Ðconstitutes€ð ðmarital€propertyðð€and€ð ðseparate€propertyðð€for€the€purposes€of€that€chapter€of€the€CodeÐ $X" Ðdealing€with€divorce€and€annulment.€€This€case€poses€the€question,€can€the€parties€to€a€marriage,€byÐ ô$D # Ðpost„nuptial€agreement,€convert€property€which€might€otherwise€be€ð ðmarital€propertyðð€into€ð ðseparateÐ à%0!$ Ðpropertyðð€and€thereby€bind€themselves€òòin€futuroóó?€€Under€the€terms€of€section€36„4„121€and€pursuantÐ Ì&"% Ðto€òòBrattonóó,€we€would€answer€the€question€in€the€affirmative.€€First€of€all,€though€ð ðseparate€propertyððÐ ¸'#& Ðis€specifically€defined€under€section€36„4„121(b)(2),€the€same€statute€provides€in€section€(g)(1),€Ð ¤(ô#' Ðð ð[Ô_Ôn]othingÔ_Ô€in€this€section€shall€be€construed€to€prevent€the€affirmation,€ratification€and€incorporationÐ )à$( Ðin€a€decree€of€an€agreement€between€the€parties€regarding€the€division€of€property.ððÐ |*Ì%) ÐÐ h+¸&* Ðà  àWhen€this€latter€provision€of€the€statute€is€read€in€conjunction€with€òòBrattonóó€all€doubt€isÐ ° Ðremoved:Ð œì ÐÌà8  à[Ô_ÔW]eÔ_Ô€adopt€the€proposition€that€marital€partners€may€validly€contract€to€divideÐ tÄ Ðproperty€or€set€support€in€the€event€of€a€divorce€by€postnuptial€agreement,€evenÐ `° Ðwithout€it€being€incident€to€a€contemplated€separation€or€divorce.ÐL œÐ Ð  ÐÌà8  àà ` àGenerally,€postnuptial€agreements€will€be€treated€in€the€same€manner€asÐ $ t ÐÔ_ÔantinuptialÔ_Ô€and€reconciliation€agreements.Ð `Ð Ð  ÐÌòòBrattonóó,€136€S.W.3d€at€600.Ð è 8  ÐÌà  àLike€anti„nuptial€agreements,€such€post„nuptial€contract€must€be€freely€and€knowledgeably€Ð À  Ðexecuted€by€both€spouses€in€good€faith€and€without€duress€or€undue€influence€affecting€eitherÐ ¬ü  Ðspouse.€€òòSeeóó€Tenn.€Code€Ann.€ðð€36„3„501.€€In€the€case€at€bar,€it€is€neither€alleged€nor€proven€thatÐ ˜è  Ðeither€party€was€acting€under€duress€or€undue€influence€or€in€any€other€way€except€freely,Ð „Ô  Ðknowledgeably€and€in€good€faith€when€they€executed€the€1995€Agreement.€Ð pÀ ÐÌà  àEqually€compelling€as€a€reason€to€uphold€the€validity€of€Agreement€and€the€action€of€the€trialÐ H˜ Ðcourt€is€the€fact€that€the€parties,€subsequent€to€the€execution€of€the€Agreement€in€1995,€scrupulouslyÐ 4„ Ðhonored€its€provisions.€€Doubtless,€after€1995,€the€parties€could€have,€by€their€actions,€created€aÐ  p Ðmarital€estate€which€would€have€been€subject€to€distribution€under€Tennessee€Code€AnnotatedÐ  \ Ðsection€36„4„121€at€the€time€of€the€December€2002€divorce.€€But€all€of€the€proof€in€this€caseÐ øH Ðestablishes€that€the€parties€did€not€do€so€but€continued€to€act€in€conformity€with€the€1995€Agreement.Ð ä4 ÐUnder€the€Agreement€Husband€was€to€pay€$12,533€to€the€Internal€Revenue€Service€for€the€partiesððÐ Ð  Ðtax€liability€in€1994.€€He€did€so.€€In€1995€and€1996,€the€parties€filed€separate€tax€returns€with€WifeÐ ¼  Ðclaiming€all€income€from€the€Hickory€Hollow€Mini„Storage€Warehouse.€€In€1997,€she€sold€the€mini„Ð ¨ø Ðstorage€warehouse€with€her€signature€alone€being€appended€to€the€transfer€documents€and€theÐ ”ä Ð$27,000€purchase€price€paid€to€her€and€her€alone.