CertainofthechildrenandnextofkinofShermanOvertonappealajudgmentoftheProbateDivisionoftheGeneralSessionsCourtforScottCountywhichfirstdeniedtheirmotiontodismissthepetitionforprobatefiledbyBettyOverton,oneoftheirsiblings,onthegroundthatsuchanactionwasbarredbythestatuteoflimitations.TheProbateJudgethereafterfoundthatitwasappropriatetheestatebeprobated.HethengrantedlettersofadministrationtoSidneyR.Seals,alicensedattorney,who,accordingtotheTrialCourt,wasadisinterestedthirdparty.  ThisappealinsiststhattheCourtwasinerrorinnotsustainingitsmotion,whichwaspredicatedupontheprovisionsofT.C.A.301110(4)which,althoughrepealedbyChapter449ofthePublicActsof1993,wasinfullforceandeffectforafull10yearperiodafterMr.Overton'sdeath,andfurther,ifinfacttherepealedstatutewasnoteffectivetobarthisprobateproceeding,thesuitwasbarredbythecatchallprovisionsofT.C.A.283110(3).  TherecorddisclosesthatShermanOvertondiedintheyear1980andnopetitionseekingtoadministerhisestatewasfileduntilOctober17,1996,sometwoweeksafterthedeathofhiswidow,LauraOverton,onOctober8,1996.  TheTrialCourtinitsorderofprobateimpliedlyoverruledthemotiontodismiss.  Thefirststatuteraisedasadefense,T.C.A.301110(4)providesthefollowing:         301110.Timewithinwhichadministrationmaybegranted. Thetimewithinwhichadministrationmaybegrantedshallbeasfollows: .... (4)OTHERCASES. q   ׀Innoothercasesshalllettersofadministrationbegrantedwherethedeceaseddiedten(10)yearsbeforeapplicationmadeforthesame;andallsuchletterstestamentaryorofadministration,grantedafterthatperiod,shallbeutterlyvoidandofnoeffect.         TheAppellantsarguethat,asabovenoted,thestatutewasinfullforceandeffectfromthedateofMr.Overton'sdeathuntilrepealedsome13yearslater,andthatitwouldbeanunconstitutionalapplicationoftherepealingstatutetoholditinvalidunderthefactsofthiscase.ThisinsistenceisbaseduponthecontentionthattoaccordretrospectiveapplicationtothestatutewouldimpairtheAppellants'vestedrighttoassertthedefenseoftherepealedstatute.  Inourview,assetoutintheTrialJudge'smemorandumopinionhereinafterquoted,aprobateproceedingisauniqueoneandforthemostpartunadversarial,atleastintheinitialphaseofobtainingprobate.Forthatreasonwedeclinetoequateadaughter'srightnottohaveherfather'sestateprobatedwiththerightofawrongdoernottobesued.  T.C.A.283110(3)providesthefollowing:         283110.Actionsonpublicofficers'andfiduciarybondsActionsnototherwisecovered. τThefollowingactionsshallbecommencedwithinten(10)yearsafterthecauseofactionaccrued: .... (3)Allothercasesnotexpresslyprovidedfor.         WeconcurintheTrialJudge'streatmentoftheforegoingstatute.        ThattheCourt,toanunusualdegree,hasstruggledinreachingafinaldecisioninthismatter,itfranklybeingtroublingtotheCourttoopenupanestatemorethan16yearsafterthedecedent'sintestatedeathwhentherewouldinitiallyappeartobenocompellingreasonstodosowhicharebasedinfactandnotspeculation,andcoupledwiththelawbeingsomewhatunclearinthisarea;however,itappearingtotheCourt,thatin1993whentheGeneralAssemblydeletedSubsection(4)ofTennesseeCodeAnnotated301110(whichpreviouslyimposedastatuteoflimitationsexpresslyvoidingalllettersissuedmorethan10yearsafterthedecedent'sdeath),thatbyclearlegalimplication,thelegalmessagewasbeingsentthatsuchlettersissuemorethan10yearsafterthedecedent'sdeatharelegallypermissible,thethresholdlegalquestionthenbeingwhetherornotthe10year"catchall"statuteoflimitationsetforthinTennesseeCodeAnnotated283110(3)prohibitstheissueoflettersandestateadministrationinthiscause. ItbeingthefinalopinionoftheCourtthattheissueofletterstoadministeradecedent'sestateisauniqueproceedingtobedistinguishedfromthetypesofadversarialcausesofactionscontemplatedbyandaddressedinTennesseeCodeAnnotated283110,althoughotherspecifictypesofclaimsorsuits,whichmightderiveoutoforspringfromdiscoveryorotherlegalactivityoccurringwithintheframeworkofestateadministration,inthecourt'sopinion,couldpossiblybebarredbyTennesseeCodeAnnotated283110,estoppelorevenlaches,baseduponanadhocevaluationofeachsuchderivativecause.         Moreover,itwouldseemanomalousfortheLegislaturetointendtorepealtheprovisionsofT.C.A.301110(4)sotheexactstatutoryperiodofT.C.A.283110(3)wouldbecomeeffective.
