Thisappealinvolvesamotiontosetasideanordermodifyingchildcustody.Defendant,GaryThomasMoore(Father),appealsthetrialcourtsordergrantingtheMotiontoDismissfiledbyplaintiff,BeverlyDiannePrivetteMoore(Mother),anddenyinghisMotionforReliefPursuanttoTenn.R.Civ.P.60.02. ThepartiesweredivorcedbyadecreeenteredonOctober,10,1990.Thepartieshavetwochildrentogether:GaryDwayneMoore,bornMarch28,1975,andDennisWesleyMoore,bornJune15,1978.AlthoughMotherwasawardedtemporarycustodyofthechildrenpendingthedivorceproceedings,thefinaldecreeofdivorceawardedcustodytoFather.InAprilof1991,MotherfiledaPetitiontoModifyCustody,allegingthatFatherwaspreparingtomoveoutofstatewiththechildren.ThispetitionandaccompanyinginjunctionwereneverservedonFather.Motherthenfileda FurtherPetitiontoModifyDecreeandforWritofAttachmentinAugustof1991andservedthispetitionbymailontheattorneywhorepresentedFatherintheoriginaldivorceaction.FathersattorneyfiledananswertothispetitiononAugust28,1991.Afterahearing,thecourtenteredanorderonJanuary29,1992modifyingtheoriginaldecreeandawardingcustodyofthetwochildren,thenagedsixteenandthirteen,toMother.ThecourtalsoorderedFathertopaychildsupport.  OnFebruary21,1996,Fatherfileda MotionforRelieffromChildSupportandtheRestoralofCustody.Fatherlaterfiledtwo amendmentstothisMotionforRelief,askingthetrialcourttosetasidetheModificationOrderpursuanttoTenn.R.Civ.P.60.02becauseof extrinsicfraudperpetratedbyMother.Motherwasnotrepresentedbycounselatthistime.OnJune11,1996,FatherfiledaMotionforDefaultJudgment,alongwithamemoranduminsupportofthemotion.Subsequently,FatherfiledanamendmenttohisMotionforDefaultJudgment.AfterMotherobtainedcounsel,shefiledananswertoFathersmotions,aresponsetohisMotionforDefaultJudgment,andaMotiontoDismiss.ThetrialcourtdeniedFathersMotionforDefaultJudgmentanddismissedhisMotionforReliefunderTenn.R.Civ.P.60.02,alongwithhisrequestfordamages.Fatherappealsthetrialcourtsdecision. AlthoughFatherpresentsthreeissuesforourreviewonappeal,weperceivetherealissuetobewhetherthetrialcourterredindismissinghisMotionforReliefpremisedonRule60.02(2).AmotionforreliefpursuanttoTenn.R.Civ.P.60.02lieswithinthesounddiscretionofthetrialcourt,andourreviewastothisissueiswhetherthetrialcourtabuseditsdiscretion. Underwoodv.ZurichIns.Co. ,854S.W.2d94,97(Tenn.1993). Althoughnotmentionedbyeitherparty,therecordindicatesthatbothofthepartieschildrenhadreachedtheageofmajoritybythetimeofthetrialcourtsdecisionrelevanttothisappeal.Thus,itappearsthatFathersmotiontosetasidetheordermodifyingchildcustodyismoot. H H  Fromourreviewoftherecord,however,itappearsthatthetrialcourtdismissedthemotionbecauseitwasuntimelyfiledandbecauseitfailedtostateaclaimuponwhichreliefcanbegranted. ThemotionseeksrelieffromtheordermodifyingchildcustodyonthebasisofTenn.R.Civ.P.60.02,whichprovidesinpertinentpart:8 8 Onmotionanduponsuchtermsasarejust,thecourtmayrelieveapartyorthepartyslegalrepresentativefromafinaljudgment,orderorproceedingforthefollowingreasons:...(2)fraud(whetherheretoforedenominatedintrinsicorextrinsic),misrepresentation,orothermisconductofanadverseparty....Themotionshallbemadewithinareasonabletime,andforreasons(1)and(2)notmorethanoneyearafterthejudgment,orderorproceedingwasenteredortaken.  Fathersmotion,filedonFebruary21,1996,seeksreliefpursuantto60.02(2).ThiswasoverfouryearsafterthetrialcourtsordermodifyingchildcustodywasenteredonJanuary29,1992.Rule60.02isquiteexplicitthatamotionseekingreliefbecauseofthefraudofanadversepartymustbefiledwithinoneyearofthedateoftheorderfromwhichreliefissought.Thismotionwasnotsofiledandwas,therefore,untimely.Thus,thetrialcourtcorrectlydismissedthemotiononthisbasis.
