…tion€Resources.ÌÌà àIn€November€of€1993,€the€parties€purchased€some€rental€prop…erty,€consisting€of€two€houses€located€in€Clinton.€€The€purchaseÏprice€for€the€rental€property€was€$20,000.00.€€The€parties€mort…gaged€the€property€in€the€amount€of€$38,400.00.€€The€additionalÏ$18,400.00€was€used€to€renovate€the€houses.€€The€wife€testifiedÏthat€they€borrowed€an€additional€$25,423.00€in€order€to€get€theÏhouses€in€"livable€condition."€ÌÌà àThe€parties€separated€on€September€5,€1995.€€The€wife€filedÏfor€divorce€on€October€13,€1995.€€The€husband's€answer€stated:€"inÏan€effort€to€achieve€an€equitable€and€expeditious€resolution€ofÏthis€matter,€defendant€alleges€in€the€affirmative,€without€admit…ting€to€any€specific€act€or€conduct,€that€plaintiff€is€entitled€toÏa€divorce€pursuant€to€T.C.A.€ðð€36„4„102(a)(1)."€€ÌÌà àIt€appears€from€the€testimony€that€the€parties€kept€theirÏfinances€entirely€separate€during€the€marriage.€€Until€theirÏseparation,€the€wife€paid€65%€of€the€first€mortgage€on€the€maritalÏresidence€and€the€husband€paid€35%.€€The€wife€testified€that€theÍhusband€insisted€on€this€arrangement€because€the€wife's€two€daugh…ters€from€a€previous€marriage€lived€with€them€in€the€house.€€TheÏhusband€made€payments€on€the€second€mortgage€until€the€partiesÏseparated.€€It€is€undisputed€that€the€husband€never€made€anyÏpayments€on€the€rental€property€encumbrances€and€had€very€little,Ïif€anything,€to€do€with€the€rental€property€during€the€marriage.€ÏDuring€the€approximately€13€months€between€the€parties'€separationÏand€the€divorce€hearing,€the€wife€made€all€payments€on€the€firstÏand€second€mortgages€on€the€marital€residence€and€the€rentalÏproperty€encumbrances.€€ÌÌà àAfter€a€bench€trial€on€October€11,€1996,€a€final€decree€wasÏentered€on€October€28,€1996.€€The€trial€court€found€the€value€ofÏthe€marital€residence€to€be€$160,000.00€and€established€the€equityÏtherein€at€$43,000.00.€€The€trial€court€further€found€that€theÏequity€in€the€rental€houses€was€$23,000.00.× ƒ+ ××  ×€€The€trial€court'sÏmemorandum€opinion€reflects€the€following€regarding€equity€andÏindebtedness:ÌÓÓÌà8 àà àThe€Court€finds€that€there€is€an€equity€in€theÏmarital€home€of€$43,000.€€The€Court€further€finds,€basedÏupon€the€testimony,€that€there€is€an€equity€in€theÏrental€property€of€$23,000.ÌÌà@ à*€€€€*€€€€*€€€€*ÌÌà8 àà àI€have€a€total€debt€of€nearly€$41,500,€when€IÏconsider€all€of€the€debt.€€The€Court€recognizes€thatÏthere€has€been,€during€the€period€of€separation,€aÏsubstantial€sum€of€money€that€Mrs.€King€has€paid€towardsÏthe€joint€debts€of€the€parties,€and€I€believe€that€it€isÏappropriate€to€award€the€marital€residence€and€theÏrental€property€to€Mrs.€King€and€to€require€her€toÏassume€all€of€the€marital€debt€as€set€forth€on€her€list,Ïwhich€is€some€nearly€$42,000.€€So€there's€$46,000€[sic]Ïin€equity,€and€nearly€$42,000€in€debt€that€the€CourtÏassigns€to€her€with€respect€to€those€items.× ƒ, ××  ×ÌÌÌÌÓÓà àThe€trial€court€assigned€to€the€husband€the€responsibility€ofÏpaying€the€$25,000.00€debt€to€his€business€partner.€€The€courtÏawarded€each€party€the€personal€items€in€his€or€her€possession,Ïwith€the€exception€of€certain€items€belonging€to€the€husband€whichÏwere€still€at€the€marital€residence.