Theundisputedfactsofthiscaseareasfollows:MarlonMadisonwasintheeleventhgradeatPickettCountyHighSchool.Hewasplacedinanalternativeschoolafteranincidentinvolvingpossessionofdrugparaphernaliaandsuspicionofmarijuanause.Shortlyafterenteringthealternativeschool,Marlonapproachedanotherstudentandaskedhimifhewantedtobuymarijuana.  Thestudenttoldaschoolofficial,VickLowhorn,abouttheoffer.Mr.ϜLowhornandJamesW.Taylor,principalofthehighschool,begananinvestigation.Theygavethestudenta$20billwithwhichtopurchasethemarijuana.Anexchangewasmadeinaclassroomoftheschool,withMarlonMadisonreceivingthe$20,andtheotherstudentreceivingwhatappearedtobefourorfiverolledjointsofmarijuanainaplasticbag.  DelinquencyproceedingsweresubsequentlybroughtagainstMarlonMadisonintheJuvenileCourtofPickettCounty.AfteranoncustodialassessmentofMarlonshomeandfamilysituation,andahearingbeforetheJuvenileCourt,theyoungmanwasfoundtobedelinquent,andwasplacedonprobation.Theprobationtermsincludedrandomdrugtesting,adrugeducationprogram,drugcounseling,andfiftyhoursofcommunityservice.  ThedefendantfiledanappealforadenovohearinginCircuitCourt,pursuanttoTenn.CodeAnn.371159.TheonlywitnessescalledatthehearingwereJamesW.Taylorandthestudentwhomadethepurchase.Thedefendantcrossexaminedthesewitnesses,butcallednowitnessesofhisown.Afterthehearing,thetrialcourtfoundthedefendanttobedelinquent fortheactofsellingmarijuanaupontheschoolproperty,andimposedthesamepenaltyuponhimashadthejuvenilecourt.Thisappealfollowed.@ II.   Aminormaybeconsidereddelinquentifhehascommittedadelinquentact,andisinneedoftreatmentorrehabilitation.Adelinquentactisbasicallyanactperformedbyaminor,whichwouldbeacriminaloffenseifitwereperformedbyanadult.SeeTenn.CodeAnn.371102.MarijuanaisclassifiedasaScheduleIIcontrolledsubstance.Tenn.CodeAnn.3917407.ThesaleofaScheduleIIcontrolledsubstanceisaClassCfelony.Tenn.CodeAnn.3917417.  TheappellantarguesonappealthattheStatefailedtoprovethattherolledjointscontainedmarijuana,andthusdidnotmeettheburdenofproofrequiredtofindthatthedefendanthadcommittedanactwhichwouldhavebeenacriminaloffenseifcommittedbyanadult.HerefersustotwocasesintheCourtofCriminalAppeals,Statev.Hill,638S.W.2d827(1982)andStatev.Doelman,620S.W.2d96(1981).Inbothofthosecases,thecourtheldthatthetestimonyofapoliceofficerwithseveralyearsofexperienceindetectingmarijuanawassufficienttosupportafindingbeyondareasonabledoubtthatthesubstanceinquestionwasindeedmarijuana.  Inthepresentcase,therewasnotestimonybyapoliceofficerorbyanyotherexpertontheidentificationofmarijuana.Theappellantinsiststhatwithoutsuchtestimony,thecourtcouldnotfindbeyondareasonabledoubtthatMarlonMadisonhadsoldmarijuanatoaclassmate.  WebelievethattheappellantiscorrectastotheburdenofproofthattheStatemustcarryontheunderlyingoffenseinordertosupportafindingofdelinquency.InStatev.Johnson,574S.W.2d739,741(Tenn.1978),JusticeϜHarbisonwrote:     0   Althoughjuvenileproceedingsdo,inmanyways,partakeofcivilratherthancriminalproceedings,thejuvenilehasarighttocounsel,confrontationandcrossexaminationofwitnesses,theprivilegeagainstselfincriminationandtherighttohaveguiltestablishedbeyondareasonabledoubt....Weareoftheopinionthatsimilarprocedureshouldbefollowedwhenajuvenile,chargedwithanoffensewhichwouldconstituteafelonyunderthepenalcode,appealstothecircuitcourtfortrialdenovo....      However,evenifthejointssoldbyMarlonMadisonsoldwerenotproventocontainmarijuana,thesaleviolatedanotherportionofthecriminalcode.Tenn.CodeAnn.3917423readsinpertinentpart: 0   Counterfeitcontrolledsubstances. (a)Itisanoffenseforapersonto: (1)Sell; (2)Deliver;or (3)Distributeasubstancewhichisrepresentedtobeacontrolledsubstanceandwhichissubstantiallysimilarincolor,shape,size,andmarkingsorlackthereof,toaScheduleI,II,IIIorIVcontrolledsubstanceasclassifiedin39174063917412,inorderthatthesubstancemaybesoldasacontrolledsubstance. (b)... (c)Aviolationofsubsection(a)or(b)isaClassEfelony.       ItthusappearstousthattheevidencewassufficientforthetrialcourttofindbeyondareasonabledoubtthatMarlonMadisonhadcommittedadelinquentact,whetherthatactwasthesaleofmarijuana,orthesaleofacounterfeitcontrolledsubstance.@ III.
