àò òI.ó óÌÌà à€à àRoald€Moyers€and€Kathy€Moyers€were€divorced€by€a€final€decree€ofÏthe€Davidson€County€Circuit€Court€on€June€15,€1994.€€The€decree€divided€theÏmarital€property€and€ordered€the€husband€to€take€sole€responsibility€for€theÏpayment€of€certain€marital€debts€as€alimony€in€solido,€and€to€hold€the€wifeÏharmless€for€those€debts.ÌÌà àà àHe€was€also€ordered€to€pay€the€wife€rehabilitative€alimony€for€twoÏyears.€The€decree€included€a€finding€that€both€parties€were€guilty€of€willfulÏcriminal€contempt€for€failing€to€abide€by€previously€issued€restraining€orders,€andÏthey€were€sentenced€to€take€a€tour€of€the€Metro€Jail.ÌÌà àà àThe€wife€filed€several€post„divorce€petitions€for€contempt€against€herÏformer€husband.€€This€case€arose€out€of€an€amended€petition,€filed€on€April€26,Ï1996,€in€which€she€asked€the€court€to€find€him€in€criminal€and€civil€contempt€forÏfailing€to€comply€with€the€courtððs€order€to€pay€off€five€separate€obligations.€€SheÏsigned€the€pleading€with€the€name€Kathy€L.€Moyers€Flaherty,€and€we€willÏhenceforth€refer€to€her€as€Ms.€Flaherty€or€as€petitioner.€€Her€former€husband€is€aÏchiropractor,€and€we€will€refer€to€him€as€Dr.€Moyers€or€as€respondent.€ÌÌà àà àRespondentððs€attorney€subsequently€filed€several€motions.€€HisÏMotion€to€Recuse€was€based€on€Dr.€Moyersðð€objections€to€colloquy€at€an€earlierÏhearing,€where€the€trial€judge€advised€Ms.€Flahertyððs€attorney€to€amend€theÍPetition€for€Contempt€to€allege€criminal€contempt,€because€it€was€unlikely€that€theÏcourt€could€imprison€him€for€civil€contempt.€€The€respondent€felt€that€the€giving€ofÏsuch€advice€was€improper€and€gave€the€appearance€of€partiality.ÌÌà àà àAnother€motion€was€captioned€Motion€to€Disqualify€Private€CounselÏfrom€Criminal€Prosecution.€€The€respondent€argued€that€allowing€Ms.€FlahertyððsÏattorney€to€prosecute€the€contempt€was€inconsistent€with€the€directives€of€theÏUnited€States€Supreme€Court€in€the€case€of€òòYoung€v.€U.S.óó,€481€U.S.€787,€107ÏS.Ct.€2124,€L.Ed.2d€740€(1987)€and€of€Tenn.€Code€Ann.€ðð€8„7„103,€which€sets€outÏthe€duties€of€District€Attorneys€General.Ì€€€Ìà àThe€Motion€to€Require€Petitioner€to€Proceed€on€Civil€or€CriminalÏContempt€asked€the€court€to€order€the€petitioner€to€elect€the€theory€under€whichÏshe€would€be€proceeding,€in€order€that€the€respondentððs€attorney€might€properlyÏprepare€for€trial.ÌÌà àThe€case€was€heard€on€May€9,€1996.€€The€trial€court€orally€deniedÏthe€Motion€to€Recuse€and€the€Motion€to€Disqualify€Private€Counsel.€€TheÏpetitionerððs€attorney€stated€that€if€he€was€required€to€make€an€election,€he€wouldÏelect€to€proceed€on€the€criminal€contempt.€€The€respondent€and€the€petitionerÏwere€the€only€two€witnesses€called.€€Dr.€Moyers€admitted€that€he€did€not€make€theÏrequired€payments,€but€claimed€that€he€was€financially€unable€to€do€so.€€Ms.ÍFlaherty€testified€to€a€telephone€conversation€in€which€Dr.