àThe€Barrs€are€owners€of€three€tracts€of€property€designated€in€CheathamÏCounty,€Tennessee,€as€Map€53,€Parcels€102.01,€102.04,€and€22.01.€€œThese›€threeÏparcels€of€land€were€purchased€by€the€Barrs€between€July€of€1973€and€the€end€ofÏ1975.€€œIn›€June€of€1973,€Cheatham€County€passed€a€comprehensive€zoning€ordinance.€ÏOver€the€years,€the€zoning€plan€was€amended€several€times.€€A€comprehensive€zoningÏplan€was€in€effect€at€the€time€the€Barrs€purchased€each€tract€of€land€in€question.€€ÌÌà àAt€the€time€of€trial,€Willie€Barr€had€been€in€the€tire€disposal€business€for€34Íyears.€€œSince›€1971,€he€has€disposed€of€tires€on€the€property€mentioned€òòsupraóó.€ÏBecause€of€this,€the€Barrs€contend€that€their€use€of€the€property€in€question€as€a€tireÏlandfill€prior€to€June€of€1973€entitles€them€to€continue€these€practices€under€œtheÏconcept›€of€prior€non„conforming€use€as€set€forth€in€Tenn.€Code€Ann.€ðð€13„7„208(b).€€œItÏis€sharply€disputed€which›€œparcels›€were€originally€used€for€tire€disposal€prior€to€theÏimplementation€of€Cheatham€Countyððs€comprehensive€zoning€œordinance.›€€The€BarrsÏmaintain€that€they€used€the€majority€of€parcel€102.04€and€small€portions€of€œparcelsÏ102.01€and€22.01.›€œ€Appellants,€on€the€other€hand,€contend€that€the€Barrsðð€use€of€theÏland€should€not€qualify€as€a€prior€non„conforming€use€because€the€use€of€the›€œparcelsÏas€a€tire€landfill€was€never€legal€prior€to€the€implementation€of€the€Cheatham€CountyÏcomprehensive€zoning€ordinance.›€œ€Alternatively,›€appellants€insist€that€even€if€theÏBarrsðð€use€of€the€land€is€a€prior€non„conforming€one,€this€use€was€limited€to€œparcel›Ï102.04.€œAs›€such,€appellants€maintain€that€the€Planning€Commission€and€the€Board€ofÏZoning€Appealsðð€decision€to€consider€the€Barrsðð€tire€landfill€as€a€prior€non„conformingÏuse€applies€only€to€parcel€102.04€œto›€the€exclusion€of€parcels€102.01€and€22.01.€ÌÌà àThe€Barrs€were€in€the€process€of€obtaining€a€landfill€permit€from€the€state€ofÏTennessee€when,€in€1992,€they€requested€a€rezoning€of€approximately€20€acres€ofÏtheir€property.€€œIn€the€Barrsðð€application€for€rezoning,€only€parcel€102.04€was€listed€forÏconsideration.€€However,€a€map,€as€shown€in€exhibit€3,€accompanied€the€application.€ÏThis€map€depicted€portions€of€all€three€parcels.€€The€Planning€Commission€and€BoardÏof€Zoning€Appeals€declared€the€use€of€the€area€as€a€tire€landfill€to€be€a€prior€non„conforming€use€and€found€rezoning€to€be€unnecessary.€€There€is€some€dispute€as€toÍwhether€the€Planning€Commission€and€Board€of€Zoning€Appeals€considered€onlyÏparcel€102.04€when€they€declared€the€use€of€the€property€as€a€tire€landfill€to€be€a€priorÏnon„conforming€use€or€whether€they€considered€the€area€encompassing€portions€of€allÏthree€parcels€as€evidenced€by€the€map€presented€at€the€meetings.€€›€€ÌÌà àœAfter€the€Planning€Commission€and€Board€of€Zoning€Appeals€declared€that€theÏproperty€was€a€prior€non„conforming€use€and€after›€œthe€Barrs€spent€approximately›Ï$360,000€to€meet€state€requirements€for€a€tire€disposal€landfill,€the€state€wasÏforthcoming€with€the€Barrsðð€permit€to€operate€their€tire€landfill.€€€€€€ÌÌà àThis€cause€originated€in€the€Chancery€Court€for€Cheatham€County,€Tennessee,Ïat€Ashland€City€upon€the€original€complaint€of€the€Lanes€in€which€they€alleged€theÏBarrs€had€violated€certain€zoning€ordinances€adopted€by€Cheatham€County,ÏTennessee.