ThejudgmentoftheTrialCourtstates:   `  Basedonthemotionofthedefendants,thedepositionoftheplaintiffandtheaffidavitsfiledbybothpartiesandtheirwitnessesandthebriefsandargumentsofcounsel,theCourtfindsthatthedefectordangerousconditioncomplainedofbytheplaintiffwasequallyobvioustobothpartiesandthattheplaintiffisthereforebarredbyherownnegligence.ItisthereforeORDEREDthattheplaintiffscomplaintbedismissedatthecostsoftheplaintiff.     Ithasbeenheldthatthecontrollerofapremisesisnotliableforinjuryresultingfromaconditionofthepremiseswhichisopenandobvious.McCormickv.Waters,Tenn.1980,594S.W.2d385;KendallOilCo.v.Payne,Tenn.App.293S.W.2d40(1955). However,onMarch30,1998,theSupremeCourtannounceditsopinioninthecaseofColnv.CityofSavannahandVancleavev.Markowskiwhichstates:   `  Weagreewiththerationaleofthemajorityofcourtswhichhavelimitedorrestrictedthetraditional openandobviousruleinfavoroftheRestatementapproach.Wealsoagreethatattemptingtoanalyzethedutyissuesimplybylabelingsomeconditions openandobvious,withoutconsiderationofanysurroundingcircumstances,promotesarbitraryandinconsistentresults.Moreover,theopenandobviousruleisinconsistentwithourcaseswhichanalyzedutybybalancingforeseeabilityandgravityofharmwithfeasibilityandavailabilityofalternativesthatwouldhaveavoidedtheharm.  ӄ   Accordingly,whilewerestricttheoncebroadapplicationofthe openandobviousdoctrine,westressthatdutyremainsaseparatecomponentofaplaintiffsnegligenceaction.AswesaidinBlairv.Campbell,924S.W.2d75(Tenn.1996), ouradoptionoftheprinciplesofcomparativefaultdidnotaltertheanalysisapplicabletothecommonlawconceptofduty...anditisbeyonddisputethatdutyisaquestionoflawforthetrialcourtsdetermination.Thus,onlyafteradutyisestablisheddoescomparativefaultcomeintoplay.  ӄ   Werejectthedefendantscontentionsthatrestrictionoftheopenandobviousdangerrulewillprecludethetrialcourtfromapplyingmechanismssuchassummaryjudgmentanddirectedverdicttoevaluatecases.Byretainingtheseparateanalysisofduty,andnottotallysubsumingallcasesbyapplyingcomparativefault,themechanismsofsummaryjudgmentanddirectedverdictremainviabletoevaluatecasesatpreliminarystatesintheproceedings.     ThejudgmentoftheTrialCourt,quotedabove,isbasedspecificallyandsolelyupontheabsolutedefenseof openandobviousdanger,whichwasrecognizedatthetimeoftherenditionofthejudgment.However,theopinionoftheSupremeCourt,quotedabove,requiresthatthejudgmentoftheTrialCourtbevacatedwithoutprejudicetofurtherpleadings,evidence,considerationandrulingsoftheTrialCourtconsistentwiththelatestrulingoftheSupremeCourt. ThejudgmentoftheTrialCourtisvacated,andthecauseisremandedforfurtherappropriateproceedings.Costsofthisappealaretaxedagainsttheappellees.
