WegrantedaninterlocutoryappealpursuanttoRule9oftheTennesseeRulesofAppellateProceduretodetermineiftheTrialCourtwascorrectinallowingthePlaintiffs,GeraldL.Martinandhiswife,JudyA.Martin,toamendtheircomplainttoseekdamagesforMrs.Martin'spersonalinjuriesinadditiontoalossofconsortiumclaimshesoughtintheoriginalcomplaint.  ThecomplaintwasfiledinthiscauseonJanuary19,1993,seekingdamagesforpersonalinjuriestoGeraldL.Martinand,asalreadynoted,lossofconsortiumastohiswife,JudyA.Martin,resultingfromavehicularaccidentoccurringonApril30,1992.  Thereafter,onDecember20,1993,theMartinsmovedtoamendtheircomplainttoallegepersonalinjuriestoMrs.Martinand,onJanuary20,1994,filedaproposedamendedcomplaintwiththeCourt.   Inresponse,theDefendant,PaulM.Trice,filedamotiontodismiss,allegingMrs.Martin'samendedclaimwasbarredbyT.C.A.283104,theoneyearstatuteoflimitationsapplicabletopersonalinjuries.  ByorderenteredonNovember3,1994,theTrialCourtallowedtheamendmentanddeniedMr.Trice'smotiontodismiss.  ThereafterMr.Tricemovedthathebeallowedaninterlocutoryappeal,whichwasgrantedbytheTrialCourtandalsobythisCourt.   Turningtothemeritsofthisappeal,wefirstobservethatthemotionseekingtheamendment,whichwasfiledonDecember20,1993,allegesthatMrs.Martinhad,"recentlybeendiagnosedassustainingextensiveandseriousinjuriesasaresultoftheaccident."Thereisnootherprooforpleadingintherecordtouchingonthissubject.InTennessee,thediscoveryruleobtainsandastatuteoflimitationsdoesnotbegintorununtilϜpartiesknoworshouldhaveknownthattheyhaveacauseofaction.Beamanv.Schwartz,738S.W.2d632(Tenn.App.1986).Inviewofthepresentstatusoftherecord,webelievetheTrialCourtproperlyallowedtheamendmentproffered.  Wealsobelieveintheinterestofjudicialeconomythatweshouldaddressthemoredifficultquestionwhichmayarise,dependingontheproof,astotheknowledgeMrs.Martinhadorshouldhavehadregardingherinjuries.Thatquestioniswhether,undertheprovisionsofRule15.03oftheTennesseeRulesofCivilProcedure,apersonalinjuryclaimofMrs.Martinshouldrelatebacktothefilingofherclaimforlossofconsortiumeventhoughshekneworshouldhaveknownofherinjurymorethanoneyearbeforethefilingofthemotiontoamend.̜  Thecaseswehavereviewedareinagreementthatanewcauseofactionmaynotrelatebacktosaveaclaimotherwisebarredbyastatuteoflimitations.IntherecentcaseofRaineyBros.v.MemphisandShelbyCounty,821S.W.2d938(Tenn.App.1991),JudgeHighersaddressesthequestioninacasewheretheoriginalcomplaintattackedtheactionofMemphisandShelbyCountyBoardofAdjustmentonthetheorythattheyhadactedillegally,arbitrarilyandcapriciously,andsoughtaninjunctionaswellasmonetarydamages.Theamendedcomplaint,however,pressedaclaimforinversecondemnationandviolationof42U.S.C.1983.  InaffirmingtheTrialCourt'sdenyingtheamendmentbecausetimebarred,JudgeHighersmadethefollowingobservation(atpage941):        AsprovidedinRule15,onlythoseclaimswhichrelatebacktotheoriginalpleadingsaresavedfromtheeffectsoftheapplicablestatuteoflimitations.Tenn.R.Civ.P.15.03.However,wheretheamendmentinsubstanceraisesanewcauseofaction,thecourtshaverepeatedlyheldthattheamendmentdoesnotrelatebacktotheoriginalpleadingsandthestatuteoflimitationscontinuestorununtiltheamendmentisfiled.EnergySav.Prods.Inc.v.Carney,737S.W.2d783(Tenn.App.1987).Thus,therealquestioniswhethertheamendmentsraiseanewcauseofaction. Thereareseveralmethodsofdeterminingwhetheranamendmentraisesanewcauseofactionormerelyrelatesbacktotheoriginalpleading.SeeGamblev.HospitalCorp.ofAmerica,676S.W.2d340(Tenn.App.1984).Tennesseecourtshavegenerallyfollowedthestatutorystandardthattheamendmentmustarisefromthesameconduct,transactionoroccurrenceassetforthintheoriginalpleadings.Karashv.Pigott,530S.W.2d775(Tenn.1975).NoticetothedefendantisnotexpresslyrequiredbythestatutorystandardforrelationbackbuttheTennesseeSupremeCourthasdeterminedthatnoticeisthecriticalelementinvolvedindeterminingwhetheramendmentstopleadingsrelateback.Floydv.Rentrop,675S.W.2d165,168(Tenn.1984).         Wedonote,however,thatanearliercasecitedbyJudgeHighers,EnergySavingProducts,Inc.v.Carney,737S.W.2d783(Tenn.App.1987),reversedthetrialcourtinnotallowinganamendment.Inthatcasetheoriginalsuitsoughttorecoveradebtoweduponanopenaccount.Theamendmentincludedanallegationthatthedefendant'sfraudulentmisconducthadinducedtheplaintifftoprovidethegoodsandservices.ThisCourtheldthattheamendedcomplaintraisedacauseofactionwhichrelatedbackinthatitgrewoutofthesame"conducttransactionoroccurrencewhichisthebasisoftheoriginalsuit."  OurreadingofthetwocasespersuadeusthepresentcaseiscontrolledbytheholdinginRaineyBros.WereachthisconclusionbecausealthoughtheinjuryreceivedbyMrs.Martingrewoutofthesameaccidentinwhichshesoughtlossofconsortiumitisinfactanewcauseofactioninthattheoriginalcomplaintsoughtdamagesshesustainedbyreasonofherhusband'sinjuries,andtheamendedcomplaintbyreasonofherowninjuries.  Moreover,aswillbenotedfromthematerialquotedfromRaineyBros.,itisnecessarytoshowthattheDefendanthadnoticeofherclaimwithinthestatutoryperiod.Thereisnosuchshowingintherecord.  Inconclusion,wepointoutthatourresolutionofthisappealpreservesforMrs.Martinonefullyeartoassertherclaimaftershekneworshouldhaveknownshehadacauseofaction.Toholdotherwisewouldgivepreferentialtreatmenttothosefilingseparateanddistinctcausesofaction,aresultwhichwedonotbelievewasintendedbyourSupremeCourt,whichproposedtheRule,ortheLegislature,whichadoptedit.