€€She€sold€the€Gillette€Road€property€in€1997€takingÐ €Ð Ðall€of€the€$40,000€equity€therein.€€During€the€years€the€parties€filed€separate€tax€returns€(1995,€1996Ð l¼ Ðand€2001),€Charles€Mosley€claimed€the€Brentwood,€Williamsburg€Road€property€on€his€tax€return.€Ð X ¨ ÐSubsequent€to€1995,€and€prior€to€the€2003€divorce,€Wife€used€much€of€her€money,€realized€from€saleÐ D!” Ðof€her€assets,€to€pay€debts€for€her€son€and€her€sick€nieceððs€husband.€€Finally,€between€1995€and€2003,Ð 0"€  Ðthe€record€clearly€shows€that€the€parties€accumulated€no€marital€property€but€continued€to€treat€theirÐ #l! Ðassets€as€individual€assets€in€accordance€with€the€òòin€futuroóó€provisions€of€the€Marital€DissolutionÐ $X" ÐAgreement.Ð ô$D # ÐÌà  àThe€parties,€despite€their€on€and€off€relationship€during€their€marriage,€accumulatedÐ Ì&"% Ðsubstantial€property€during€their€23€year€marriage.€€Beginning€in€1990€they€kept€separate€bankÐ ¸'#& Ðaccounts€and,€in€1995,€determined€by€post„nuptial€agreement€to€settle€their€property€rights€both€forÐ ¤(ô#' Ðthe€present€and€for€the€future.€€Thereafter,€they€scrupulously€followed€their€Marital€DissolutionÐ )à$( ÐAgreement.€€In€the€interim€between€1995€and€2003,€Wife€disposed€of€much€of€the€assets€given€toÐ |*Ì%) Ðher€under€the€Marital€Dissolution€Agreement.€€She€used€the€proceeds€of€her€dispositions€to€benefitÐ h+¸&* Ðher€son€by€a€previous€marriage€and€sick€relatives.€€She€now€seeks€a€redistribution€of€alleged€maritalÐ ° Ðproperty€which€consists€almost€entirely€of€the€corpus€of€and€the€fruits€of€property€assigned€toÐ œì ÐHusband€in€the€1995€Marital€Dissolution€Agreement.Ð ˆØ ÐÌà  àSuch€being€the€facts€of€the€case,€the€trial€court€correctly€held€that€the€Marital€DissolutionÐ `° ÐAgreement€was€a€fair€and€equitable€distribution€of€the€property€of€the€parties,€which€is€a€particularlyÐ L œ Ðappealing€action€in€view€of€the€fact€that€the€parties€accumulated€no€marital€property€between€theÐ 8 ˆ ÐAgreement€of€1995€and€the€divorce€and€property€settlement€decree€in€2003.Ð $ t ÐÌà  àAppellant€seeks€attorneyððs€fees€from€Appellee€pursuant€to€the€provisions€of€the€1995Ð ü L  ÐAgreement.€€The€trial€court€did€not€allow€attorneyððs€fees€but€gave€no€reason€for€the€decision.€Ð è 8  ÐWhether€or€not€to€allow€attorneyððs€fees€is€largely€in€the€discretion€of€the€trial€court,€òòBarnhillóó,€826Ð Ô$  ÐS.W.2d€443.€€The€trial€court€offered€no€reason€for€denying€attorneyððs€fees,€but€it€is€well€to€note€thatÐ À  ÐAppellant€did€not€raise€the€1995€Agreement€in€his€Answer€and€Counter„Complaint€and€did€not€seekÐ ¬ü  Ðto€enforce€such€Agreement€until€three€days€before€the€trial€of€this€case€on€February€10,€2003.€€WeÐ ˜è  Ðwill€not€disturb€the€action€of€the€trial€court€in€denying€attorneyððs€fees.Ð „Ô  ÐÌà  àThe€action€of€the€trial€court€is€in€all€respects€affirmed.€€Costs€of€this€cause€are€assessed€toÐ \¬ ÐAppellant.€€The€case€is€remanded€to€the€trial€court€for€such€further€proceedings€as€may€be€necessary.Ð H˜ ÐÌÌà  àÌÌÌÌà  àà ` àà ¸ àà  àà h àà À àà  à___________________________________€Ð ¼  Ðà  àà ` àà ¸ àà  àà h àà À àà  àWILLIAM€B.€CAIN,€JUDGE
