Ðher€husband,€Roy,€purchased€a€three„bedroom,€two„bath€home€at€2800€Noonan€Drive€in€DavidsonÐ À&"& ÐCounty€(the€ð ðPropertyðð)€in€1976.€€Although€they€eventually€paid€off€the€mortgage,€in€1989,€theyÐ ¬'ü"' Ðborrowed€approximately€$60,000€secured€by€another€mortgage.€€Ms.€Owen€used€$30,000€of€the€loanÐ ˜(è#( Ðproceeds€to€purchase€a€square€dance€apparel€business€called€the€Flutter€Wheel.€€Shortly€after€theÐ „)Ô$) Ðpurchase€of€Flutter€Wheel,€Roy€Owen€left€the€marital€home.€€Ms.€Owen€developed€physicalÐ p*À%*ýo ÐÔ_Ômaladies,€which€kept€her€from€working.€€Flutter€Wheel€was€not€profitable€and€Ms.€Owen€eventuallyÐ ° Ðstopped€paying€the€property€taxes€and€mortgage€payments€on€the€Property.€€When€the€mortgage„Ð œì Ðholder€threatened€to€foreclose,€Ms.€Owen€and€Roy€Owen€signed€a€contract€to€have€the€PropertyÐ ˆØ Ðauctioned.€€Ms.€Owenððs€son,€William€Martin€(ð ðMr.€Martin,ðð€or€ð ðAppellantðð)€offered€to€help€with€theÐ tÄ Ðmortgage€payments€and€Ms.€Owen€was€able€to€have€herself€released€from€the€contract€to€auction€theÐ `° ÐProperty.Ð L œ ÐÌà  àAlthough€Mr.€Martin€had€resided€in€Cincinnati€since€1988,€he€often€visited€Nashville€to€seeÐ $ t Ðhis€two€children.€€Mr.€Martin€planned€to€convert€the€area€over€the€garage€into€an€apartment€for€hisÐ  ` Ðuse€when€he€came€to€Nashville.€€After€discovering€that€Ms.€Owenððs€equity€in€the€house€exceededÐ ü L  Ðthe€mortgage€obligation,€Mr.€Martin€allowed€the€Property€to€go€into€foreclosure€and€then€purchasedÐ è 8  Ðit€himself€at€the€mortgage€sale.׃×Ý ƒ #ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€€Mr.€Martin€allowed€his€mother€to€continue€living€in€the€main€houseÐ Ô$  Ðbut€he€did€not€begin€renovations€on€the€garage.€€Ms.€Owen€used€the€area€for€storage,€includingÐ À  Ðstorage€for€the€Flutter€Wheel€inventory.€€Eventually,€Ms.€Owen€allowed€Mr.€Martin€to€sell€the€FlutterÐ ¬ü  ÐWheel€inventory€in€order€to€finance€some€repairs€to€the€Property.׃×Ý ƒ #ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×Ð ˜è  ÐÌà  àIn€1997,€Mr.€Martin€asked€Ms.€Owen€to€begin€making€the€monthly€payments€on€theÐ pÀ Ðmortgage.€€She€refused.€€The€matter€escalated€until€Mr.€Martin€sent€Ms.€Owen€a€letter€giving€her€theÐ \¬ Ðoption€of€paying€$250€per€month€in€rent,€or€vacating€the€house€so€that€he€could€sell€it.€€Ms.€OwenÐ H˜ Ðfailed€to€respond€to€this€letter.Ð 4„ ÐÌà  àOn€January€31,€1998,€Mr.€Martin€filed€a€detainer€warrant€against€Ms.€Owen€in€the€DavidsonÐ  \ ÐCounty€General€Sessions€Court.€€Ms.€Owen€responded€on€February€6,€1998€with€a€Complaint€inÐ øH ÐChancery€Court.€€Ms.€Owenððs€Complaint€prayed€for€a€temporary€restraining€order€to€prevent€Mr.Ð ä4 ÐMartin€from€evicting€her.€€She€also€asked€the€court€to€declare€a€constructive€or€resulting€trust€on€theÐ Ð  Ðproperty€in€her€favor€or,€in€the€alternative,€that€the€property€be€sold€and€that€she€receive€all€of€theÐ ¼  Ðequity€plus€approximately€$23,000€for€the€value€of€the€Flutter€Wheel€inventory.Ð ¨ø ÐÌà
