àWe€must€first€state€that€contrary€to€Mr.€Nortonððs€contention,€theÏDepartment€was€not€required€to€grant€him€a€contested€case€hearing€in€response€to€hisÏapplication.€€Tenn.€Code€Ann.€ðð€4„5„223(a)€provides€that€upon€receiving€a€Petition€forÏa€Declaratory€Order,€filed€by€a€person€affected€by€a€statute,€rule€or€order€within€theÏprimary€jurisdiction€of€a€state€agency,€that€agency€has€two€alternative€courses€ofÏaction€available€to€it.€€It€may€either€convene€a€contested€case€hearing€and€issue€aÏdeclaratory€order€embodying€the€results€of€that€hearing,€or€it€may€refuse€to€issue€aÏdeclaratory€order.€€In€either€case,€the€petitioner€is€entitled€to€judicial€review€of€theÏagencyððs€action,€if€he€files€a€Petition€for€a€Declaratory€Judgment€within€the€allottedÏtime,€which€is€exactly€what€Mr.€Norton€did.ÌÌà àIt›€is€true€that€Section€(d)€of€the€above„mentioned€statute€prevents€theÏgovernor€from€using€the€administrative€procedures€established€by€the€PrisonÏOvercrowding€Act,€Tenn.€Code€Ann.€ðð€œ41„1„501,€et€seq.,›€to€release€certain€prisoners.€ÏHowever€the€powers€statutorily€conferred€upon€the€governor€by€the€PrisonÏOvercrowding€Act€are€entirely€separate€from,€and€are€in€addition€to,€his€generalÏconstitutional€power€to€commute€sentences.€€Just€as€the€legislature€is€not€barred€fromÏgranting€the€governor€such€additional€powers,€it€is€also€not€prevented€from€placingÐ Ðlimits€on€the€powers€it€grants.€€Mr.€Norton€still€has€the€right€to€ask€the€governor€forÏleniency,€and€we€believe€there€is€nothing€to€prevent€the€governor€from€granting€suchÏrelief,€if€he€so€wishes.ÌÌà@$êàò Ðthere€is€a€rational€basis€for€legislation€preventing€the€early€release€from€confinementÏof€individuals€who€have€been€convicted€of€child€rape,€and€who€are€guilty€of€victimizingÏsome€of€the€most€vulnerable€members€of€our€œsociety.›€€€€ÌÌà@……êàò òV.€€Cruel€and€Unusual€Punishmentó óˆÐ @  ÐÌà Ø àà 0 àMr.€Norton€claims€that€the€application€of€Tenn.€Code€Ann.€ðð€39„13„523Ïto€his€sentence€amounts€to€cruel€and€unusual€punishment,€because€the€amount€ofÏtime€he€will€be€have€to€serve€in€prison€is€disproportionate€to€the€severity€of€his€crime.ÌÌà àThe€trial€court€examined€his€twenty€year€sentence€in€light€of€his€crime,Ïand€concluded€that€the€sentence€was€not€grossly€disproportionate,€and€thus€did€notÏamount€to€cruel€and€unusual€punishment.€òòSeeóó€òòState€v.€Harrisóó,€844€S.W.2d€601Ð àWe€note€that€the€chancery€court€does€not€have€jurisdiction€to€review€theÏlength€of€Mr.€Nortonððs€sentence;€such€a€review€would€have€to€be€conducted€in€ourÏcourts€of€criminal€jurisdiction.€€The€only€question€under€review€is€the€application€ofÏTenn.€Code€Ann.€ðð€€39„13„523€to€that€sentence.€ÌÌà àThis€is€not€a€matter€of€first€impression.€€The€Court€of€Criminal€AppealsÏhas€dealt€with€the€same€question€in€a€case€similar€to€the€present€one.€€In€theÏunpublished€case€of€òòState€v.€Holderóó,€No.€01„C„01„9501„CC„00015€(filed€Nashville,Ð |8 26 ÐMarch€22,€1996),€the€defendant€was€accused€of€rape€of€a€child.€€The€evidenceÏshowed€that€Mr.€Holder€had€engaged€in€sexual€intercourse€and€other€sexual€activitiesÏwith€his€twelve€year€old€daughter.€€He€argued€that€the€activity€was€consensual,€butÏbecause€of€the€age€of€the€victim,€his€actions€constituted€rape€under€the€law.€€The€juryÏfound€him€guilty,€and€he€received€a€sentence€of€twenty„three€years.€€€€ÌÌà
