CharlesMontagueisincarceratedintheNortheastCorrectionalCenterwhereheisservingalifesentenceforfirstdegreemurder 7   כandasixyearsentenceforpossessionofcontrolledsubstancesanddrugparaphernalia. 8   כOnOctober23,1994,Mr.Montaguereceivedadisciplinarywriteupafteraguardobservedhisgirlfriendmasturbatinghimduringanapprovedvisit.FollowingahearingonOctober31,1994,theprisondisciplinaryboardfoundMr.Montagueguiltyofsexualmisconductanddeterminedthatheshouldlosehisvisitationprivilegesforsixtydaysandthatheshouldlosehisprisonjob.TheCommissionerofCorrectionapprovedthesesanctionsonNovember10,1994.   OnFebruary21,1995,Mr.MontaguefiledapetitionfordeclaratoryjudgmentunderTenn.CodeAnn.45225(Supp.1997)(formerlyTenn.CodeAnn.45224)seekingjudicialreviewofthedisciplinaryboardsaction.TheDepartmentofCorrectionfiledaTenn.R.Civ.P.12.02(6)motiontodismissorinthealternativeforasummaryjudgmentaccompaniedbyevidentiarymaterialsrelatingtoMr.Montaguesdisciplinaryhearing.OnAugust7,1995,Mr.Montaguefiledanamendedcomplaintaddingaclaimseekingreliefthroughacommonlawwritofcertiorari.ThetrialcourtdismissedtheoriginalcomplaintonAugust30,1995,onthegroundthatdeclaratoryjudgmentproceedingsunderTenn.CodeAnn.45224couldnotbeusedtoreviewprisondisciplinaryproceedings.InresponsetoMr.Montaguesmotiontoreconsider,thetrialcourtalsoheldthatMr.Montaguehadfailedtostateaclaimforwhichreliefthroughacommonlawwritofhabeascorpuscouldbegranted.@ II. Mr.MontaguedidnotfileacomplaintseekingreliefpursuanttoacommonlawwritofcertiorariuntilAugust7,1995twohundredandseventydaysaftertheCommissioneraffirmedMr.Montaguespunishment.Evenifhiscertiorariclaimcouldrelatebacktothefilingofthecomplaintfordeclaratoryjudgment,itwasstillfiledonehundredandthreedaysaftertheCommissionersdecision.SinceMr.MontaguefiledhispetitionfortythreedaysaftertheexpirationoftheperiodprovidedinTenn.CodeAnn.279102,thetrialcourtcorrectlydeterminedthatthepetitionfailedtostateaclaimuponwhichreliefcanbegranted.@ III.
