fearforthechildren.0" ` x` x   8 ` Ididntbringitoutherewithme,butIwrotedownthatacoupleof $X" timessheindicated!shestatedthatshetookthechildrenoutoftown, $D # oncetoherauntsandtosomeotherplace,andtoldtheCourtthatshe %0!$ didthatbecauseshewantedthemtobesafefromherhusband.And &"% shehasneverfearedforthesafetyofthechildreninthepresenceof '#& herhusband.Ithinkthatwasapurefabrication.(#'` x` x   8 ` Also,itmayseemtobeasmallpoint,buttheCourtwasvery |*%) botheredbysomeshopliftingincidentswhichareminorbutthey h+&* certainlyaffectapersonscredibility.IthinkthatMr._Lockmiller_Ԁand  theotherwitnesseswhotestifiedtothatweretellingtheabsolute  truth.Itwasdisturbing,anditaffectedtheCourtsassessmentofMs.  _Lockmiller_scredibility.t` x` x   8 ` Sheobviouslywasunhappyinthemarriage.Idontknowifthiswas L  beforeoraftermeetingMr.Rouse.8 ` x` x   8 ` Iknowthis,thatMr._Lockmiller_sconductwasneverprovenbya  ` preponderanceoftheevidencetoconstitutecruelandinhuman  L  treatment.Hisconceptofputtinghiswifeonapedestalmightbe  8  someoneelsesconceptofexcessivepossessiveness,butitiscertainly $  notcruelandinhumantreatment.Ithinkhedidtrustandrespecthis   wife,andIthinkhewasveryupsetatthebreakupofthemarriage. ` x` x   8 ` Idonotbelievethatherejectedcounseling.Ibelievethathewas   placedinapositionsothatMs._Lockmiller_Ԁcouldtestifythathe p rejectedcounselingbecauseshewantedadivorce.Ithinkhewanted \ tosavethemarriage,andIthinkthathewouldhaveenteredinto H meaningfulcounseling,andIdontthinkthat_that_Ԁwasofferedtohim.4` x` x   8 ` Iknowthemostimportantissuetothepartiesiswhowillbethe  \ residentialparent.H` x` x   8 ` Again,IcannotstatetoomuchhowconcernedIamaboutthe   bitternesswhichthiscasehasgenerated.IllsayIthinkagreatdeal   ofthebitternessisjustified.Butsomehowitmustbeovercome,  becauseifanybodycontinuestotrytopunishsomeone,thechildren  aregoingtosuffer.` x` x   8 ` TheCourtdoesnotmakeadeterminationofresidentialparentingin X  ordertopunishaparent.Anditcertainlywouldnotdothatinthis D! casebecausethesearebothgood,fitparents.Despiteeverything 0"  thatsbeensaidhere,thesearebothcaringparents.Thechildrenare #l! innodangerfromeitheroneofthem,andtheyneedbothparents.$X"` x` x   8 ` Buthavingweighedalltheevidenceinthiscaseandhavinglooked %0!$ atallthefactorsthattheCourtisrequiredtolookatunderthestatute, &"% Iamconvincedbyapreponderanceoftheevidencethatthefatheris '#& thefitterparenttobetheresidentialparentinthiscase.(#'` x` x   8 ` Hehasbeenastrong_caregiver_,muchmoresothanmanyfathersto |*%) whomcustodyhasbeenawarded,inmyexperience.Andnowthat h+&* thisisbehindthem,Ibelievethatheismorelikelythanthemother  wouldbetoensurethatthechildrenhaveagoodrelationshipwiththe  otherparent.` x` x   8 ` Inotherwords,Itrusthimmoretoensurethatthechildrenhave ` qualitytimeandaqualityrelationshipwiththemotherthanIwould L  trustthemotheratthisparticulartime.8 ` x` x   8 ` Hesateacher.Hesinvolvedwithchildren.Ifindnothinginthe  ` evidencethatwouldindicateanythingotherthanthathewasagood  L  teacher.Hehasbeeninvolvedinthechildrensactivities.Thatsnot  8  tosaythemotherhasnotbeen,buthehasbeenveryinvolvedand $  hesbeeninvolvedinaverypositive,constructiveway. ` x` x   8 ` Hehasstrongfamilysupport.Ididnotthinkthathesafatherwho   isseekingcustodyofhischildrentopleasehismotherorbecausehis   motherisdoingthat.Ithinkhesdoingthatbecausehefeelsthat_that_ p ishisobligation.ButIthinkhesfortunateinthesupportthathehas.