WaymonHale,alicensedgeneralcontractor,builtahouseinWarrenCountyforafamilynamedKuhr.ThehousewassubstantiallycompletedinJuneof1985,butMr.Kuhrdiedbeforetakingpossession.In1987,inthesettlementofMr.Kuhrsestate,thehousewasdeededtoLenoreH.Heidemann,Mr.Kuhrsbusinesspartner.  Ms.HeidemannwasalsoaffiliatedwithMr.Hale,andshedeededthehousetothetwoofthemjointlyinDecemberof1987,atwhichtimeMr.Haleandhiswifemovedintotheproperty.̜  Whilethepropertywasstillvacantin1987,theplaintiffMrs.KinneylookedatitbutdecidedtobuyanotherresidenceinCoffeeCounty.In1990Mrs.KinneylookedatthehouseagainandonSeptember21,1990signedacontracttopurchaseitfor$100,000.Herhusbandalsosignedthecontract,althoughhewasatthattimeinfailinghealth.Hediedduringtheproceedingsbelow.Thecontractcontainedaprovisionstating, unlessotherwisespecifiedhereinthispropertyispurchasedasisandneitherthesellernoragentmakesorimpliesanywarrantiesastotheconditionofthepremises.TheKinneystookpossessiononoraboutOctober17,1990underawarrantydeedsignedbyMr.HaleandMs.Heidemann.  InDecemberof1990andagaininFebruaryof1991,afteraperiodofunusuallyheavyrainfall,Mrs.Kinneydiscoveredwaterstandingaroundandunderthehouse.Shealsosaidthattheroofleaked,especiallyaroundthechimney,andthatchipsbegantofallfromthebricksiding.TheKinneysfiledthisactioninJuneof1991againstMr.HaleandMs.Heidemann.  Mrs.KinneytookavoluntarynonsuitastoMs.HeidemanninJuneof1996.Mr.Halefiledamotiontodismissin1993,andthepartiesfiledvariousevidentiarymaterial,includingMrs.Kinneysaffidavitanddeposition,anaffidavitfromMrs.hale,andMr.Halesdeposition.ThetrialjudgetreatedthemotionasoneforsummaryjudgmentandgrantedthemotiononOctober30,1996.@ II.@ BreachofWarranty   Mrs.KinneyreliesonthelimitedwarrantyestablishedinDixonv.MountainCityConstructionCo.,632S.W.2d538(Tenn.1982).TheSupremeCourt,however,carefullylimitedthewarrantyrecognizedinthatcasetorecentlycompleteddwellings,andthereachofthewarrantyonlytotheinitialvendees.632S.W.2dat541.Perhapsmoreimportantly,thewarrantyisimpliedonlywhenthewrittencontractissilent.Id.at542.  Noneoftheconditionsunderwhichthewarrantywouldarisearepresentinthiscase.Mr.andMrs.Kinneywerenottheinitialvendees;thehousewasbuiltin1985,andtheHaleshadlivedinitfortwoyearswhenitwastransferredtotheKinneys;andthecontractcontainedthe asislanguage.  Nordowefindintherecordanybasisonwhichwecouldfindanexpresswarranty.Inheraffidavit,Mrs.Kinneymakesonlytwoassertionsoffactbearingonthisquestion.Shesaysthatwhenshelookedatthehousein1990sheaskedMrs.Haleifthey(theHales)hadhadanywaterstandingaroundorunderthehouse.Mrs.Halestatedthattheyhadnothadanywaterproblems.ϜShealsosaidthatinOctoberof1990,whenMr.Halegaveherakeytothehouse,hetoldherthatthehousewasbuiltforamanwhohadsomekindoflungorbreathingproblemsandthatunderneaththehouseandthebrickhadbeentreatedtomakeitmoistureproof.  InherdepositionMrs.Kinneysaidthatwhenshelookedatthehousein1987,theagenttoldherthatthehousehadbeenspeciallytreatedfordampness.SherepeatedthefactthatMrs.Haletoldherin1990thattheyhadnotexperiencedanywaterproblemsandsherelatedagainhowMr.Haletoldherwhenhegaveherthekeythatthehousehadbeenspeciallytreatedformoisture.  Mrs.HalefiledheraffidavitstatingthatpriortothesaletotheϜKinneysshewasnotawareofanywaterproblemsatthehouse.Thereisnoproofintherecordthatpriortothesale,theHalesdidhaveanyknowledgeaboutwaterproblemsunderthehouseorofanyproblemswithaleakingroof.  Awarrantyisarepresentationmade insuchmannerandcircumstancesastoauthorizethebuyertounderstandthatthesellerintendedtobeboundbythemasapartofthecontractofsaleandhemusthavepurchasedinrelianceonthem.Wallacev.McCampbell,156S.W.2d442at444(Tenn.1941).Measuredbythisstandard,Mrs.Halesstatementthattheyhadnotexperiencedanywateraroundorunderthehousecannotamounttoawarranty.Mr.HalesallegedstatementafterthepropertyhadbeendeededtotheKinneyscouldnothavehadanyeffectontheKinneysdecisiontomakethepurchase.Therefore,theKinneyscouldnotbaseaclaimonexpresswarranty.@ III.@ Misrepresentations   WearesatisfiedthatthesamefactscompelaconclusionthatMr.HaledidnotmakeanyactionablemisrepresentationstoMrs.Kinneyconcerningtheconditionoftheproperty.Relianceisakeyelementinanactionfordeceitwhetheratlaworinequity.SeeHaynesv.CumberlandBuilders,Inc.,546S.W.2d228(Tenn.App.1976).Onthebasisofthisrecord,theKinneyscouldnothavereliedonMr.Halesrepresentationinmakingthedecisiontopurchasetheproperty.  AstoMrs.Halesstatement,thereisnothingintherecordfromwhichaninferencecouldbedrawnthatherstatementwasfalse.Sofarastherecordshowsherstatementthattheyhadneverhadanywaterproblemsatthehousewastrue.ThewaterproblemsshowedupinFebruaryof1991aftersomerecordrainfallinthatmonthandinDecemberoftheprioryear.Ifinfactthewaterproblemsexistedpriortothesale,thereisnoproofthatMrs.Haleknewaboutthem.SeeGibbsv.Odell,42Tenn.132(1865).@ IV.@ FaultyDesignorConstruction   Mr.Hale,asthebuilder,mighthavebeenliablefortheharmcausedbydesignorconstructiondefectsinthehouse.Butthelegislaturehasplacedanoutsidelimitoffouryearsaftersubstantialcompletionontherighttorecoverforanyinjuries,topersonsorproperty,resultingfromthedesignorconstruction.SeeTenn.CodeAnn.283202.Thishousewassubstantiallycompletein1985.Therefore,thisaction,filedin1991,comestoolate.̛̜  ThejudgmentofthetrialcourtisaffirmedandthecauseisremandedtotheCircuitCourtofWarrenCountyforanyfurtherproceedingsnecessary.Taxthecostsonappealtotheappellants.       ____________________________       BENH.CANTRELL,JUDGECONCUR:_______________________________HENRYF.TODD,PRESIDINGJUDGEMIDDLESECTION_______________________________WILLIAMC.KOCH,JR.,JUDGE   Ԝ
