šthence€southwesterly€along€the€center€of€saidĻRight„Of„Way€Road,€to€a€point€marked€by€a€steel€pin€located€15€ft.€west€of€theĻcenter€of€said€Road;€thence€in€a€northwardly€direction€with€the€lands€of€DevoreĻto€a€corner€in€Floyd€Vache€line.šš€€Earl€Walls€conveyed€twenty€acres€to€Ted€SelfĻon€October€2,€1989.€€Selfššs€deed€described€his€southern€and€eastern€boundary€asĻfollows:€€š šbounded€on€the€South€by€the€lands€of€George€W.€Reynolds€and€CherylĻHarrison;€bounded€on€the€East€by€the€lands€of€Devore€and€Toler.šš€€Finally,€onĻSeptember€2,€1990,€the€Devores€conveyed€by€quitclaim€deed€a€parcel€of€land€toĶthe€Posses.€€A€portion€of€this€land€is€the€subject€of€this€appeal.€€The€Possesšš€deedĻstated:ĢÓÓą8 ąBeginning€on€a€steel€pin€in€the€East€margin€of€the€Melton€HollowĻRoad,€this€also€being€the€Self€Southwest€corner;€running€thence€aboutĻEast€approximately€1800€feet€with€the€Self€line€to€the€Howard€line;Ļthence€about€East€and/or€Southeast€approximately€1000€feet€with€theĻHoward€line€to€the€center€of€a€farm€road€to€the€intersection€withĻanother€farm€road,€this€also€being€the€Howard€Southeast€corner€inĻthe€Lulow€line;€thence€about€South€and€East€approximately€1000€feetĻwith€Lulow€and€with€the€meanders€f€the€center€of€a€farm€road€to€theĻintersection€with€another€farm€road,€this€also€being€the€LulowĻSouthern€corner€in€the€Strange€line;€thence€continuing€about€SouthĻapproximately€120€feet€with€Strange€and€the€center€of€the€Road€toĻthe€intersection€of€the€farm€road€to€the€intersection€of€the€farm€roadĻwith€a€County€road,€this€also€being€the€Broach€Western€corner€in€theĻStrange€line;€thence€about€Northwest€and€West€approximately€3500Ļfeet€with€the€meanders€of€the€a€County€Road€and€the€Broach€line€toĻthe€East€margin€of€the€Melton€Hollow€Road;€and,€thence€about€NorthĻapproximately€120€feet€with€the€Melton€Hollow€Road€to€the€point€ofĻbeginning,€containing€16€acres,€more€or€less,€by€estimation.€.€.€.€It€isĻagreed€and€understood€that€this€is€a€conveyance€by€the€tract,€and€inĻno€sense€shall€it€be€construed€as€a€conveyance€by€the€acre.ĢĢą8 ƒ5 ××  ×ĢÓ€ÓĢÓ€ÓĢą ąThe€Lulows€filed€a€complaint€on€October€27,€1990.€€They€claimed€theyĻowned€land€west€of€the€Troublesome€Ridge€Road€and€asked€the€court€to€resolveĶthe€boundary€dispute€between€them€and€the€Posses.€€The€Lulows€also€alleged€theĻPosses€had€caused€damages€to€the€disputed€property€and€to€property€clearlyĻbelonging€to€the€Lulows.€€The€Lulows,€therefore,€requested€a€temporaryĻinjunction€enjoining€the€Posses€from€causing€any€further€damage.€€The€trial€courtĻordered€that€a€mutual€temporary€injunction€issue.€€The€Posses€filed€an€answer.€ĻThey€denied€all€the€material€allegations€of€the€complaint€and€stated€aĻcounterclaim.€€The€Posses€alleged€the€Lulows€had€blocked€access€to€theĻTroublesome€Ridge€Road.ĢĢą ąJim€and€Judy€King€filed€a€motion€to€intervene€as€defendants€in€order€toĻgain€rights€of€ingress€and€egress€over€the€Troublesome€Ridge€Road.€€The€KingsĻwere€involved€in€a€separate€property€dispute€with€the€Mingles€concerning€theĻownership€of€the€property€requiring€access.× ƒ6 ××  ׀€ĢĢą ąThe€court€filed€an€order€on€February€14,€1991€allowing€the€Posses€to€useĻthe€Troublesome€Ridge€Road€pending€further€orders€of€the€court.€€Two€monthsĻlater,€the€court€filed€an€opinion€and€determined€the€lay€of€the€land€entitled€theĻKings€to€an€easement€by€necessity.