€Moyers€allegedly€toldÏher€that€he€had€no€intention€of€complying€with€the€order€of€the€court,€and€madeÏinsulting€references€both€to€her€and€to€the€judge.€ÌÌà àà àThe€judge€found€the€respondent€to€be€guilty€of€five€counts€of€willfulÏcriminal€contempt€for€failing€to€pay€on€each€of€the€five€obligations,€and€he€wasÏsentenced€to€ten€days€in€the€Metro€jail€for€each€offense,€the€sentences€to€beÏserved€consecutively.€€The€judge€also€awarded€the€petitioner€judgments€on€fourÏof€the€obligations,× ƒ, ××  ×€totaling€$11,078.42,€and€$1,500€in€attorney€fees,€and€placed€aÏlien€on€the€respondentððs€office€equipment€and€furniture€to€secure€payment.€ThisÏappeal€followed.ÌÌà@ àò òII.ó óÌÌà àà àAfter€filing€his€notice€of€appeal,€the€respondentððs€attorney€filedÏcopies€of€the€notice€on€the€Tennessee€Attorney€General€and€on€the€DavidsonÏCounty€District€Attorney,€in€accordance€with€Tenn.€R.€App.€P.€5(b),€which€requiresÏsuch€notice€in€appeals€of€criminal€actions.€€The€Attorney€General€filed€a€brief€onÏbehalf€of€the€State,€which€vigorously€defended€the€trial€judgeððs€exercise€of€herÍdiscretion€in€refusing€to€recuse€herself,€and€in€denying€Dr.€Moyersðð€motion€toÏdisqualify€Ms.€Flahertyððs€private€counsel€from€prosecuting€the€contempts.€ÌÌà àà àThe€respondent€argues€that€the€trial€judge€erred€in€not€granting€hisÏmotion€that€she€recuse€herself.€€As€we€discussed€earlier,€he€alleged€that€at€anÏearlier€proceeding€the€judge€offered€legal€advice€to€Ms.€Flaherty€from€the€bench,Ïadvising€her€to€proceed€on€criminal€contempt€rather€than€civil€contempt€if€sheÏwanted€to€see€her€former€husband€go€to€jail.€€ÌÌà àà àThere€is€no€transcript€in€the€record€of€the€proceeding€where€thatÏadvice€was€allegedly€given.€€We€only€have€the€arguments€of€counsel€and€theÏallegations€in€pleadings€to€go€on,€and€these€do€not€constitute€evidence.€€Even€ifÏwe€were€to€concede€the€accuracy€of€the€respondentððs€account€of€the€judgeððsÏwords,€this€would€still€not€necessarily€require€recusal,€absent€a€more€completeÏrecord€of€the€proceedings€to€reveal€the€circumstances€and€the€context€in€whichÏthose€words€were€uttered.ÌÌà àà àDr.€Moyers€also€argues€that€the€trial€court€should€have€granted€hisÏmotion€to€disqualify€the€wifeððs€attorney€from€prosecuting€this€action.€€He€relies€onÏan€opinion€of€the€United€States€Supreme€Court,€òòYoung€v.€U.S.óó,€481€U.S.€787,€107ÏS.Ct.€2124,€95€L.Ed.2d€740€(1987)€in€which€the€High€Court€ruled€that€ð ð.€.€.€we€agree€with€the€United€States€Supreme€Court€thatÏthe€better€practice€is€for€a€trial€court€to€first€ask€the€districtÏattorney€to€prosecute€contempt€actions,€and€shouldÏappoint€a€private€prosecutor€only€if€that€request€is€denied.ðð€ÌÌÒ € ÒÒ  ÒÒ € ÒÒ „ Ò938€S.W.2d€at€403.ÌÌÌÓÓÌà àà àWe€believe,€however,€that€in€the€present€case€even€if€it€was€error€forÏthe€trial€court€not€to€ask€for€a€public€prosecutor€before€allowing€Ms.€FlahertyððsÏattorney€to€prosecute€the€contempt,€the€error€was€harmless€because€it€did€notÏaffect€the€outcome.