GaryW.PhelpsiscurrentlyincarceratedatTurneyCenterservingtwoconsecutivesentencesforsexcrimes.HewasaffordedaparolehearingonFebruary14,1995,andattheconclusionofthehearing,thehearingofficerrecommendedthatMr.Phelpsshouldnotbeparoledbecauseoftheseriousnessofhisoffensesandbecausehehadnotcompletedaprogramforsexoffenders. 6   ׀BetweenFebruary16and23,1995,fourmembersoftheBoardapprovedthehearingofficersrecommendation,andMr.PhelpswasinformedoftheBoardsdecisioninaletterdatedFebruary28,1995. OnMarch20,1995,Mr.PhelpsrequestedthatthefullBoardreviewthehearingofficersdecision.OnApril25,1995,theBoardnotifiedMr.Phelpsthathisrequestforreviewhadbeendenied.Mr.PhelpsreceivedthisnoticeonApril28,1995andfiledapetitionforwritofcertiorariintheChanceryCourtforDavidsonCountyon d  8 June23,1995.ThetrialcourtdismissedthepetitionafterconcludingthatMr.PhelpshadnotfileditbeforethedeadlineprescribedbyTenn.CodeAnn.279102.@ II.  ThisappealrequiresustodeterminewhenthetimeforfilingapetitionforwritofcertioraritoreviewtheBoardofParolesdenialofparolebeginstorun.Thisissuehasbeenraisedinpriorcases,butwehaveneverdecidedthequestionbecausethosecasesweredisposedofonothergrounds. 7   ׀Specifically,wemustdeterminewhetherthesixtydayfilingperiodrequiredbyTenn.CodeAnn.279102commenceswhenapaneloftheBoardfirstdeniesparoleorwhenthefullBoarddeniestheprisonerstimelyapplication 8   ׀forappellatereview.ThisisapivotalissueinmanyofthesecasesbecausethesixtydayfilingperiodinTenn.CodeAnn.279102ismandatoryandjurisdictional.See_Thandiwe_Ԁv._Traughber_,909S.W.2d802,804(Tenn.Ct.App.1994).@ A.  Prisonersdonothavearighttobereleasedonparole.SeeGrahamv.State,202Tenn.423,426,304S.W.2d622,623(1957);Tenn.CodeAnn.4028117(a)(1997).ThedecisiontoreleaseaprisoneronparoleiswithintheBoardofParolesdiscretion.Stateexrel._Ivey_Ԁv.Meadows,216Tenn.678,685,393S.W.2d744,747(1965);Doylev.Hampton,207Tenn.399,403,340S.W.2d891,893(1960).TheDepartmentofCorrectionisresponsiblefordeterminingwhenaprisonerbecomeseligibleforparoleconsideration,seeTenn.CodeAnn.4028116&4028129(1997),andthisdecisionisbasedprimarilyontheportionofthesentencetheprisonerhasservedandonthesentencecreditstheprisonerhasearned.SeeTenn.CodeAnn.4028115(1997);Tenn.Comp.R.&Regs.r.110011.07(1)(a)(1995).    Afterbecomingeligibleforparoleconsideration,aprisonerisaffordedahearingbeforeeitherahearingofficerorapaneloftheBoard.ThesehearingsmustbeconductedinaccordancewiththeOpenParolesHearingAct.SeeTenn.CodeAnn.4028501through505(1997).Prisonersmaybepermittedtobepresentduringthedeliberationsfollowingthehearing,seeTenn.Comp.R.&Regs.r.110011.07(3)(a),butinanyeventtheyareentitledtobeinformedofthedecision assoonasitismade.SeeTenn.Comp.R.&Regs.r.110011.07(3)(b). Ifaparolehearingisconductedbyahearingofficer,thehearingofficersdecisionisadvisoryonlyandmustbeeitheraccepted,modified,orrejectedbyamajorityofthemembersoftheBoard.SeeTenn.Comp.R.