àAt€some€point€before€airing€the€advertisements,€appellee€heard€some€Nashville€MetropolitanÏpolice€officers€discussing€a€deputy€sheriff€in€Wilson€County€who€had€been€involved€in€a€domesticÏdispute.€€Later,€a€young€woman€approached€the€appellee€and€told€him€she€had€been€involved€in€aÏdomestic€dispute€with€the€appellant.€€Appellee€also€started€receiving€anonymous€letters€from€ð ðoneÏof€the€sheriffs€[sic]€many€snitchesðð€regarding€practices€in€the€sheriffððs€department.€€AppelleeÏdecided€to€use€the€information€he€had€discovered€in€several€advertisements€during€his€campaign€forÏsheriff.ÌÌà ðduties€affect€the€lives,€liberty€and€property€of€citizens€.€.€.€.ðð€€òòSelbyóó,€1996€WL€219620,€*€4.€€WeÏbelieve€that€the€same€is€true€of€any€law€enforcement€officer.€€Therefore,€appellant€is€a€public€figure.ÌÌà ÒThe€occupant€of€any€position€in€any€branch€of€government€who€exercises€any€publicÏfunction€is€subject€to€the€New€York€Times€rule€as€to€all€conduct€in€his€officialÏcapacity€or€as€to€any€conduct€that€might€adversely€affect€his€fitness€for€public€office,Ïif€he€has€or€ð ðappear(s)€to€the€public€to€have,€substantial€responsibilities€for€orÏcontrol€over€the€conduct€of€governmental€affairs.ððÌÒ ° ÒÒ ° àOn€the€question€of€malice,€we€first€note€that€the€appellant€was€not€the€object€of€the€politicalÏadvertisements.€€The€appelleeððs€target€was€the€sheriff,€and€the€story€told€was€mostly€about€theÏsheriffððs€conduct€in€office.€€In€addition,€the€appellee€presented€evidence€that€he€believed€theÏinformation€to€be€true.€€In€his€affidavit,€appellee€stated€that€he€spoke€with€the€third€party,€sheÏshowed€him€her€medical€records,€she€showed€him€pictures€of€her€injuries,€she€showed€him€a€bloodyÏtowel€that€was€from€the€injury,€and€she€showed€him€the€Internal€Investigation€Statement€from€theÏWilson€County€Sheriffððs€Department.€€The€appellant€himself€admitted€he€hit€the€third€party€over€theÏhead€with€a€telephone.€€Based€on€his€investigation€and€the€corroboration€the€appellee€found,€andÏbased€on€the€lack€of€evidence€to€the€contrary,€we€find€that€there€is€nothing€in€the€record€from€whichÏan€inference€could€be€drawn€that€the€appellee€acted€maliciously€toward€the€appellant.ÌÌà@ àIn€addition,€we€find€that€the€appellant€has€failed€to€show€that€he€was€damaged€by€theÏpublication€of€the€advertisements.€€In€a€defamation€case,€a€plaintiff€must€prove€actual€damagesÏresulting€from€actual€injury.€€òòGertz€v.€Robert€Welch,€Inc.óó,€418€U.S.€323,€349„50€(1974);€òòMemphisÏPublishing€Co€v.€Nicholsóó,€569€S.W.2d€412,€421€(Tenn.€1978).€€The€United€States€Supreme€CourtÏaddressed€the€issue€of€actual€damages€in€òòGertz€v.€Robert€Welch,€Inc.óó,€418€U.S.€323€(1974).€€TheÏCourt€stated:ÌÌÒ  ÒÒ  ÒWe€need€not€define€ð ðactual€injury,ðð€as€trial€courts€have€wide€experience€in€framingÏappropriate€jury€instructions€in€tort€actions.€€Suffice€it€to€say€that€actual€injury€is€notÏlimited€to€out„of„pocket€loss.€€Indeed,€the€more€customary€types€of€actual€harmÏinflicted€by€defamatory€falsehood€include€impairment€of€reputation€and€standing€inÏthe€community,€personal€humiliation,€and€mental€anguish€and€suffering.