Ðhistory€that€might€shed€additional€light€on€the€ordinanceððs€purpose.Ð ¤ä Ðâ âÐ Ð Ðà  àWhen€Nolensvilleððs€Board€of€Mayor€and€Aldermen€enacted€this€ordinance,€it€was€exercisingÐ À Ðits€authority€to€promote€the€health,€safety,€and€welfare€of€the€townððs€residents.׃"×Ý ƒ #ÃÝòòÚ  Ú20Ú  ÚóóÝ  Ý×  ×€€In€addition€toÐ ¬ì Ðdefining€and€describing€the€undesirable€conduct,€the€ordinance€provided€thatÐ ˜Ø Ðâ âÌà8  àà8` Ð Ð à[v]iolations€of€this€chapter€shall€.€.€.€subject€the€offender€to€a€penaltyÐ p° Ðof€up€to€five€hundred€dollars€($500.00)€for€each€offense.€€Each€day€aÐ \œ Ðviolation€is€allowed€to€continue€shall€constitute€a€separate€offense.ÐH ˆ` x` x ÐÌWe€cannot€say€that€the€language€of€this€ordinance,€on€its€face,€requires€us€to€conclude€that€theÐ  ` Ðordinance€is€primarily€punitive.€€It€does€not€criminalize€violations,€and€it€contains€no€provision€forÐ  L  Ðincarceration.€€The€terms€ð ðviolation,ðð€ð ðoffender,ðð€and€ð ¼ü  Ðthe€Courtððs€admonition€against€erecting€obstacles€that€prevent€the€enactment€and€enforcement€ofÐ ¨è ÐWhile€the€total€amount€of€the€monetary€assessment€was€based€on€the€number€of€days€ofÐ h¨ Ðnoncompliance€by€Mr.€King,€its€total€amount€was€fixed,€and€it€did€not€provide€for€increasingÐ T ” Ðmonetary€assessment€for€each€day€Mr.€King€remained€in€non„compliance.Ð @!€  ÐÐ ,"l!
