Fromthisdecreeapplicantappeals. Noverbatimtranscriptoftherecord,eitherbeforethebeerboardorbeforethechancellor,appearsintherecordbutaRule24(c)statementoftheevidenceasrevisedbythechancellorisfiled. AtthehearingbeforethechancelloronOctober28,1997threewitnessestestified.Firstwasthepetitioner,AnnaBelleLynn;secondly,herhusbandDavidWalls,andthirdly,HumphreysCountySheriffRonnieToungette,calledasawitnessbythedefendants. PetitionertestifiedthatshewasaresidentofDickson,Tennesseewheresheoperated"Anna'sUpperDeckLounge"andheldabeerpermit.Shehadno @ violationsinDicksonandnorevocationsorotherproblems.ShehadlongfamiliaritywiththepremisesforwhichshesoughtabeerpermitinHumphreysCounty.ThebuildingwaslocatedatHurricaneMillsneartheintersectionofTennesseeHighway13andInterstateHighway40.Sheproposedtonameit"Anna'sCountryPlace"andwouldmanagethebusinessherselfwithtwofemaleemployeesandherhusbandDavidWallsas"security".Sheplannedeighttablescapableofseatingandservingthirtytofiftypersonsandplannedamusicbandonweekendnightstohelpdrawcrowds.Shehadworkedforthepreviousownersofthepropertyandin1989wasarrestedandconvictedforassaultanddestructionofprivateproperty,forwhichshewasplacedonprobationforaperiodofelevenmonthsandtwentyninedays.ShemarriedDavidWallsin1996,awarethathehadpreviouslybeenconvictedofbankrobberyinNewMexicoin1980andhadservedtimeinthepenitentiary. DavidWallstestifiedthatinadditiontothebankrobberychargeshehadpriordisorderlyconductandtrespassingchargesinFlorida.Withthistestimony 84? petitionerrestedhercase. SheriffToungettetestifiedthathehadbeenSheriffofHumphreysCountyforsixteenyearsandthatpetitioner'sproposedbusinesslocationwasintheBuffaloCommunitywhichwasunincorporated.Hedescribedthesurroundingareaasamixtureofresidentialandcommercialareaswithamotelandrestaurantlocatedbehindthepropertyinissue.Hetestifiedthattheareawaslocatedsixteenmilesfromthesheriff'sofficeandthatnootherpoliceorlawenforcementagencypatrolledthearea.SheriffToungettetestifiedatlengthconcerningpriorproblemswiththepropertynowownedbythepetitioner.Ithadbeenabeerjointsince1985withconstantcomplaintsoffighting,threatsandpeopleurinatingintheparkinglot.In1991,anapplicationforabeerpermitbypreviousownerhadbeendenied.In1993,thepropertyreopenedwithabeerpermitundernewownershipbutmorecomplaintsoccurredaboutmarijuanasmoking,fighting,andotherdisorderlyconduct.DuringportionsofthistimethepetitionerAnnaLynnhadworkedforCharlieShanesandBarbaraWarren,previousownersoftheproperty,andwasawareofpreviousproblems.ThesheriffalsotestifiedtherewerenoothertavernsinthevicinityoftheBuffaloCommunityofHumphreysCountyandthathecouldnotprovidecountywidepolicepatrolsandcouldonlyrespondtorequestsforaidasconservatorsofthepeaceandtoinvestigatecriminalviolationsinaccordancewithhisstatutoryduties.HetestifiedthatthetimerequiredtoreachtheBuffaloCommunityenhancedthepotentialdangertopersonsandpropertyresultingfromdisorderlyactsthatcommonlyoccuratabeertaverninanunpatrolled,rural,remotelocation. Inrebuttalpetitioneracknowledgedthatshehadworkedasanemployeeforpriorownersbuthadnocontrolovertheactionsofsuchownersormanagers. Upontheforegoingevidencethechancellorfoundbyapreponderanceoftheevidencethattheissuanceofabeerpermitwouldbecontrarytothepublichealth,safetyandwelfareofthecounty. Whileitistruethatabuilding,perse,cannothaveabadreputation(Lones 73@ v.BlountCountyBeerBoard,538S.W.2d386(Tenn.1976)),itisequallytrue H94B thatthereputationandpasthistoryofthepersonsproposingtooperatethebusinessonsuchpremisesaresubjecttolegitimateinquiry. Tippitv.Obion H County ,651S.W.2d211(Tenn.1983). 3  TennesseeCodeAnnotatedsection571105(b)(1)placestheburdenontheapplicanttoestablishthat"[n]obeerwillbesoldexceptatplaceswheresuchsale    willnot...otherwiseinterferewithpublichealth,safetyandmorals."TheTennesseeSupremeCourthasheldthatapermittosellbeercanbedeniedbecausetheproposedsiteisunsiuitable. Itislikewisetruethatthedistancebetweentheproposedbusinesslocationandthenearestpoliceauthorityismaterialtothebeerboardandtothechancellorinconsideringanapplicationforabeerpermit.