€€Appellants,€Kay€Grimes€and€Bobby€Joe€Knight,€were€joined€as€partiesÏafter€commencement€of€the€lawsuit.€ÌÌà àThe€Lanes€live€across€the€street€from€the€Barrs€property.€€At€trial,€Holland€LaneÏdid€not€testify,€but€his€wife€Cynthia€Lane€chose€to€do€so.€€She€admitted€that€œthey€did›€notÏpossess€a€deed€or€any€writing€to€manifest€ownership€of€the€property€they€lived€œon,›€butÏshe€insisted€that€they€had€an€oral€agreement€with€Bobby€Joe€Knight€to€purchase€theÏland.€ÌÌà àKay€Grimes€lives€across€the€street€from€the€Barrs,€approximately€an€eighth€œof€aÍmile€away.›€€œShe€and€her€husband€are€listed€on€the€deed€as€owners€of€the€propertyÏwhere€they€live.€€Mr.€Grimes€did€not€intervene€in€this€lawsuit.ÌÌà àBobby€Joe€Knight€testified€at€trial€that€ð ðBobby€Joe€Knight,€Trusteeðð€was€theÏname€listed€on€the€deed€as€the€owner€of€the€land€on€which€the€Lanes€resided.€€HisÏtestimony€is€somewhat€unclear,€however,€concerning€for€whom€he€is€holding€the€landÏin€trust.€€At€one€point€during€his€testimony,€Knight€stated€that€he€held€the€land€in€a€livingÏtrust€for€himself.€€Knight,€however,€seemed€to€contradict€this€statement€when€heÏtestified€that€the€land€belonged€to€the€Lanes.ÌÌà àThis€matter€was€heard€in€the€Chancery€Court€on€April€21,€1997.€€At€theÏconclusion€of€the€€appellantsðð€case„in„chief€the€Chancellor€dismissed€the€complaintÏupon€the€motion€of€the€Barrs,€reasoning€not€only€that›€œthe›€appellants€lacked€standing€œ›Ïœbut€also€that›€the€Barrsðð€use€of€the€land€in€question€qualified€as€a€prior€non„conformingÏuse€under€Tenn.€Code€Ann.€ðð€13„7„208(b).€€œThis›€appeal€ensued.ÌÌÓ  Óò òSTANDINGÌÓ  Óà àó óAs€mentioned€òòsupraóó,€the€trial€court€dismissed€this€matter€on€grounds€ofÏstanding.€€The€trial€court€reasoned€that€neither€the€Lanes,€Kay€Grimes,€nor€Bobby€JoeÏKnight€had€standing€to€bring€this€lawsuit€under€Tenn.€Code€Ann.€ðð€13„7„208(a)(2).€ÌÌÌà àTenn.€Code€Ann.€ðð€13„7„208(a)(2)€provides:ÌÓÓà8 àà8 à(a)(2)€In€case€any€building€or€structure€is€or€is€proposed€toÏbe€erected,€constructed,€reconstructed,€altered,€convertedÏor€maintained,€or€any€building,€structure€or€land€is€or€isÏproposed€to€be€used€in€violation€of€any€ordinance€enactedÏunder€this€part€and€part€3€of€this€chapter,€the€buildingÏcommissioner,€municipal€counsel€or€other€appropriateÏauthority€of€the€municipality,€or€any€òòadjacent€or€neighboringÏproperty€owneróó€who€would€be€specially€damaged€by€suchÏviolation,€may,€in€addition€to€other€remedies,€instituteÏinjunction,€mandamus€or€other€appropriate€action€orÏproceeding€to€prevent€such€unlawful€erection,€construction,Ïreconstruction,€alteration,€conversion,€maintenance€or€use,Ïor€to€correct€or€abate€such€violation,€or€to€prevent€theÏoccupancy€of€the€building,€structure€or€land.ÌÌTenn.€Code€Ann.€ðð€13„7„208(a)(2)(Supp.€1997)(emphasis€added).ÓÓÌÌà àThe€trial€court€provided€in€pertinent€part:à8 àÌÓÓà8 àà8 àFirst€off,€the€Lanes€have€no€standingò ò€ó óin€this€court.€€There€isÏno€question€about€that.€€Thatððs€clear.€€The€only€statute€I€canÏfind,€it€says,€ð ðadjacent€or€neighboring€property€owners.ðð€ÏTheyððre€not€either.ÌÌà8 àà8 àMr.€Bobby€Joe€Knight,€obviously,€from€whatððs€before€theÏCourt€is€thereððs€an€indispensable€party€out€thereÏsomewhere,€because€he€only€owns€that€property€as€aÏtrustee.€€I€donððt€know€who€he€holds€it€for,€but€he€holds€it€as€aÏtrustee.€€So€obviously,€thereððs€an€indispensable€party€outÏthere€somewhere.