&Regs.r.110011.07(2)(a).AftertheBoardhasactedonthehearingofficersrecommendations,inmateshavetherighttoappealtotheBoardforfurtherconsiderationonthreegrounds.WrittenrequestsforthisappellatereviewmustbereceivedbytheBoardwithintwentyonedaysaftertheBoardsfinaldisposition ismadeavailabletotheinmate. 9   ׀ThedecisionconcerningwhethertograntortodenytheappealisdiscretionarywiththeBoard.@ B.  ThetrialcourtdidnotexplainthefactualbasisforitsdeterminationthatMr.PhelpsspetitionforcommonlawwritofcertiorarihadnotbeenfiledwithinthetimerequiredbyTenn.CodeAnn.279102.Wemayassume,however,thatthetrialcourtmusthavedeterminedthattherunningofthefilingperiodinTenn.CodeAnn.279102wasnottolledwhiletheBoardwasconsideringMr._Phelps_srequestforappellatereviewoftheBoardsdecisionannouncedinitsFebruary28,1995letter.Indeed,theBoardassertsinitsbriefthatthefilingperiodbegantorunonFebruary28,1995andthatthereisnootherpossibledatebecausetheBoarddoesnothavetheauthoritytoextendthefilingdeadlineinTenn.CodeAnn.279102.WecertainlyagreethattheBoarddoesnothavetheauthoritytoextendastatutoryfilingdeadline;however,identifyingthecorrectdatewhenthefilingperiodbeginstorunisanothermatter. Commonlawwritsofcertiorariareextraordinaryremedies.See_Clark_Ԁv.Metropolitan_Govt_ԀofNashvilleandDavidsonCounty,827S.W.2d312,316(Tenn.Ct.App.1991).Inthepropercircumstances,thecourtsmaygrantthesewritstoreviewdecisionsthatarenotfinal.SeeBoycev.Williams,215Tenn.704,713,389S.W.2d272,276(1965);_Hewgley_Ԁv.Trice,207Tenn.466,472,340S.W.2d918,921(1961).However,thecourtsshoulddeclinetograntwritsofcertiorariifthereareotherplain,adequate,andspeedyremediesavailabletothepersonseekingthewrit.Packv.RoyalGlobeIns.Co.,224Tenn.452,465,457S.W.2d19,24(1970);_McGee_Ԁv.State,207Tenn.431,434,340S.W.2d904,90506(1960). Tenn.CodeAnn.279102requiresapetitionforcommonlawwritofcertioraritobefiled withinsixty(60)daysfromtheentryoftheorderorjudgment.InthecontextofreviewingdecisionsoftheBoardtodenyparole,Tenn.CodeAnn.279102shouldbeconstruedtorefertothefinaldecisionthatfullyandfinallyresolvesalltheclaimswithnooptionforfurtheradministrativeremedies.AnyotherinterpretationofTenn.CodeAnn.279102wouldrequirethecourtstobecomeenmeshedintheBoardsproceedingsprematurelyandwouldalsodevaluetheadministrativeremediesstillavailabletotheprisonersseekingthewrit.TheBoardsownproceduresthatpermitappellatereviewbythefullBoardprovideprisonerswithaplain,adequate,andspeedyremedythatshouldnotbecircumvented. Accordingly,wehavedeterminedthatthetimeforfilingacommonlawwritofcertioraritoreviewdecisionsoftheBoardofParolesshouldbegintoruneitherwhenamajorityofthemembersoftheboardrendertheirdecisionor,iftheprisonerhasfiledatimelyrequestforappellatereviewbytheBoard,fromthedatethefullBoardactsontheprisonersrequest.ThisinterpretationofTenn.CodeAnn.279102isconsistentwithourinterpretationofTenn.R.App.P.4(b)regardingthefilingofnoticesofappealandTenn.CodeAnn.45322(b)(1)(Supp.1997)regardingthefilingofpetitionsforjudicialreviewofadministrativedecisions.@ III.