€€The€court€did€not€determine€ownership€of€theĻdisputed€area€or€the€compensation€to€the€Lulows€from€the€Kings€at€that€time.ĢĢą ąRichard€and€Phyllis€Jones€filed€a€motion€to€intervene€on€May€9,€1991.€ĻThey€claimed€the€Kings€by€ruling€of€the€court€had€taken€a€portion€of€the€theirĻproperty,€i.e.,€that€portion€of€the€easement€running€through€their€property,€andĻthat€they€were€entitled€to€compensation€from€the€Kings€for€such€taking.€€TheĻLulows€filed€a€motion€to€amend€their€answer€to€the€counter„complaint€to€includeĶthe€defense€of€champtery.ĢĢą ąOn€September€11,€1991,€the€court€determined€the€controversy€between€theĻJoneses€and€the€Kings€was€too€remote.€€As€a€result,€the€court€overruled€theĻJoneses€motion€and€dissolved€the€temporary€restraining€order.€€The€court€filed€anĻorder€on€November€13,€1991€allowing€the€Devores€to€intervene€as€plaintiffs.€ĻThe€court€also€granted€the€Kingsšš€motion€to€intervene.ĢĢą ąThe€court€filed€an€opinion€on€February€7,€1992€and€determined€the€landĻclaimed€by€the€Lulows€was€rightfully€theirs€and€the€boundary€lines€should€beĻestablished€in€accordance€with€the€survey€prepared€by€the€Lulowsšš€surveyor,€JohnĻKnotts.€€The€court€found€the€issue€of€champerty€was€not€established.€€Finally,€theĻcourt€determined€it€should€appoint€a€jury€of€view€pursuant€to€Tennessee€CodeĻAnnotated€title€54,€chapter€14€to€determine€the€location€of€the€easement€byĻnecessity,€if€different€than€the€determination€of€the€court,€and€to€determineĻdamages.ĢĢą ąThe€Posses€filed€a€motion€pursuant€to€Rule€52.01€of€the€Tennessee€Rules€ofĻCivil€Procedure.€€The€Posses€also€claimed€the€Lulows€waived€their€right€to€a€juryĻof€view.€€The€Posses€and€the€Kings€filed€a€motion€alleging€the€Lulows€hadĻviolated€the€courtššs€orders€of€February€14,€1991€and€April€9,€1991.€€The€PossesĻand€the€Kings€requested€the€court€punish€the€Lulows€for€contempt€of€court€andĻissue€a€restraining€order.€€The€Lulows€filed€a€counter„motion€for€contempt.ĢĢą ąThe€Posses€and€the€Kings€filed€a€motion€for€a€new€trial€on€December€4,Ļ1992.€€The€parties€claimed€the€evidence€preponderated€against€the€courtššs€rulingĻand€the€trial€court€failed€to€properly€treat€the€easement€issue€as€an€action€in€rem.€€ĶThe€trial€court€filed€an€order€in€which€the€court:€1)€restated€its€conclusions€as€toĻthe€boundary€dispute;€2)€specifically€stated€the€Posses€had€no€interest€in€theĻdisputed€property€and€divested€them€of€any€interest;€3)€found€there€was€no€proofĻsustaining€the€champtery€allegations;€4)€held€the€Kings€were€entitled€to€anĻeasement€by€necessity€to€be€used€once€per€week;€5)€found€the€Lulows€wereĻentitled€to€a€jury€of€view€to€determine€compensation€as€the€parties€agreed€theĻTroublesome€Ridge€Road€was€the€most€reasonable€easement;€and€6)€ordered€thatĻthe€findings€of€fact€and€conclusions€of€law€filed€by€the€Lulows€on€July€30,€1992Ļbe€made€the€findings€and€conclusions€of€the€court.€€The€court€filed€a€second€orderĻdismissing€both€contempt€motions,€restraining€the€Posses€from€coming€upon€theĻproperty€awarded€to€the€Lulows,€allowed€the€Kings€to€continue€using€theĻeasement€once€a€week,€and€restrained€the€parties€from€carrying€weapons€onto€theĻeasement.ĢĢą ąOn€December€8,€1994,€the€Lulows€filed€a€motion€to€dissolve€the€easementĻpreviously€granted€the€Kings.€€The€Lulows€alleged€a€ruling€in€a€separate€caseĻinvolving€the€Kings€had€established€the€boundary€lines€in€a€way€which€destroyedĻthe€need€for€the€easement.