Ðorder€of€child€support€is€a€question€relevant€to€our€resolution€of€the€first€issue.Ð $X" ÐÌà  àà ` àFather€argues,€on€appeal,€the€Trial€Court€erred€in€setting€his€current€child€supportÐ à%0!$ Ðobligation€because€it€failed€to€include€his€obligation€to€pay€private€school€tuition€for€his€two€maritalÐ Ì&"% Ðchildren€under€the€previously„entered€Final€Divorce€Decree.€€The€transcript€of€the€hearing€shows€theÐ ¸'#& ÐTrial€Court€deducted€the€percentage€base€amount€of€child€support€for€Fatherððs€two€marital€children,Ð ¤(ô#' Ð32%€of€his€net€income,€consistent€with€the€MDA,€in€calculating€Fatherððs€current€child€support€forÐ )à$( Ðthe€Child.€€As€discussed,€the€Trial€Court€stated€at€the€hearing€it€did€not€deduct€the€private€schoolÐ |*Ì%) Ðtuition€expenses€from€Fatherððs€net€income€because€it€felt€the€expenses€were€not€ð ðextraordinaryÐ h+¸&* Ðeducational€expensesðð€under€the€Guidelines€and€because€the€Parenting€Plan€indicated€the€tuitionÐ ° Ðexpenses€were€not€an€upward€deviation€from€Fatherððs€base€percentage€amount€of€child€support.€€TheÐ œì Ðrecord€shows€if€the€Trial€Court€had€deducted€the€marital€childrenððs€private€school€tuition€expensesÐ ˆØ Ðfrom€Fatherððs€net€income,€Fatherððs€current€child€support€obligation€for€the€Child€at€issue€would€haveÐ tÄ Ðbeen€reduced€from€approximately€$576€per€month€to€approximately€$215€per€month.Ð `° ÐÌà  àà ` àOur€Supreme€Court€has€held€that,€under€the€Guidelines,€private€school€tuitionÐ 8 ˆ Ðexpenses€constitute€ð ðextraordinary€educational€expensesðð€and,€in€addition€to€the€percentage€baseÐ $ t Ðamount,€are€part€of€the€total€child€support€award.׃×Ý ƒ#ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€€òòBarnett€v.€Barnettóó,€27€S.W.3d€at€907€(citing€Tenn.Ð  ` ÐComp.€R.€&€Regs.€ch.€1240„2„4„.04(1)(c)).€€In€light€of€òòBarnett€v.€Barnettóó,€we€hold€that€FatherððsÐ ü L  Ðobligation,€under€the€Final€Divorce€Decree,€to€pay€private€school€tuition€expenses€for€his€two€maritalÐ è 8  Ðchildren€is€part€of€a€total€ð ðprevious€order€of€child€support€for€other€children.ðð€€Tenn.€Comp.€R.€&Ð Ô$  ÐRegs.€ch.€1240„2„4„.03(4).€€Accordingly,€in€addition€to€the€percentage€base€amount€of€child€supportÐ À  ÐFather€was€ordered€to€pay€for€his€two€marital€children,€the€Trial€Court€should€have€consideredÐ ¬ü  ÐFatherððs€obligation€to€pay€private€school€tuition€expenses€when€determining€Fatherððs€net€income€andÐ ˜è  Ðsetting€his€base€percentage€amount€of€child€support€for€the€Child.€€The€Trial€Court€was€not€at€libertyÐ „Ô  Ðto€ignore€the€guidelines€and€instead€use€some€formula€of€its€own.€€To€do€so€was€error.€€Therefore,Ð pÀ Ðthe€Trial€Court€erred€in€its€determination€that€the€private€school€tuition€expenses€for€Fatherððs€maritalÐ \¬ Ðchildren€are€not€part€of€a€ð ðprevious€order€of€child€support.ððÐ H˜ ÐÌà  àà ` àNevertheless,€due€to€the€facts€and€circumstances€presented€by€the€record€on€appeal,Ð  p Ðwe€find€no€reversible€error€in€the€Trial€Courtððs€ultimately€setting€Fatherððs€current€child€supportÐ  \ Ðobligation€at€approximately€$576€per€month.€€òòSeeóóTenn.€R.€App.€P.€36(b).€€The€Guidelines€provideÐ øH Ðits€major€goals€are,€in€pertinent€part,€as€follows:Ð ä4 ÐÌà8  àà8` Ð Ð à(a)€€To€decrease€the€number€of€impoverished€children€living€in€singleÐ ¼  Ðparent€families.Шø` x` x ÐÌà8  àà8` Ð Ð à(b)€€To€make€child€support€awards€more€equitable€by€ensuring€moreÐ €Ð Ðconsistent€treatment€of€persons€in€similar€circumstances.€.€.€.