ÌÌà8 àà8 àNow,€Mrs.€Kay€Grimes,€on€the€other€hand,€does€have€œan›Ïinterest€in€property.€€Sheððs€an€intervening€party,€but€she€hasÏan€interest€in€the€property€along€with€her€husband.€€So€IÏthink€that€definitely€she€will€be€an€adjacent€and€neighboringÏproperty€owner.ÌÌà8 àà8 àBut€what€does€Mrs.€Grimes€say?€€ð ðI€just€donððt€want€it€outÏthere.ðð€€You€know,€ð ðI€just€donððt€want€it.ðð€€No€damages.€€ItððsÏnot€bothering€her.€€ð ðI€just€donððt€want€it.ðð€€Thatððs€all€she€says.ÌÌà8 àà8 àWeððve€got€to€have€more€than€that.€€So€on€those€issues,€IÍwould€find€for€the€defendants,€.€.€.ÌÌÌÌÓÓà àUndoubtedly,€the€Lanes€have€no€standing€to€bring€this€lawsuit.€€They€are€notÏð ðadjacent€or€neighboring€property€owners.ðð€€The€proof€in€the€record€only€evinces€aÏpossible€oral€agreement€between€the€Lanes€and€Bobby€Joe€Knight€for€the€Lanesðð€rightÏto€purchase€the€property€in€the€future.€€Indeed,€they€are€not€listed€on€the€deed€as€theÏowners.ÌÌà àKay€Grimes,€on€the€other€hand,€is€truly€a€property€owner.€€She€owns€herÏproperty€not€solely€but€as€a€tenant€by€entirety€with€her€husband,€Lawrence€Grimes.€€InÏtheir€brief,€the€Barrs€argue€that€œGrimesðð›€husband,€as€a€tenant€by€the€entirety,€is€anÏindispensable€party€in€this€matter.€€This€issue€is€not€extensively€briefed,€and€we€areÏcited€to€no€authority€which€holds€that€both€tenants€by€the€entirety€are€required€to€join€asÏœplaintiffs›€when€the€lawsuit€does€œnot›€directly€concern€their€property.€€In€this€case,€theÏGrimesðð€property€is€not€the€focal€point€of€the€dispute.€€It€is€œthe€Barrsðð€adjacent›€piece€ofÏproperty€which€œis€the€focal€point€of€the€dispute.€€Grimes›€œcontends›€œthat€she€has›€sufferedÏa€loss€in€value€because€of€the€Barrsðð€tire€landfill.€€œÌÌà àMoreover,›€the€trial€court€held€that€Grimes€had€no€standing€in€this€matterÏbecause€she€alleged€no€specific€damages€to€her€property.€€However,€in€her€motion€toÏintervene,€Grimes€stated€that€the€tire€landfill€ð ðwould€affect€not€only€the€value€of€herÏproperty,€but€also€her€peace€and€enjoyment€of€her€property.ðð€€œIt›€is€the€opinion€of€thisÏcourt€that€Kay€Grimes€was€properly€before€the€trial€court€in€this€matter.Ì€€€Ìà àœð ðBobby›€Joe€Knight,€œTrustee,ðð›€is€the€name€listed€on€the€deed€to€the€propertyÏwhere€the€Lanes€reside.€€However,€Bobby€Joe€Knight€intervened€in€this€matter€in€hisÏpersonal€capacity€and€not€as€trustee€of€the€property.€€The€Barrs€contend€that€a€trusteeÏcan€bring€a€suit€for€a€beneficiary€but€insist€that€Knight€did€not€bring€this€suit€as€trustee.€ÏœWe›€are€of€the€opinion€œthat€under€these€facts›€Bobby€Joe€Knight€and€Bobby€Joe€Knight,ÏTrustee,€are€one€and€the€same.€€As€such,€it€is€not€fatal€to€Knightððs€standing€that€heÏintervened€in€his€personal€capacity€and€not€as€trustee.ÌÌà àAs€mentioned€œabove,›€the€trial€court€found€that€the€beneficiary€of€this€trust€wasÏundetermined€and€an€indispensable€party€to€this€action.€€The€trial€court€cited€no€legalÏauthority€for€its€position€nor€the€specific€facts€upon€which€œit›€based€that€ruling.€€This€is€aÏcase€in€which€the€trust€property€is€not€at€the€center€of€the€dispute.€€This€is€not€an€actionÏto€terminate€a€trust€or€to€modify€a€trust.€€This€action€has€no€interaction€with€the€trustÏitself.€€This€is€merely€an€action€by€a€trustee€to€protect€the€œòòres›óó€of€the€trust.€€We€find€thatÏthe€beneficiary€of€Knightððs€trust€is€not€a€necessary€party€to€this€action.