X8P15  ` OnFebruary13,1997,thehusbandfiledthepresentpetitionforreductionofalimony andterminationofinsurance.- `  `  ` Thepartiesenteredintoamaritaldissolutionagreementspecifyingdetailsofpropertydivisionandalimony,allofwhichwasapprovedandadoptedbytheTrialCourt. ` TheTrialJudgeenteredanordercontainingthefollowing:  `    Mr.Loganisaseventyyearoldgentlemanwhohasobviouslyworkedhardallhislifeandwasrecentlyinvoluntarilyretired.Mr.Loganhassincethedivorceremarried.Mrs.Logan,ontheotherhand,haschosennottoremarry,whichwouldhavestoppedthealimonyandisnowresidinginthestateofNorthCarolinawheresheislivingonsocialsecurityandsomeinterestincome.Sincetheentryofthefinaldecree,Mr.Loganhaspaidalmostonehundredeightythreethousanddollarsinalimony.  Inthisdayandagewhenmaritalvows forbetterorworse,forricherorpoorer,insicknessandinhealthanduntildeathdouspartconfrontthelegalsystemtoooftentheyarebroken,whichisunfortunate.Inthiscaseattachedtothefinaldecreeofdivorceisanegotiatedalimonyandpropertysettlementagreementnegotiatedbycompetentattorneysandbearingthesignaturesoftheparties.Contractsaremadeinthisstatetobenotonlyenforcedbutapartyisentitledtorelyuponthetermsoftheagreement.Fromareviewofallthefactspresentedtothehearing,itistheopinionoftheundersignedthatthealimonypaymentsshouldremainunchanged,however,thereappearstobeaseriousissueofMr.Logansinsurabilityandnorealpracticalneedtocontinuehisobligationtomaintainathirtythousanddollarpolicyoflifeinsuranceandheisrelievedfromthatobligation.  Inallotherrespectsthetermsofthefinaldecreeshallremaininfullforceandeffect. ` ̀ ` Atthetimeofthedivorce,thehusbandwasearning$33,430peryear.Thewifes p1h*. earningswereinconsequential.Sincethedivorce,thehusbandhasbeeninvoluntarilyretiredandhisincomeisnow$4,022.00permonth,consistingof$235pension,$1,287socialsecurity,and$2,500IRAdistribution.Hehasremarried.Hisrealestateisheldjointlywithhisnewwifewhoearns$25,708peryear.Heclaimsmonthlyexpensesof$4,613includingmortgagepayments 816 of$341.29,creditunion$633.34,$150giftsandflowers,andvariousexpensesofson,grandsonanddaughterinlaw.Inshort,noevidenceiscitedorfoundwhichdemonstratesthatappellanthaslegitimateexpensesof$4,613permonth. ` Appellantclaimshehashealthproblems,butdoesnotclaimdisabilitytoperformthefunctionsheistrainedtoperform.Thisrecorddoesnotdemonstratethatappellantcouldnotobtainandpursueemploymentforwhichheisfitted. ` Appellantcomplainsthathehasalreadypaidappellee$184,000inalimony.Thisfactisnotanunanticipatedchangeofcircumstancesjustifyingrelieffromalimonyspecifiedinthemaritaldissolutionagreementandorderedinthedecree. ` Appellantarguesthatappelleeshouldberequiredtopayherlivingexpensesoutofthefundsassignedtoherinthemaritaldissolutionandpropertysettlementagreement.Nosuchintentorexpectationappearsintheagreement. ` Appellantarguesthatappelleeshouldberequiredtogotoworkandearnherownlivingexpenses.Nosuchintentorexpectationappearsinthemaritaldissolutionagreementwhichspecifiestheamountofalimonywithoutcondition. ` Appelleeassertsmodestlivingexpensesof$1,231permonth.Shereceives$540permonthsocialsecurity,and$800permonthalimony,atotalof$1,340.Shehasserioushealthproblemswhichdiscourageanyeffortatrehabilitation.Shedeservestopreservehersavingstoprovidesecurityforheroldage.66̛ ` AppellantcitesLoriav.Loria,Tenn.App.1997,952S.W.2d836,inwhichthisCourt  5.2 held:66`    [2,3] h Alimonyinfuturomaybemadesubjectto 816 limitationsorconditions,butitneverthelessremainssubject 927 tothecontrolofthecourt.Inthisrespect,rehabilitativealimonymaybeconsideredaspeciesofalimonyinfuturo.Itispaidperiodicallyandremainssubjecttothecontrolofthecourt.Itdistinguishingcharacteristicisthepurposeforwhichitisawarded,whichistoprovideatemporaryincomeduringaperiodofadjustmentandeffortofthedependentspousetobecomepartiallyortotallyselfsufficient.Duringthisperiod,theCourtretainstheauthoritytomakeappropriateadjustmentsinkeepingwithchangingcircumstancesanddevelopments.  [4,5] h Ifadependentspousedoesnotsatisfactorily ,$  striveforselfsufficiency,theCourtmaywithdrawpartorallofthesupportallocatedtofinancerehabilitation.Ifthedependentspousedemonstratescompleteinabilitytoachieveevenpartialselfsufficiency,theCourtmaygrantalimonyinfuturotoprovidetheneedsofthedependentspouse.  [6] h Ifthedefendantspouseachievespartialself  sufficiencybutdemonstratesinabilitytoachievetotalselfsufficiency,theCourtmaygrantsufficientalimonyinfuturotosupplementtheearningcapacityofthedependentspouse.  Ofcourse,alloftheforegoingmustbeadministeredwithinthecapabilityofthesupportingspousetoprovidetheneededsupport. %` %% ` InLoria,thisCourtwasreviewinganoriginaldivorcedecreewhichwasnotbaseduponamaritaldissolutionagreementspecifyingtheamountanddurationofalimony.Thewifesagewas56andnodisabilityismentionedintheopinion. ` Thispresentappealinvolvesadecreewhichwasbaseduponagreedalimonyandpropertydivisioninapriordivorcedecreewhichappellantseekstorevisebysubsequentpetition.Appellanthastheburdenofshowinganunanticipatedchangeincircumstanceswhichjustifiestherevisionheseeks.Hehasnotcarriedthatburden.Bowmanv.Bowman,Tenn.App.1991, -&* 836S.W.2d563andauthoritiescitedtherein. ` Theappellantwillderivesomerelieffromterminationofthedutytomaintainlifeinsurance,astowhichappelleemakesnocomplaint. 816 Ї ` ThejudgmentoftheTrialCourtisaffirmed.Costsofthisappealareassessedtotheappellant.ThecauseisremandedtotheTrialCourtforfurtherappropriateproceedings.