Ðl¼` x` x ÐÌà8  àà8` Ð Ð à(e)€To€ensure€that€when€parents€live€separately,€the€economic€impactÐ D!” Ðon€the€child(ren)€is€minimized€and€to€the€extent€that€either€parentÐ 0"€  Ðenjoys€a€higher€standard€of€living,€the€child(ren)€share(s)€in€that€à8@p  àà8@pÐ Ð àÐ #l! Ðhigher€standard.Ð$X"` x` x ЇTenn.€Comp.€R.€&€Regs.€ch.€1240„2„4„.02(2)(a),€(b)€&€(e).€€Moreover,€the€Guidelines€are€ð ðaÐ ° Ðminimum€base€for€determining€child€support€obligationsðð€and€ð ðless€than€average€overnightÐ œì Ðvisitationðð€by€the€obligor€parent€justifies€an€upward€adjustment€from€the€base€percentage€amount.€Ð ˆØ ÐTenn.€Comp.€R.€&€Regs.€ch.€1240„2„4„.02(5).€€Ð tÄ ÐÌà  àà ` àDue€to€the€facts€and€circumstances€presented€by€the€record€on€appeal,€we€find€noÐ L œ Ðreversible€error€in€the€Trial€Courtððs€determination€that€Fatherððs€current€child€support€obligationÐ 8 ˆ Ðshould€be€set€at€approximately€$576€per€month€because€the€record€supports€an€upward€deviationÐ $ t Ðfrom€Fatherððs€base€percentage€amount€of€21%€of€his€net€income,€$215,€in€order€to€provide€for€theÐ  ` Ðbest€interest€of€the€Child.€€Such€an€upward€deviation€is€both€just€and€appropriate€under€the€facts€ofÐ ü L  Ðthis€case.€€The€record€on€appeal€shows€Father€enjoys€a€substantially€higher€income€than€Mother€asÐ è 8  ÐFather€has€been€gainfully€employed€throughout€the€Childððs€life€while€Mother€received€publicÐ Ô$  Ðassistance€from1998€to€2001.€€In€addition,€Father€has€exercised€no€visitation€with€the€Child.€€AnÐ À  Ðupward€deviation€from€the€base€percentage€amount€of€support€in€this€matter€also€serves€theÐ ¬ü  ÐGuidelinesðð€goals€of€decreasing€the€poverty€in€this€Childððs€life€and€allowing€the€Child€to€share€inÐ ˜è  ÐFatherððs€higher€standard€of€living,€thereby€serving€the€Childððs€best€interests.€€òòSeeóó€Tenn.€Comp.€R.Ð „Ô  Ð&€Regs.€ch.€1240„2„4„.04(5).€€Furthermore,€it€is€clear€from€the€record€that€Father€voluntarily€agreedÐ pÀ Ðto€pay€his€marital€childrenððs€private€school€tuition€expenses€of€$1,715€per€month,€with€the€certainÐ \¬ Ðknowledge€that€this€child€support€matter€was€set€to€be€heard€shortly€thereafter.€€In€fact,€the€FinalÐ H˜ ÐDivorce€Order€was€entered€just€2€months€prior€to€this€child€support€Order.€€Basically,€Father€arguesÐ 4„ Ðhis€child€support€obligation€for€the€Child€should€be€only€$215€per€month€while€his€total€monthlyÐ  p Ðsupport€payments€for€the€two€children€of€his€marriage€exceed€$3,000€per€month.€€The€Trial€CourtÐ  \ Ðfound,€and€the€evidence€does€not€preponderate€against€this€finding,€that€Father€knew€when€heÐ øH Ðvoluntarily€agreed€to€pay€his€marital€childrenððs€private€school€tuition€expenses€he€was€facing€havingÐ ä4 Ðchild€support€set€for€the€Child.€€The€Child€should€not€be€left€with€a€òòde€minimisóó€percentage€of€FatherððsÐ Ð  Ðincome€for€child€support€because€Father€voluntarily€agreed€to€pay€private€school€tuition€for€his€otherÐ ¼  Ðchildren.€€ð ðAll€children€of€the€same€parent€have€the€right€to€share€fairly€with€their€siblings€in€theirÐ ¨ø Ðcommon€parentððs€resources.ðð€€òòGallaher€v.€Elamóó,€No.€E2000„02719„COA„R3„CV,€2002€Tenn.€App.Ð ”ä ÐLEXIS€94,€at€*€7€(Tenn.€Ct.€App.€Jan.€29,€2002),€òòappl.€perm.€app.€granted€July€1,€2002óó.€Ð €Ð ÐAccordingly,€we€affirm€the€Trial€Courtððs€determination€that€Fatherððs€current€child€support€obligationÐ l¼ Ðfor€the€Child€should€be€set€at€$133€per€week,€or€approximately€$576€per€month.€Ð X ¨ ÐÌà  àà ` àWe€next€will€address€the€partiesðð€issues€on€appeal€regarding€the€Trial€Courtððs€awardÐ 0"€  Ðof€retroactive€child€support.€€Father€contends€the€Trial€Court€erred€in€awarding€any€retroactive€childÐ #l!