€€Consequently,ÏKnight€was€properly€before€the€trial€court.€€€€€€ÌÌÓ  Óò òPRIOR€NON„CONFORMING€USEó óÌÓ  Óà àThe€trial€court€further€disposed€of€this€matter€by€holding€that€the€Barrsðð€use€ofÏtheir€property€as€a€tire€landfill€was€a€prior€non„conforming€use€and,€as€such,€could€beÏcontinued€without€rezoning.€€œTenn.›€Code€Ann.€ðð€13„7„208(b)€provides:€ÌÓÓà8 àà8 à(b)€In€the€event€that€a€zoning€change€occurs€in€any€landÍarea€where€such€land€area€was€not€previously€covered€byÏany€zoning€restrictions€of€any€governmental€agency€of€thisÏstate€or€its€political€subdivisions,€or€where€such€land€area€isÏcovered€by€zoning€restrictions€of€a€governmental€agency€ofÏthis€state€or€its€political€subdivisions,€and€such€zoningÏrestrictions€differ€from€zoning€restrictions€imposed€after€theÏzoning€change,€then€any€industrial,€commercial€or€businessÏestablishment€in€operation,€permitted€to€operate€underÏzoning€regulations€or€exceptions€thereto€prior€to€the€zoningÏchange€shall€be€allowed€to€continue€in€operation€and€beÏpermitted;€€provided,€that€no€change€in€the€use€of€the€land€isÏundertaken€by€such€industry€or€business.€Ìà àÌÌÌà àSpecifically,€the€trial€court€stated:Ìà8 àà8 àÌà8 àà8 àItððs€no€question€that€even€before€the€first€code€in€this€county,Ïthey€were€burying€tires€out€there.ÌÌà8 àà8 àWhat€the€Board€heard€here€was€whatððs€on€Exhibit€3.€€Iððm€notÏgoing€to€limit€them€out€there.€.€.€[t]hat€whole€area€was€there.€ÏIt€was€before€the€Board.€€All€three€pieces€of€property€wereÏbefore€the€Board.€€They€say,€ð ðWell,€weððre€not€usingÏanything,ðð€but€it€was€all€before€the€Board.€€They€passed€onÏit.€€They€said,€ð ðWell,€itððs€all€non„conforming€uses.ðð€ÌÌÓÓÌà àAppellants€contend€that€the€Barrsðð€use€of€the€land€is€not€a€prior€non„conformingÏuse€and,€alternatively,€that€if€the€Barrsðð€tire€landfill€is€a€prior€non„conforming€use,€it€isÏonly€applicable€to€parcel€œ102.04.€ÌÌà àAfter€a€careful€review€of€the€record€before€us,€we€find€that€there€is€sufficient€proofÏin€the€record€to€support€the€trial€courtððs€finding€that€the€Barrs€were€using€parcels€otherÏthan€102.04€in€their€tire€disposal€business.›€€Barr€testified€that€he€was€using€œpropertyÏother€than€parcel›€œ102.04›€in€1971,€at€least€two€years€before€Cheatham€Countyððs€firstÍcomprehensive€zoning€ordinance€came€into€being.€€œConsequently,›€œthe›€use€of€a€tireÏlandfill€on€œthis›€œland›€œcomes€within€the€scope›€of€Tenn.€Code€Ann.€ðð€13„7„208(b)€as€aÏprior€non„conforming€use.€€œAlthough€the€Barrsðð€application€for€rezoning›€œlisted›€œonly›Ïparcel€œ102.04€in€consideration€for€rezoning,€the€accompanying€map€depicted€portionsÏof€all€three€parcels.›€€œThis€map€was€presented›€to€the€Planning€Commission,€Board€ofÏZoning€Appeals,€and€the€state€of€Tennessee,€and€œultimately,€the€state€of€TennesseeÏgranted€the€Barrsðð€application€for€a€landfill€permit€for€the€area€illustrated€on€the€map.›€€ÌÌà àBased€upon€exhibit€3,€the€testimony€of€Willie€Barr,€and€the€testimony€of€R.D.ÏHuffines,€we€are€of€the€opinion€that€the€evidence€does€not€preponderate€against€theÏtrial€courtððs€finding€that€the€Barrsðð€use€of€the€acreage€depicted€in€exhibit€3€qualified€asÏa€prior€non„conforming€use.ÌÌà àAccordingly,€we€affirm€the€judgment€of€the€trial€court€dismissing€the€complaint€ofÏappellants.€€Costs€are€taxed€to€appellants,€for€which€execution€may€issue€if€necessary.€œÌÌÌÓÓà àà àà àà àà àà àà àà
