ðeducation€and€experienceðð€standards€in€the€jobÏdescription€for€the€Metro€Fire€œChief›€œwere,›€on€November€10,€œ1992,›€amended€by€theÏMetropolitan€Civil€Service€Commission€to€read€as€follows:ÌÒ ¸ ÒÒ ° ÒÓÓð ðBachelorððs€degree€from€an€accredited€college€or€university,€and€ten€(10)Ïyears€of€increasingly€responsible€management€or€administrative€experience.ÌÌNo€substitution.ððÌÌÒ  ÒÒ ° ÒÓÓÌà àSo€it€was€that€the€Metropolitan€Civil€Service€Commission€removed€from€the€jobÏdescription€all€requirements€for€previous€fire€service€œ(experience).›ÌÌà àThe€minutes€of€the€November€10,€1992€meeting€of€the€Metropolitan€Civil€ServiceÏœCommission,›€wherein€this€change€in€job€qualification€was€made,€describes€the€basis€for€theÏpresent€lawsuit.ÌÒ ¸ ÒÒ ° ÒÓÓð ðMr.€John€Kennedy€stated€that€the€proposed€change€to€Fire€Chief€andÏDeputy€Director€was€to€require€a€Bachelorððs€Degree€bringing€the€educationÏin€line€with€what€is€required€for€other€Department€Directors.€€Also€to€changeÏthe€experience€from€specific€experience€in€the€Fire€Fighting€Division€œinto›Ïgeneral€experience€in€administration€and€management,€not€necessarilyÏobtained€in€the€Fire€Fighting€Division€of€the€Fire€Department.ÌÌà@ àò ò€.€.€.ó óÌÌMr.€B.R.€Hall,€President€of€the€Metro€Fire€Fighters€Association€stated€thatÏhe€thought€the€Fire€Chief€classification€should€continue€to€require€the€tenÏ(10)€years€experience€in€the€Fire€Division€of€the€Fire€Department.ððÌÌÒ  ÒÒ ° ÒÌÌÓÓà àœIn€1993,€incumbent›€Fire€Chief€Coleman€retired€and€the€Personnel€DepartmentÏposted€a€job€announcement€that€it€would€accept€from€November€29,€1993€to€December€3,Ïœ1993,›€applications€for€Fire€Chief.€€The€Personnel€Department€further€on€November€28,Ï1993,€placed€a€classified€ad€in€the€Nashville€Tennessean€announcing€that€starting€the€nextÏday€it€would€accept€Fire€Chief€applications€until€the€end€of€the€week.€€This€ad€ran€for€oneÏday.€€There€is€no€assertion€by€the€Plaintiffs€that€these€actions€by€the€Personnel€DepartmentÏdid€not€conform€to€the€requirements€of€law.€€ÌœÌ›à àNorman€ð ðBuckðð€Dozier€submitted€his€application€as€did€numerous€other€individualsÏmany€of€them€from€within€the€Fire€Department.€€There€is€no€assertion€by€Plaintiffs€that€theÏqualifications€of€Mr.€Dozier€did€not€match€the€qualifications€required€for€a€Fire€Chief€underÏthe€November€10,€1992€amendment€to€such€qualifications€adopted€by€the€Civil€ServiceÏCommission.€€ÌÌà àMayor€Bredesen€appointed€Mr.€Dozier€as€Metro€Fire€œChief,›€effective€January€1,Ï1994€and€this€appointment€was€approved€by€the€Civil€Service€œCommission›€œon›€February€8,Ï1994.̛̜Ìà àSuch€are€the€controlling€fact€of€this€case€which€are€undisputed€in€the€record.̛̜à àThe€only€statement€of€issue€presented€for€review€by€the€Appellant€asserts:ÌÒ ¸ ÒÒ ° ÒÓÓð ðWhether€the€undisputed€facts€demonstrate€that€the€Metro€Civil€ServiceÏCommission€(ððCSCðð)€violated€the€Metro€Charter€when€it€a)€eliminated€aÏthirty„year€requirement€that€Metroððs€Fire€Chief€must€possess€fire€departmentÏexperience;€and€b)€approved€a€man€without€any€fire€department€experienceÏas€Metroððs€current€Fire€Chief.ððÌÌÒ àAt€the€time€the€Metropolitan€Government€Charter€was€submitted€for€ratification€toÏthe€people€of€Nashville„Davidson€County,€Section€20.08€(g)€provided€that€the€incumbentÏCity€of€Nashville€Fire€Chief€Mr.