\` x` x   8 ` Ifeltthathisfamilymembersdidmakegoodwitnesses.Again, 4 theressomeharshnessthere,butIthinktheyfeelthattheirfamilyhas  p beensteppedonanddemeaned,andtheyrejustified,asIvesaid,in  \ someofthat.Again,Ihopetheycanovercomethat.H` x` x   8 ` AnotherfactorthatIthinkstronglyarguesinfavorofthefatheristhat   thechildrenwillbeabletoremaininthesameenvironmentthatthey   havebeenin.#XaXXXaa##TuXXa8#XaXTu` x` x Aswillbecomeclearlaterinthisopinion,thetrialcourtscredibilitydeterminationsplaya  significantroleinourappellatereviewofthiscase. l @vv(III. Intheinstantcase,thereisanabundanceofevidencethatthereis love,affectionand  emotionaltiesexistingbetween[both]parentsand[their]_child[ren_].SeeTenn.CodeAnn.366 t 106(a)(1).Nowitnesstestifiedtothecontrarywithrespecttoeitherparent. `   ThetrialcourtbelievedthetestimonyofFather.Thisbeingthecase,weacceptastruethe 8  trialcourtsimplicitfindingthatFatherisaparentwhowasandisintimatelyinvolvedinhis $ t childrenslives.Fromchangingdiaperstobathingthechildrenanddoingtheirlaundry,Fatherhas  ` beenthereforhischildren.Itisclearfromtheproofthathehasalwaysbeenaveryactiveparent.  L  Hetakesthechildrentochurch.Hehasparticipatedindiscussionswithhisdaughtersteacher.On  8  severaloccasions,hetookhisdaughtertoschoolandgotherthereontime,somethingthatcannot $  besaidaboutMother.BecausebothparentsworkedandFathergotofffromworkearlierthan   Mother,hewouldtypicallypickuphisdaughterafterschool.SeeTenn.CodeAnn.366   106(a)(2).     Fathertookhisdaughtertoballetlessonsandhelpedhergetintoherballetuniform.Healso p tookhertoherLittleLeaguebasketballpracticesandattendedhercheerleadingpractices.Hewas \ therewhenshecheeredfortheLittleLeaguefootballteam. Id . H   MothertriedtopaintFatherasanoutofcontrol,angryindividual,whosechildrenfeared  p him.Fatherstestimonywastothecontrary.ThetrialcourtbelievedFatherwhenhesaidthe  \ childrendidnotfearhim;furthermore,thetrialcourtheldthatthetestimonyregardingFathersanger H problemswasgreatlyexaggerated.Inthisregard,itisinterestingtonotethatMothernevertestified 4 thatFatherwasviolentwithortowardher.     Itistruethat!asheadmitted!Fatherleftabruiseonhissonsbuttocksfromavery  inappropriatespankingwhenthechildwasonly18monthsold.Fathertestifiedthathenowgreatly  regretsthisinappropriatebehavioronhispart.Whilehefreelyadmittedthatheisadisciplinarian  andthathespankshischildren,hedeniedanyotherincidentsthatcausedbruisestoappearor l incidentsthatcouldbereasonablyconstruedaschildabuse.Itisclearfromthetestimonythat,save X  theone bruisingincident,Motherneverreallycomplained,priortothebreakupoftheparties D! marriagebeginninginearly2001,aboutFathersdiscipliningofthechildren.Asthetrialcourt 0"  intimated,allofthisgottobeamuchbiggerthingwithMotheraftershedevelopedaninterestin #l! anotherman. $X"   ThetrialcourtfoundthatthespankingincidentthatledtoMothersposttrial emergency %0!$ petitiondidnotamounttoabuse.Theevidencedoesnotpreponderateagainstthisfinding. &"%   ThetrialcourtrecognizedthatFatherandhisnearbyfamilywereimportantforthechildren.
