TheTrialCourtsustainedamotiontodismissforfailuretostateaclaimforwhichreliefcanbegranted. Thecomplaintstates:   ` 6) OnSeptember4,1995,I,CharlesMontague,filledoutawithdrawalfor$64.00Dollars.ThemoneycamefrommyInmateTrustFundAccountthatswithintheTennesseeDepartmentofCorrection.Themoneywasforthereplacementofakeytoroomnumber12201,atNortheastCorrectionalCenter.Ihadlossthekeytosaidroomontheabovedate.7) OnSeptember5,1995,thelockandkeywasreplacedbySgt.Baker.Thekeyandlockhowever,wasreassignedtoanotherdoor/roomwithinNortheastCorrectionalCenter.8) OnSeptember21,1995,thekeythatIlostwasfoundandturnedintooperationsatNortheastCorrectionalCenter,andtheunitmanagementteamwasnotifiedandtheyretrievedthekey.9) OnSeptember21,1995,plaintifffilledoutainmateinformationrequestformtoWardenHowardCarlton,andMr.CarltonroutedittoSgt.Baker.Containedontheinformationrequestformwasmyrequestforarefund.However,Sgt.BakerinformedmethatIwouldnotbereceivinganyrefundbecausethelockcylinderandkeywasinuseinanotherdooratN.E.C.C.    ̀ TheorderoftheTrialCourtstates:   `  IntheabovecaptionedmatterthepetitionerfiledapetitionfordeclaratoryjudgmentchallengingthepoliciesoftheTennesseeDepartmentofCorrectionconcerninglostkeys.Heseeksreturnof$54.00withdrawnfromhisinmatetrustaccountforthereplacementofalostkey. TennesseeCodeAnnotatedsection45223and45224allowanindividualtopetitionanagencyfordeclaratoryorderregardingtheapplicabilityofthestatute,ruleororderandthen,ifdenied,fileanactionintheChanceryCourtofDavidsonCounty.Buttousethisprocedurethepoliciesunderattackmustbe rulesascontemplatedbytheUniformAdministrativeProceduresAct.TennesseeCodeAnnotatedsection45102(10)definesa ruleasanagencystatementofgeneralapplicabilitythatimplementsorprescribeslaworpolicyordescribestheproceduresorpracticerequirementsoftheagency.Itdoesnotinclude statementsconcerningonlytheinternalmanagementofstategovernment. Inthecaseatbarthepolicyforcharginginmatesforkeysandlockcylindersdoesnotfitwithinthedefinitionof rulesasprescribedbyTennesseeCodeAnnotatedsection45102(10).Accordingly,thepoliciesarenotsubjecttoreviewfordeclaratoryrelief. ItisthereforeORDEREDthattheabovecaptionedmatterisdismissedwithprejudice.Inthatthepetitionerhasqualifiedtoproceedasapauper,theCourtassessesonlystatelitigationtaxagainsttheplaintiff.     ThisCourtagreeswiththeconclusionoftheTrialJudgethatasuitfordeclaratoryjudgmentisnotanappropriatevehicleforrecoveryof$64.00ifincorrectlychargedtoplaintiff.Moreover,eveniftheTrialCourtshouldhavegrantedanyreliefdueunderthefacts,thefactsallegedinthecomplaintdonotsupportarefundofthe$64.00asclaimed. Thelossormisplacementofakeytoalockonadoorinacorrectionalinstitutionisaseriousmatter,andrequiresareplacementlockoperatedbyadifferentkey.Thefindingofthelostkeydoesnotobviatetheexpenseofthenewlock. Despitethepaupersoath,theplaintiffisliableforallcostsofthisproceeding.Thisappealisdeclaredtobeafrivolousappealrequiringtheassessmentofattorneyfeesonremand. ThejudgmentoftheTrialCourtismodifiedtorenderjudgmentagainstplaintiffforallcostsaccruedinthatCourt.Asmodified,saidjudgmentisaffirmed.Costsofthisappealaretaxedagainsttheplaintiff.ThecauseisremandedtotheTrialCourtforascertainmentoffeesforfrivolousappealandtheentryandenforcementofjudgmentinconformitywiththisopinion.