€€These€items€were€ordered€toÏbe€turned€over€to€the€husband.€€The€court€awarded€the€husband€allÏinterest€in€his€wrongful€discharge€claim€against€his€former€em…ployer.ÌÌà àRegarding€distribution€of€marital€property,€T.C.A.€ðð€36„4„121Ïprovides€in€relevant€part:ÌÌÓÓà8 àò òDistribution€of€marital€property.€ð"ð€ó à(10)€Such€other€factors€as€are€necessary€to€consid…er€the€equities€between€the€parties.ÌÌÌÓÓà àWe€will€first€consider€the€trial€court's€action€in€awardingÏthe€marital€residence€entirely€to€the€wife.€€As€noted€earlier,€theÏwife€testified€she€had€made€all€payments€on€the€residence€sinceÏthe€parties€separated€some€13€months€prior€to€the€hearing.€€TheseÏpayments€amounted€to€some€$20,000.00.€€It€is€altogether€reasonableÏto€give€credit€to€the€wife€for€these€payments€in€dividing€theÏequity€in€the€marital€residence.€€Further,€the€court€ordered€theÏwife€to€assume€approximately€$42,000.00€in€marital€debt€not€in…cluding€the€first€and€second€mortgage€on€the€marital€residence,Ïwhich€she€is€also€required€to€pay.€€Therefore,€the€equity€in€theÏmarital€residence€œwas,€for€all€practical€purposes,›€offset€by€theÍdebts€assigned€to€the€œwife,€without€giving€consideration€or€creditÏfor€payments€made€on€marital€debts€during€the€period€of€separa…tion.›€€Under€these€circumstances,€and€after€considering€all€rele…vant€statutory€provisions,€we€find€no€inequity€in€awarding€theÏmarital€residence€to€the€wife.€€In€support€of€the€award€of€theÏequity€in€the€marital€residence€and€the€assignment€to€her€of€theÏindebtedness,€we€note€that€in€viewing€the€relative€earning€capaci…ties,€both€present€and€future,€the€wife€is€the€only€party€which€isÏreasonably€capable€of€satisfying€the€indebtedness.€The€wife,€in€aÏfinancial€statement€filed€with€the€court€dated€October€1,€1996,Ïstated€that€her€net€monthly€income€was€$6,613.00.€€The€husband'sÏfinancial€statement,€filed€October€1,€1996,€placed€his€net€monthlyÏincome€at€$2,663.88€ð"ð€less€than€one„half€that€of€the€wife.€€ÌÌà àWe€find€that€the€evidence€does€not€preponderate€against€theÏtrial€court's€decision€to€award€the€wife€the€rental€property€alongÏwith€the€attendant€debt€on€that€property.€€Although€the€rentalÏproperty€was€marital€property,€the€husband€had€no€involvement€withÏit€during€the€marriage€and€made€no€payments€on€the€mortgage€or€theÏother€debts€incurred€to€improve€the€property.€€Further,€while€theÍcourt€found€that€there€was€equity€of€$23,000.00€in€the€rentalÏproperty,€this€finding,€apparently,€was€without€regard€to€theÏadditional€expenditures€over€and€above€the€receipts€from€theÏmortgage€on€the€property€which€were€required€to€make€the€rentalÏproperty€œlivable.€€Nevertheless,€after€giving€the€wife€creditÏ(here‚inbefore€discussed)€for€the€payments€made€during€the€parties'Ïseparation,€little,€if€any€of€the€equity€in€the€rental€propertyÏremains.›ÌÌà àWe€recognize€that€the€division€made€by€the€trial€court€is€notÏœentirely›€equal€division.€€It€is€well„settled,€however,€that:ÌÌÓÓà8 àThe€trial€court's€goal€in€every€divorce€case€is€toÏdivide€the€parties'€marital€estate€in€a€just€and€equita…ble€manner.