€Ragsdale€would€œbe,›€in€œfact,›€the€first€Fire€Chief€underÏMetropolitan€Government.€€Because€Chief€Ragsdale€had€many€years€experience€in€the€oldÏCity€of€Nashville€Fire€Department,€Appellant€asserts€that€construing€Section€8.304€òòin€pariÍmateriaóó€with€Section€20.08€(g)€œmandates›€that€the€term€ð ðespecially€qualified€.€.€.by€trainingÏand€experienceðð€contained€in€Section€8.304€elevates€to€Charter€dignity€a€qualification€thatÏall€future€Fire€Chiefs€must€have€fire€experience.€€Such€a€construction€would€effectivelyÏprevent€the€Civil€Service€Commission€from€ever€changing€the€job€qualifications€of€the€FireÏChief€from€those€qualifications€possessed€by€Chief€Ragsdale.€€This€is€a€non„sequitur.ÌÌà àThe€same€Section€20.08€of€the€original€Metropolitan€Charter€designated€the€old€CityÏof€Nashville€government€incumbents€and€various€Davidson€County€governmentÏincumbents€as€ð ðfirstðð€Metropolitan€government€holders€of€their€respective€positions.€€TheseÏincluded:ÌÓÓà à1.à àMetropolitan€Clerk;Ìà à2.à àMetropolitanòò€óó€€Treasurer;Ìà à3.à àChief€Medical€Director;Ìà à4.à àDirector€of€Department€of€Water€and€Sewerage€Service;Ìà à5.à àPublic€Defender;Ìà à6.à àDirector€of€Department€of€Police;Ìà à7.à àBudget€Officer,€Division€of€Budgets;Ìà à8.à àChief€Accountant;Ìà à9.à àIt€is€œsignificant,›€that€in€many€of€these€positions€the€Charter€itself€designates€certain€ÌÌminimal€qualifications.€€The€Director€of€Water€and€Sewerage€Services€must€be€a€graduate€ÌÌengineer,€trained€and€skilled€in€public€utility€problems.€€The€Chief€Traffic€Engineer€must€ÌÌhave€a€least€five€years€experience€in€traffic€administration.€€The€Budget€Officer€must€have€ÌÌa€least€five€years€experience€in€budget€preparation,€administration€and€accounting.ÌÌÌÌà àThere€are€no€such€Charter€limitations€in€the€qualifications€of€Fire€Chief.€€ÌÌœÌÌ›ÓÓà àIn€construing€a€statute€such€as€the€Metropolitan€Government€Charter,€the€pertinentÏlanguage€must€be€considered€in€the€context€of€the€entire€statute€ð ð.€.€.without€any€forced€orÏsubtle€construction€extending€its€importðð€òòMcClain€v.€Henry€I€Segal,€Co.€óó€834€S.W.2d.€295Ï(Tenn.€1992).ÌÌà àIt€is€the€failure€to€distinguish€between€the€governing€language€of€a€statute€and€theÏwholly€subordinate€language€of€a€civil€service€rule€that€defeats€the€position€of€theÏAppellants.ÌÌà àThe€Fire€Chief€of€the€old€City€of€Nashville€Government€had€to€have€fire€experience,Ïbecause€under€the€private€act€of€the€legislature€forming€the€Charter€for€the€City€ofÏNashville,€the€Fire€Chief€had€to€come€from€within€the€Fire€Department.€€The€first€FireÏœChief,›€under€the€Metropolitan€Government€œCharter,›€œhad›€past€fire€experience€because€theÏCharter€itself€appointed€the€then€incumbent€Fire€Chief€of€the€City€of€Nashville.€€Those€whoÏsucceeded€Chief€œRasdale,›€up€until€the€appointment€of€Mr.€Dozier,€had€to€have€fireÏexperience€not€because€of€any€provision€of€the€Metropolitan€Charter,€but€because€prior€fireÏexperience€was€written€into€the€qualifications€for€Fire€Chief€under€the€rules€of€theÏMetropolitan€Civil€Service€Commission.€€ÌÌà àThe€argument€of€the€Appellants€that€any€future€Fire€Chief€must€possess€aÏð ðmodicumðð€of€fire€experience€can€be€true€only€if€Metropolitan€Civil€Service€rulesÏsubsequent€to€the€adoption€of€the€Metropolitan€Charter€can€be€equated€in€dignity€to€theÏCharter€language€itself.€€ÌÌà
