×€€The€trialÏcourtððs€order€cites€Tenn.€œDepððt.€Personnel›€œR.€1120„2„.13(1)(a),›€which€permits€anÏappointing€authority€to€transfer€an€employee€with€the€approval€of€theÏCommissioner€of€Personnel.€€The€trial€courtððs€order€also€cites€T.C.A.€ðð€8„30„221Ïfor€the€proposition€that€the€appointing€authority€and€the€Commissioner€mustÏbase€their€transfer€decisions€on€an€employeeððs€merit€rather€than€on€theÏemployeeððs€political€beliefs.€€Therefore,€the€trial€court€held€that€all€careerÏemployees€are€ð ðentitled€to€grieve€a€transfer€alleged€to€be€politically€motivated.ððÌà àRespondents€argue€for€a€more€narrow€interpretation€of€subsection€(9).€ÏRespondents€contend€that€the€purpose€of€the€provision€is€to€give€theÏappointing€authority€and€the€CSC€flexibility€to€consider€other€matters€to€beÏgrievable€solely€at€their€discretion.€€Respondents€maintain€that€the€fifty€mileÏradius€limitation€imposed€under€subsections€(3)€&€(4)€would€be€a€nullity€if€anÏemployee€is€entitled€to€a€hearing€for€òòanyóó€grievance€arising€from€an€action€takenÍwithin€the€control€and€discretion€of€an€appointing€authority.€€RespondentsÏfurther€contend€that€the€trial€courtððs€reliance€on€T.C.A.€ðð€8„30„201(a)€and€ðð€8„30„221€is€misplaced.€€According€to€the€respondents,€these€provisions€are€merelyÏdirectory€in€nature€and€do€not€confer€a€right€to€relief€under€the€grievanceÏprocedures.Ìà àThe€commissioner€of€personnel€has€the€duty€to€prescribe€rules€andÏregulations€for€the€administration€and€execution€of€the€personnel€statutoryÏprovision,€which€rules€shall€have€the€force€and€effect€of€law.€€T.C.A.€ðð€8„30„202Ï(a)(6)(A)€&€ðð€8„30„205.€€The€primary€rule€of€statutory€construction€is€that€theÏintention€of€the€legislative€body€must€prevail,€ò òòòDingman€v.€Harvelló óóó,€814€S.W.2dÏ362,€366€(Tenn.€App.€œ1991),›€œand›€this€intent€is€ascertained€primarily€from€theÏnatural€and€ordinary€meaning€of€the€language€used.€€ò òòòSteele€v.€Ft.€SandersÏAnesthesia€Group,€P.C.ó óóó,€897€S.W.2d€270,€280€(Tenn.€App.€1994).ÌÑ7€Ì„XXdðXXdð7Ñà àRespondents€assert€that€the€trial€court€interpreted€personnel€rule€1120„11„.07(9)€as€applying€to€the€actual€act€which€is€the€basis€of€the€grievance,€i.e.,ÏMoserððs€transfer.€€The€trial€courtððs€memorandum€and€order€states:€ð ðSince€theÏappointing€authority€makes€the€transfer€decisions,€and€such€decisions€may€notÏbe€based€on€politics,€any€employee€who€is€a€career€employee€is€entitled€to€grieveÏa€transfer€alleged€to€be€politically€motivated.ðð€€If€the€respondentsðð€assertion€isÍcorrect,€we€would€respectfully€disagree€with€the€trial€courtððs€interpretation.€ÏFirst,€we€note€that€Rule€œ1120„11„.07›€lists€specific€grievable€matters€followed€byÏsubsection€(9)€which€states€ð ðother€matters€within€the€discretion€or€control€ofÏthe€appointing€authority€or€commission.ðð€€It€seems€clear€that€subsection€(9)€isÏtalking€about€other€grievable€matters€and€not€discretionary€acts€on€the€part€ofÏthe€appointing€authority€in€performance€of€the€actual€act€which€is€the€basis€ofÏthe€grievance.€€This€is€made€even€more€clear€by€the€fact€that€Moserððs€transferÏwas€entirely€within€the€control€of€the€appointing€authority€with€approval€of€theÏCommissioner€of€Personnel.€The€commission€(CSC)€would€have€no€part€inÏmaking€such€a€decision.€€Yet,€subsection€(9)€provides€for€other€matters€withinÏthe€control€of€the€appointing€authority€òòor€the€commissionóó.