€The€division€of€the€estate€is€not€renderedÏinequitable€simply€because€it€is€not€mathematicallyÏequal,€òòCohen€v.€Cohenóó,€937€S.W.2d€823,€832€(Tenn.€1996);ÏòòEllis€v.€Ellisóó,€748€S.W.2d€424,€427€(Tenn.€1988),€orÏbecause€each€party€did€not€receive€a€share€of€every€itemÏof€marital€property.€òòBrown€v.€Brownóó,€913€S.W.2d€[163]€atÏ168.€Marital€debts€should,€where€possible,€follow€theirÏassociated€assets,€òòœMondelli›€v.€Howardóó,€780€S.W.2d€769,Ï773€(Tenn.€App.€1989),€and€should€be€apportioned€byÏconsidering€the€reason€for€the€debt,€the€party€whoÏbenefitted€from€the€debt,€and€the€party€better€able€toÏassume€the€debt.€òòMahaffey€v.€Mahaffeyóó,€775€S.W.2d€[618]Ïat€624.€In€the€final€analysis,€the€justness€of€a€partic…ular€division€of€the€marital€property€and€allocation€ofÍmarital€debt€depends€on€its€final€results.€òòSeeóó€òòThompsonÏÔ& àWith€regard€to€the€debt€owed€to€the€husband's€business€part…ner€in€the€amount€of€$25,000.00,€the€evidence€does€not€preponder…ate€against€the€trial€court's€judgment€assigning€responsibilityÏfor€payment€to€the€husband.€€The€wife€testified€that€she€receivedÏno€benefit€from€the€$25,000.00,€which€œwas,€as€hereinbefore€noted,›Ïused€to€finance€the€husband's€new€business.€€ÌÌà àThe€husband€complains€on€appeal€that€"the€Trial€Court€failedÏto€award€an€adequate€monetary€judgment€to€[him]€for€personaltyÏdenied€to€him€by€the€[wife]."€€It€appears€that€the€parties€had€aÏdifficult€time€agreeing€on€a€date€and€time€for€the€husband€to€pickÏup€the€personalty€which€was€awarded€to€him€but€still€in€the€wife'sÏpossession€at€the€time€of€divorce.€€On€February€21,€1997,€theÍhusband€filed€a€motion€"for€an€Order€requiring€the€plaintiff€toÏturn€over€those€personal€items€that€she€was€required€to€do€pursu…ant€to€the€Court's€Opinion€of€October€4,€1996."€€On€May€21,€1997,Ïthe€husband€filed€a€motion€for€a€hearing€"to€determine€the€valueÏthat€the€plaintiff€may€owe€for€her€failure€to€turn€over€all€of€theÏrespective€property€that€the€defendant€was€to€receive€pursuant€toÏthe€various€Court's€Orders€..."€€ÌÌ€à àA€hearing€was€held€on€July€28,€1997€to€determine€the€value€ofÏthe€husband's€property€not€returned€by€the€wife.€€The€trialÏcourt's€order€dated€August€25,€1997€states€in€part:ÌÓÓÌà8 àthe€Court€having€heard€the€statements€of€counsel,€testi…mony€of€the€parties€and€their€witnesses€and€the€recordÏas€a€whole,€from€all€of€which€it€is€accordingly€ORDEREDÏ...ÌÌà8 àà à1.€That€the€defendant,€David€M.€King,€is€herebyÏawarded€a€Judgment€against€the€plaintiff,€Ann€King€inÏthe€amount€of€$511.03€being€made€up€of€$150.00€for€theÏfailure€to€return€a€sofa€and€$361.33€for€discretionaryÏcosts€for€the€costs€and€expenses€of€the€hearing€of€thisÏcause.ÌÌÌÓÓà àThe€apparent€thrust€of€the€husband's€argument€on€appeal€isÏthat€the€trial€court€failed€to€award€him€sufficient€credit€forÍpersonal€items€not€returned€by€the€wife.€€There€is€no€transcriptÏof€the€hearing€in€the€record,€œand,€therefore,›€no€œtestimony€in€theÏrecord›€as€to€what€items€were€not€returned€by€the€wife.€€There€is€aÏsingle€handwritten,€unsworn€and€unsigned€exhibit€in€the€recordÏstyled€"items€not€returned,"€with€a€list€of€various€items€andÏtheir€estimated€œvalues.Ì›€€ÌÓÓà8