€€The€court€filed€an€order€on€May€25,€1995.€€The€courtĻoverruled€the€motion€for€a€new€trial€and€removed€any€rights€obtained€by€theĻKings€from€previous€orders€of€the€court.€€The€order€also€stated€that€a€letterĻwritten€by€Chancellor€Corlew,€dated€April€17,€1995€setting€out€the€courtššsĻfindings,€would€be€made€part€of€the€record.ĢĢą ąThe€Kings€filed€a€š šmotion€for€written€findings€of€facts€and€adjudication€ofĻall€parties€and€issues.šš€€The€court€filed€an€order€finding€that€the€ChancellorššsĻletter€and€Appelleeššs€counselššs€statement€of€the€facts€sufficiently€satisfied€theĻprovisions€of€Rule€52€and€overruled€the€motion€for€further€written€findings.€€TheĶcourt€also€ordered€the€clerk€to€mail€copies€of€the€Final€Judgment€to€all€partiesĻwho€were€not€previously€served.ĢĢą ąThe€Posses€and€the€Kings× ƒ7 ××  ׀filed€a€notice€of€appeal€as€to€the€courtššs€May€25,Ļ1995€order.€€The€Kings€filed€a€letter€with€the€court€suggesting€the€court€wasĻconfused€and€mistaken.€€The€Devores€filed€a€notice€of€voluntary€dismissal,€andĻthe€court€filed€an€order€allowing€the€Devores€to€take€a€voluntary€nonsuit.ĢĢą ąDespite€the€complex€history€of€this€case,€there€is€only€one€issue€presentedĻfor€our€determination,€that€is,€whether€the€Lulows€have€any€claim€to€land€west€ofĻthe€Troublesome€Ridge€Road.€€The€difficulty€of€determining€this€issue,€however,Ļis€exacerbated€by€a€deficient€record.€€The€parties€have€attempted€to€reconstituteĻthe€record,€but€four€exhibits€are€still€missing.€€ĢĢą ąThe€trial€court€found:ĢÓÓą8 ą[B]ased€upon€the€evidence€presented€in€this€extremely€lengthy€trial,Ļthe€plaintiff's€have€shown€by€the€preponderance€of€the€evidence€theyĻare€the€owners€of€the€portion€of€land€surveyed€by€Larry€Knott,€andĻshown€in€Exhibit€18€of€this€trial.€€The€evidence€clearly€establishesĻthe€plaintiffs€began€making€open,€notorious,€continuous,€actual€andĻvisible€use€of€the€subject€property.€€Further,€the€proof€clearlyĻestablishes€this€use€has€continued€since€their€purchase€in€June,€1978Ļuntil€September,€1990€when€the€defendants€purchased€the€propertyĻby€a€quitclaim€deed.Ģą ąą ą.€.€.€.Ģą8 ąą ąFor€the€above€reasons,€it€is€the€opinion€of€the€court€theĻplaintiffs€have€clearly€established€they€are€the€owners€of€the€disputedĻarea,€which€was€set€out€in€the€plat€labeled€Exhibit€18€of€the€survey€ofĻLarry€Knott.ĢĢÓ€ÓIt€is€the€opinion€of€this€court€that€the€trial€court€correctly€concluded€that€theĶevidence€preponderated€in€favor€of€a€finding€that€the€Lulows€adversely€possessedĻland€west€of€the€Troublesome€Ridge€Road€from€June€1978€until€September€1990.€ĻOther€questions,€however,€must€be€answered€before€the€property€of€theĻchancellor's€final€judgment€can€be€determined.€€The€first€is€the€effect€of€theĻpossession,€and€the€second€is€the€extent€of€the€land€acquired€through€suchĻpossession.ĢĢą ąA€legal€or€equitable€title€holder€may€not€challenge€the€title€of€a€party€whoĻhas€adversely€possessed€land€for€seven€years€under€a€recorded€assurance€of€titleĻwithout€challenge€from€the€legal€or€equitable€title€holder.€€Tenn.€Code€Ann.€šš€28„2„102€(19__).€€Moreover,€any€party€claiming€under€the€legal€or€equitable€titleĻholder€is€barred€as€well.€€In€this€case,€the€Lulows€adversely€possessed€land€forĻmore€than€seven€years€beginning€in€June€1978.€€The€Devores€never€challenge€theĻLulowsšš€title.