€€Obviously,€theÏdiscretion€referred€to€is€not€the€discretion€in€the€original€act€which€created€theÏgrievance€but€is€a€catch„all€provision€to€allow€the€appointing€authority€or€theÏcommission,€depending€upon€who€is€called€upon€to€act,€to€determine€in€theirÏdiscretion€that€some€matters€not€specifically€set€out€in€the€rules€should€beÏgrievable.€€à àÌà àUnder€certain€circumstances,€there€could€be€an€abuse€of€discretion€onÏthe€part€of€the€appointing€authority€or€the€commission€in€making€aÏdetermination€of€whether€a€nonspecified€matter€is€grievable.€€Under€thoseÍcircumstances€we€believe€the€standard€to€measure€exercise€of€discretion€shouldÏbe€the€same€as€for€a€trial€court€in€the€performance€of€its€discretionary€duties.€ÏIn€ò òòòBallard€v.€Herzkeó óóó,€924€S.W.2d€652€(Tenn.€App.€1996),€our€Supreme€CourtÏsaid:ÌÓÓà8 àà8 à€€€€€Discretion€denotes€the€absence€of€a€hard€and€fastÏrule.€€When€invoked€as€a€guide€for€judicial€action,€itÏrequires€that€the€trial€court€view€the€factualÏcircumstances€in€light€of€the€relevant€legal€principlesÏand€exercise€considered€discretion€before€reaching€aÏconclusion.€€Discretion€should€not€be€arbitrarilyÏexercised.€€The€applicable€facts€and€law€must€be€givenÏdue€consideration.€€An€appellate€court€should€notÏreverse€for€ð ðabuse€of€discretionðð€a€discretionaryÏjudgment€of€a€trial€court€unless€it€affirmativelyÏappears€that€the€trial€courtððs€decision€was€against€theÏlogic€or€reasoning,€and€caused€an€injustice€or€injury€toÏthe€party€complaining.€€ÌÌò àThe€trial€court€correctly€noted€that€state€agencies€are€prohibited€fromÏbasing€employment€decisions€on€the€political€beliefs€of€employees.€€T.C.A.€ðð€8„30„201€(a)€&€ðð€œ8„30„221.€€Respondents›€contend€that€these€statutory€provisionsÏdo€not€entitle€an€employee€to€challenge€the€personnel€action€under€theÏgrievance€procedure€outlined€in€UAPA.€€We€must€respectfully€disagree.Ìà àA€state€employee,€after€completing€a€probationary€period,€has€a€propertyÏright€in€his€or€her€position.€€T.C.A.€ðð€8„30„331€(1993).€€This€property€rightÍcould€reasonably€be€construed€to€include€the€geographical€location€of€theÏemployment.Ìà àMoser€contends€that€he€has€a€property€interest€in€employment€inÏMonroe€County,€and€that€the€transfer€without€a€hearing€violated€hisÏconstitutional€due€process€rights.€€In€ò òòòRutan€v.€Republican€Party€of€Illinoisó óóó,€497ÏU.S.€62,€110€S.Ct.€2729,€111€L.Ed.2d€52€(1990),€the€Supreme€Court€held:ÌÓÓà8 àà8 à€€€€We€therefore€determine€that€promotions,€transfers,Ïand€recalls€after€layoff€based€on€political€affiliation€orÏsupport€are€an€impermissible€infringement€on€theÏFirst€Amendment€rights€of€public€employees.ÌÌò òòòIdó óóó.€497€U.S.€at€75,€110€S.Ct.€at€2737.ÌÌÓÓà àThe€record€in€this€case€reflects€that€Moser€was€not€afforded€minimumÏdue€process.€€The€Commissioner€did€not€properly€exercise€its€discretion€underÏpersonnel€rule€œ1120„11„.07(9).›€€Under€the€peculiar€facts€of€this€case,€MoserÏshould€have€been€granted€a€grievance€hearing€pursuant€to€this€rule.Ìà àAccordingly,€the€judgment€of€the€trial€court€is€affirmed,€and€the€case€isÏremanded€to€the€Civil€Service€Commission€for€proceedings€consistent€with€thisÏopinion.€€Costs€of€the€appeal€are€assessed€against€the€respondents.€€WeÏpretermit€Moserððs€alternative€issues.ÌÓÓà
