TheclaimforworkerscompensationbenefitswasheardOctober22,1993.TheCommissionerfoundthattheplaintiffsustainedaworkrelatedinjuryonAugust24,1990duringthecourseofheremploymentasanaccountclerkwiththeDepartmentofCorrections,andthatshewas90percentpermanentlypartiallydisabledasaresultofthisaccidentandentitledtobenefitsaccordingly,plus124weeksfortemporarytotaldisability. 1   כ Withrespecttothatportionofthecomplaintseekingtorecoverdamagesfortheassertedtortofretaliatorydischarge,thedefendantfiledamotiontodismisspursuanttoRule12.02(1),Tenn.R.Civ.P.,forlackofsubjectmatterjurisdiction.TheCommissioneroverruledthemotiononJanuary30,1995,holdingthatthejurisdictionalstatuteoftheClaimsCommission 2   ׀wassufficientlybroadtoϜ accommodateaclaimfordamagesforthetortofretaliatorydischarge.𛀀Theclaimthenlayfallowfor19monthswhentheCommissionenteredanOrder,onSeptember9,1996,that theclaimanthasfactuallyandlegallyestablishedthatshewasdischargedbecauseshefiledaworkerscompensationclaim,butreservedtheissueofdamagesforalaterdetermination.Ajudgmentfordamagesintheamountof$300,000.00wasenteredonNovember9,1996. TheStateappealstheawardofdamagesforaretaliatorydischargeandpresentsforreviewtheissuesof(1)whethertheClaimsCommissionererredinholdingthathehadsubjectmatterjurisdictionoverthecauseofactionforretaliatorydischargeforfilingaworkerscompensationclaimagainsttheState,and(2)whethertheCommissionererredinholdingthattheclaimantisentitledtodamagesintheamountof$300,000.00forretaliatorydischargewhentheonlyreliefavailableforretaliatorydischargeisequitablerelief.Inlightofourdispositionofthecase,wedonotreachthesecondissue. TheTennesseeClaimsCommissionisanadministrativetribunal.Tenn.CodeAnn.98301(a).IthasexclusivejurisdictiontodetermineallmonetaryclaimsagainsttheStatefallingwithincertainenumeratedcategories,oneofwhich,(k),isallegedtoconferjurisdictionintheCommissiontoentertainthesubjectaction.Tenn.CodeAnn.98307(a)(1)(k)provides:  8 (K)WorkerscompensationclaimsbyStateemployees,includinginjuriesincurredbynationalguardmembers,statedefenseforcemembers,civilairpatrolmembers,civildefenseagencypersonnelandemergencyforestfirefighterswhileonactivedutyandinthecourseofthatduty; 8 (I)TheCommissionspaymentoftheseclaimsshallbeinsuchamountandsubjecttosuchlimitationssetforthintitle50,chapter6...   Infindingsubjectmatterjurisdictioninthiscase,theCommissionerreasonedthatthe  8 jurisdictionalstatute...incorporatestheprovisionsofTitle50,Chapter6oftheTennesseeCode(Tenn.CodeAnn.506101,etseq.)uponwhichallworkerscompensationcasesintheClaimsCommissionaredecided...aretaliatorydischargeisadevicewithinthemeaningofTenn.CodeAnn.506114 3   כ"    andcitedAndersonv.StandardRegisterCo.,857S.W.2d555(Tenn.1993)asauthorityforhisaction. Andersondidnotaddressajurisdictionalissue.Neitherwasitconcernedwiththecreationofacauseofaction.Theissuewaswhetherthefactsaspleadedandprovedconstitutedthepreviouslyrecognizedtortofretaliatorydischarge,andthusAndersoniswhollyinappositetothecaseathand. ThejurisdictionoftheClaimsCommissionisnotgeneral.Thelegislatureclearlylimiteditsjurisdictiontocertaincategorizedclaims,noneofwhichisaclaimfordamagesforaretaliatorydischarge.Itisbeyondperadventurethatsuchaclaimisadisparatetort,forwhichtheStatehasnotconsentedtobesued.Absentspecificconsent,theStateisimmunefromliabilityfordamagesresultingfromtortscommittedbyitsemployees.򛀜Tenn.Const.,Art.1,Sect.17;Kirbyv.MaconCounty,892S.W.2d403(Tenn.1994). ToparaphraseKirby,theClaimsCommissionActwasanActofGracetotheextentitexposedtheStateTreasurytothepaymentofcertaindetermined,describedclaims,butnotfurtherorotherwise. ThefiringofanemployeeforfilingaworkerscompensationclaimwasrecognizedasanactionabletortbytheSupremeCourtofTennesseeinClantonv.CainSloanCompany,677S.W.2d441(Tenn.1984).Thisjudicialremedywascreatedthusly:  8  Inouropinion,acauseofactionforretaliatorydischarge,althoughnotexplicitlycreatedbythestatute,isnecessarytoenforcethedutyoftheemployer,tosecuretherightsoftheemployeeandtocarryouttheintentionofthelegislature.Astatuteneednotexpresslystatewhatisnecessarilyimpliedinordertorenderiteffectual.  Relatedcasessoonfollowed.InVanCleavev.McKeeBakingCo.,712S.W.2d94(Tenn.1986),theCourtheldthat [a]claimfordamagesforretaliatorydischargeisnotpartofaworkerscompensationclaimbutisaseparatetortaction... TothesameeffectisSmithv.LincolnBrassWorks,712S.W.2d470(Tenn.1986)inwhichaclaimfordamagesforretaliatorydischargewastreatedasatortactionthatcannotbejoinedwithaworkerscompensationclaim.Seealso,Weberv.Moss,938S.W.2d387(Tenn.1996). WeneednotbelaborthepointnorengageinanalysiswherenoneisϜrequired.TheTennesseeClaimsCommissioniswithoutjurisdictiontoentertainclaimsagainsttheStatefordamagesforthetortofretaliatorydischarge.