€€Finally,€the€Lulows€had€a€recorded€assurance€of€title€in€the€formĻof€their€deed€from€the€Devores.× ƒ8 ××  ׀€Thus,€the€Devores€and€those€claiming€underĻthem,€the€Posses,€are€forever€barred€from€asserting€title€to€the€land€adverselyĻheld.€€ņņņ ņSee€Moore€v.€Brannanó óóó,€42€Tenn.€App.€542,€561,€304€S.W.2d€660,€669Ļ(1957).Ģą ąĢą ąWe€now€turn€to€the€amount€of€land€acquired€by€the€Lulows€as€a€result€ofĻtheir€adverse€possession.€€the€various€deeds€and€testimony€in€this€trial€reveal€theĻLulows€owned€land€west€of€the€Troublesome€Ridge€Road,€but€not€all€of€the€landĻincluded€in€the€survey€of€Larry€Knott.ĢĢ€ą ąIn€order€to€determine€the€amount€of€land€acquired€by€the€Lulows€throughĶadverse€possession€we€must€examine€the€language€of€the€Lulowsšš€recordedĻassurance€of€title,€i.e.,€their€deed€from€the€Devores.€€Specifically,€we€mustĻdetermine€the€location€of€the€Lulowsšš€western€boundary.€€The€Lulowsšš€deedĻdescribes€the€Lulowsšš€property€as€being€bounded€on€the€West€by€š šother€lands€ofĻDevore,šš€not€by€the€troublesome€Ridge€Road.€€This€language€alone€is€of€littleĻvalue,€however,€as€the€Devores€owned€land€to€the€East€and€West€of€theĻTroublesome€Ridge€Road.€€Given€this,€the€Lulowsšš€Western€boundary€could€haveĻlied€anywhere€West€of€the€Troublesome€Ridge€Road€as€long€as€the€line€stillĻbordered€the€Devoresšš€property.€€The€only€other€evidence€in€the€deed€of€theĻLulowsšš€Western€boundary€is€the€call€which€reads€š š32.5€acres€more€or€less.šš€ĻThis€along€with€the€description€of€the€Western€boundary€is€evidence€the€LulowsššĻdeed€included€land€West€of€the€Troublesome€Ridge€Road.ĢĢą ąThe€Posses€argued€one€could€not€read€the€Lulowsšš€deed€so€broadly€as€toĻinclude€land€west€of€the€Troublesome€Ridge€Road.€€The€Possess€argued€theĻdescription€of€the€Lulowsšš€northern,€eastern,€and€southern€boundaries€limited€theĻLulowsšš€western€boundary€to€the€Troublesome€Ridge€Road.€€Specifically,€theyĻargued€that€if€the€Lulowsšš€land€extended€west€of€the€Troublesome€Ridge€Road,Ļthe€Lulowsšš€deed€would€have€called€for€other€lands€of€Devore€on€the€northernĻboundary€and€Harrison€on€the€southern€boundary.€€Second,€the€Posses€point€outĻthat€the€Devores€would€not€have€granted€the€Lulows€the€thirty€foot€right€of€wayĻif€they€had€conveyed€land€west€of€the€Troublesome€Ridge€Road€to€the€Lulows.€ĻFinally,€the€Posses€argued€Howardššs€and€Selfššs€deeds€referred€to€the€land€ofĻDevore€as€their€southern€and€eastern€boundaries€respectively.€€The€PossesĻcontented€these€deeds€would€have€referenced€the€Lulowsšš€land€had€the€LulowsĻowned€land€west€of€the€Troublesome€Ridge€Road.€ĢĢą ąIt€is€the€opinion€of€this€court€that€the€chancellor's€final€judgment€decisionĻwould€result€in€a€windfall€to€the€Lulowsšš€as€it€would€grant€them€far€more€thanĻthe€32.5€acres€they€bargained€for.€€Thus,€it€is€the€opinion€of€this€court€that€thisĻcase€should€be€remanded€to€the€chancery€court€to€draw€a€line€granting€the€LulowsĻapproximately€ten€acres€west€of€the€Troublesome€Ridge€Road.ĢĢą ąTherefore,€the€decision€of€the€chancery€court€is€affirmed€in€part€andĻreversed€in€part.€€The€case€is€remanded€to€the€chancery€court€for€the€entry€of€anĻorder€granting€the€Lulows€approximately€ten€acres€west€of€the€TroublesomeĻRidge€Road.€€Cost€on€appeal€are€taxed€equally€against€plaintiffs/appellees,€LionelĻand€Nancy€Lulow,€and€defendants/appellants,€Earl€and€Carl€Poss.ĢĢĢÓÓą