€€As€the€State€pointed€out,€the€petitionerððs€attorney€was€notÍgranted€permission€to€conduct€his€own€investigation€or€given€broad€prosecutorialÏpowers€(unlike€the€attorney€in€the€òòYoungóó€case).€€His€role€was€limited€toÏquestioning€the€parties€during€the€hearing.€€It€is€hard€to€see€how€the€appointmentÏof€a€different€attorney€to€prosecute€this€case€would€have€altered€the€result.€€ÌÌà@ àò òIII.Ìó óÌà àà àThough€we€have€found€no€plain€error€in€the€trial€courtððs€refusal€toÏgrant€the€respondentððs€motions,€we€must€reverse€four€out€of€the€five€judgments€ofÏcontempt,€because€we€do€not€believe€the€trial€court€applied€the€correct€standardÏof€proof€in€reaching€its€decision€on€those€counts.à àÌÌà àà àIn€order€to€find€a€party€guilty€of€criminal€contempt,€the€defendantððsÏguilt€must€be€established€beyond€a€reasonable€doubt.€€See€òòStrunk€v.€Lewis€CoalÏCompanyóó,€547€S.W.2d€252€(Tenn.€Crim.€App.€1976).€€Where€the€contempt€arisesÏfrom€failure€to€make€a€court„ordered€payment,€the€court€must€find€beyond€aÏreasonable€doubt€not€only€that€the€defendant€failed€to€make€the€requiredÏpayment,€but€also€that€he€had€the€ability€to€pay.€€Dr.€Moyers€admitted€that€he€didÏnot€pay€the€debts€that€he€was€ordered€to,€but€he€claimed€that€he€was€unable€toÏpay.€€ÌÌà àà àThe€proof€showed€that€Dr.€Moyers€had€been€a€Doctor€of€ChiropracticÏfor€twenty„five€years,€and€that€he€had€previously€practiced€in€California.€€HeÏtestified€extensively€about€his€current€practice,€which€he€established€inÏNolensville€in€1992.€He€stated€that€in€the€year€of€the€divorce€(1994)€his€practiceÏgrossed€$32,000,€and€that€after€his€business€expenses€were€subtracted€from€thatÏsum,€he€was€left€with€a€net€income€of€ð ðsomewhere€around€$8,000.ðð€€He€wasÏapparently€pinning€his€hopes€for€the€success€of€his€new€practice€on€the€extensionÏof€sewage€services€to€Nolensville€and€the€population€growth€that€wouldÏpresumably€bring.ÌÌà àà àIn€1995,€Dr.€Moyers€filed€for€bankruptcy.€€Ms.€Flaherty€successfullyÏpetitioned€the€Bankruptcy€Court€to€declare€his€obligations€to€her€to€be€non„dischargeable.ÜÜÛÛ× ƒ. ××  ×ÌÌà àà àThe€petitioner€testified€that€she€had€helped€her€former€husbandÏestablish€his€practice,€and€helped€him€run€the€business€when€they€were€stillÏtogether.€The€respondentððs€attorney€questioned€her€about€his€income:ÌÒ 0 ÒÒ „ ÒÒ 0 ÒÒ  ÒÓÓQ.à àWhat€was€his€income?ÌÌA.à àYouððre€asking€net€or€gross?ÌÌQ.à àWhat€he€had€access€to,€yes,€maððam,€net.ÌÌA.à àEvery€month€that€business€was€growing,€everyÏmonth.€And€I€believe€in€December€of€that€last€year€I€wasÏwith€him,€we€were€making€eight€grand€a€month.€ÌÌQ.à àIs€that€what€you€could€take€out€of€the€business€orÏwas€that€your€total€intake?ÌÌA.à àBeing€as€it€was€a€new€business€that€was€the€intake.ÌÌQ.à àOkay.€€So€out€of€that€8,000€per€month€how€muchÏcould€you€spend€for€personal€needs?ÌÌA.à àSir,€I€donððt€remember.ÌÌQ.à àDo€you€remember€any€other€months?ÌÌA.à àNo.€€There€is€bad€things€that€one€tries€to€block€out.