ÌÒ ° ÒÒ ° ÒÌòòÔ_ÔGertzÔ_Ôóó,€418€U.S.€at€349„50.€€When€looking€at€damages€for€a€defamation€suit€this€court€has€statedÏthat,€ð ð[Ô_Ôt]heÔ_Ô€issue€is€whether€the€record€contains€any€material€evidence€of€impairment€of€reputationÏand€standing€in€the€community,€personal€humiliation,€or€mental€anguish€and€suffering.ððòò€€Myers€v.ÏPickering€Firm,€Inc.óó,€959€S.W.2d€152,€164€(Tenn.€Ct.€App.€1997)€(citing€òòHandley€v.€Mayóó,€588ÏS.W.2d€772,€776€(Tenn.€Ct.€App.€1979)).€€When€discussing€a€plaintiffððs€reaction€as€anger€ratherÏthan€anguish,€this€court€has€also€stated€that€ð ðmere€annoyance€or€loss€of€peace€of€mind,ðð€are€notÏenough€to€qualify€for€actual€damages.€€òòHandleyóó,€588€S.W.2d€at€777.€€ÌÌà àIn€òòMoore€v.€Baileyóó,€628€S.W.2d€431€(Tenn.€Ct.€App.€1981),€we€affirmed€a€jury€award€in€aÏdefamation€case.€€Where€the€plaintiff€presented€evidence€of€the€effects€of€the€defamatory€statements,Ïwhich€had€been€on„going€for€ten€(10)€years.€€The€plaintiff€in€that€case€stated€that€he€was€unable€toÏget€away€from€the€statements€made€by€the€defendant.€€The€plaintiff€was€even€approached€by€one€ofÏthe€defendantððs€employees€at€Army€Guard€camp,€which€caused€him€to€quit€the€Army€Guard.€€HeÏstated€that€it€was€in€his€mind€and€disturbed€his€mind€as€well€as€his€family.€€The€plaintiff€alsoÏtestified€that€the€statements€affected€the€performance€of€his€duties€because€it€was€always€on€hisÏmind.€€ÌÌà àIn€his€deposition,€the€appellant€stated€that€various€individuals€had€approached€himÏconcerning€the€commercials.€€He€stated€that€this€attention€embarrassed€him.€€He€also€stated€thatÏindividuals€from€church€told€the€parents€of€his€fiancee€at€the€time€that€they€should€keep€appellantÏaway€from€her.€€He€mentioned€that€he€was€embarrassed€for€his€parents,€his€wife,€and€his€in„laws.€ÏHowever,€the€damages€complained€of€by€the€appellant€never€rose€above€embarrassment€stemmingÏfrom€individual€encounters.€€He€also€stated€that€he€believed€he€had€not€been€invited€to€a€few€privateÏparties€due€to€the€advertisements.€€However,€he€did€not€present€proof€that€the€advertisements€wereÏthe€reason€he€was€not€invited.€€Appellant€did€mention€that€detectives€at€the€Sheriffððs€office€wouldÏnot€work€with€him€and€that€his€own€partner€had€left€the€department€due€in€part€to€the€allegations€onÏthe€advertisements.€€However,€appellantððs€position€as€a€deputy€had€not€been€affected.€€ÌÌà àThis€situation€is€not€the€same€as€inòò€Moore.óó€€In€òòMooreóó,€the€plaintiff€testified€that€theÏdefamatory€statements€were€constantly€with€him€in€his€day„to„day€life.€€Here€the€appellant€statedÏthat€various€people€asked€him€about€the€allegations,€but€he€did€not€state€that€the€questions€were€aÏconstant€presence€in€his€life.€€Also,€there€was€no€evidence€that€the€embarrassment€hampered€hisÏability€to€perform€his€job.€€This€evidence€does€not€rise€above€ð ðanger,€mere€annoyance€or€loss€ofÏpeace€of€mind.ðð€€Therefore,€we€find€no€proof€of€actual€damages.ÌÌà
