\  hadtheopportunitytoexamineMs.Perkins.Ms.KathyBrownrepresentedtheemployerattheJune26thhearing.Becauseoftimeconstraints,Ms.Perkinsattorneydidnothavethe  ` opportunitytocrossexamineMs.Brown.TheemployerdidnotappearattheAugust28,1997,hearing,pursuanttoasettlementagreementbetweenMs.Perkinsandtheemployer,whichhadbeenreachedpriortotheAugust28thhearing.^li K   1      ׀SinceMs.Perkinscounselhadnoopportunity   tocrossexamineMs._BrownduringtheJune26thhearing,andshedidnotappearattheAugust l hearing,theappealsrefereestuckMs.Brownstestimony.   ` OnSeptember4,1997,theappealstribunalsetasidetheTennesseeDepartmentofEmploymentSecuritysdecisionandapprovedMs.Perkinsunemploymentcompensationclaim.   ` TheemployersoughtanappealonSeptember15,1997,totheTennesseeDepartmentofEmploymentSecurityBoardofReview.Afterreviewingtherecord,theBoardofReviewreversedthedecisionoftheappealstribunal.TheBoardofReviewmadethefollowingfindingsofFactandConclusionsofLaw. FindingsofFact:TheclaimantsmostrecentemploymentpriortofilingthisclaimwasasaqualitycontrolsupervisorforSportsBelle,Knoxville,Tennessee,fromMarch28,1984,untilApril18,1997,whenshevoluntarilyquit.Shefeltthatshewasoverworkedandnotadequatelycompensatedforovertime.Infact,shewaspaidforworkperformedafterregularworkinghours.Inaddition,theemployerofferedherotherjobassignmentswhichsherefused.Shethenquitheremployment. ConclusionsofLaw:Aftercarefullyconsideringtheentirerecordinthscase,theBoardofReviewfindsthattheclaimantleftheremploymentvoluntarilyandwithoutgoodcauseconnectedwithworkunderT.C.A.507303(a)(1).Theclaimantwas dissatisfiedwithherworkassignmentbutrefusedotherjobassignmentsfromtheemployerwhichtheemployerofferedaftertheclaimanthadexpressedherdissatisfaction.Itappearsthattheclaimantisnolongeremployedbecauseofherownactionsandthatworkwasavailableforher. 4%ԀabuseditsdiscretionbyreversingthedecisionoftheAppealstribunaleventhoughnocompetenttestimonyagainstthetestimonyofthePetitionerwasavailable.Additionally,shearguedthatthefindingsoffactandconclusionsoflawarenotsupportedbysubstantialandmaterialevidenceinlightoftheentirerecord.Shewasconstructivelydischargedfromheremployment,becauseshewasdeniedcompensationandbenefitsproportionatetoherresponsibilitiescomparedtootherswhohadsimilarpositions.