ÌÒ € ÒÒ  ÒÒ € ÒÒ „ ÒÌÓÓÌThis€was€the€extent€of€Ms.€Flahertyððs€testimony€as€to€the€respondentððs€income€andÏexpenses.ÌÌà àà àThe€parties€also€disputed€the€disposition€of€some€property€that€hadÏbeen€divided€in€the€final€decree.€€Dr.€Moyers€testified€that€he€had€sold€his€gunÏcollection,€and€part€of€an€art€collection€that€the€parties€had€been€ordered€to€divideÏequally,€and€that€he€had€used€the€proceeds€to€live€on.€€A€prior€order€of€the€courtÏindicates€that€he€had€claimed€that€the€art€collection€had€been€stolen,€and€the€courtÏat€that€time€ordered€him€to€pay€the€petitioner€$957.50,€representing€the€value€ofÏone„half€of€the€collection.€€€€ÌÌà à€à àDr.€Moyers€also€claimed€that€a€box€of€diamond€jewelry€he€ownedÏhad€been€stolen,€and€that€the€wife€had€probably€taken€it.€€The€wife€claimed€thatÏthe€husband€still€had€the€jewelry,€and€that€he€had€perjured€himself€in€bankruptcyÏcourt€by€not€declaring€it.ÌÌà àà àAt€the€conclusion€of€the€proof,€the€court€stated:ÌÒ 0 ÒÒ „ ÒÒ 0 ÒÒ  ÒÓÓð ðHaving€heard€the€evidence€presented€I€find€that€Dr.ÏMoyers€is€in€willful€criminal€contempt€of€the€orders€of€thisÏcourt.€€Heððs€had€the€ability€to€pay€these€debts€from€dayÏone,€but€he€set€upon€a€course€to€disobey€the€order€andÏdefeat€the€interest€of€the€former€wife.€€Thatððs€his€patternÏthroughout€all€of€these€various€contempt€proceedingsÏweððve€had€since€the€day€of€the€final€decree.ðð€€Ì€ÌÌÌÒ àAfter€reviewing€the€record,€we€cannot€say€that€the€facts€in€evidenceÏare€sufficient€to€prove€that€Dr.€Moyers€had€the€financial€ability€to€satisfy€the€debtsÏhe€was€ordered€to€pay,€or€to€sustain€a€finding€that€he€was€guilty€beyond€aÏreasonable€doubt€of€the€contempts€relating€to€those€debts.€€We€do€find,€however,Ïsufficient€evidence€from€which€we€can€conclude€that€his€sale€of€the€art€collectionÏprovided€a€fund€from€which€he€could€have€paid€the€obligation€related€to€thatÏcollection,€at€least€in€part.ÌÌà àà àThe€appellant€argues€that€he€was€not€obligated€to€pay€the€$957.50.€ÏHe€contends€that€the€trial€court€cannot€modify€an€order€that€has€become€final,€thatÏthe€decree€ordering€him€to€divide€the€art€collection€with€his€wife€became€final€afterÏthirty€days,€and€that€the€subsequent€order€modifying€the€obligation€was€issuedÏafter€the€earlier€one€became€final.€€But€even€if,€òòarguendoóó,€we€concede€this€point,Ïwe€would€still€be€left€with€the€fact€that€he€did€not€give€the€wife€her€share€of€theÏcollection€when€it€was€still€in€his€possession,€and€that€part€of€it€remained€in€hisÏpossession€even€after€he€claimed€that€it€had€all€been€stolen.€€He€clearly€had€theÍability€to€perform€in€accordance€with€the€orders€of€the€court,€but€he€chose€not€to€doÏso.€€ÌÌà àà àWe€affirm€the€judgment€of€contempt€for€the€husbandððs€failure€toÏhonor€his€obligations€under€the€property€settlement.€€Our€dismissal€of€the€otherÏcounts€does€not,€of€course,€affect€the€validity€of€the€judgments€assessed€againstÏDr.€Moyers,€or€the€lien€placed€upon€his€assets.€Ìà
