PlaintifffiledsuitonFebruary12,1999inDavidsonCountyGeneralSessionsCourtfor t paymentofattorneysfeestotaling$897.50.ServiceofprocesswasobtainedonFebruary19,2000; ` adefaultjudgmentfor$879.50wasenteredagainstDefendantonJune4,1999.Defendantdidnot L  appealthedefaultjudgment.Eightmonthslater,onFebruary10,2000,AppellantfiledaRule60.02 8  MotiontoVacateDefaultJudgment,AnswerandCounterClaim,andAffidavitinsupportthereof $ t ingeneralsessionscourt.TheMotiontoVacatewasdenied.Defendantthenappealedthisdenial  ` toDavidsonCountyCircuitCourtbutfailedtoobtainatrialdatewithin45daysasrequiredbyLocal  L  Rule20(b).ThecircuitcourtdismissedDefendantsappeal.DefendantthenfiledaMotionto  8  ReinstateandaMotiontoSet.TheseMotionsweredenied.Thisappealfollowed.  $   (5h83! !   DefendantarguedonappealthatthejudgeabusedherdiscretioninfailingtogranthisMotion   toReinstateandthathisdueprocessrightswereviolated.ThecourtfindsDefendantsarguments   tobewithoutanymeritwhatsoever.      Defendant,allegeshimselftobeanattorneylicensedtopracticelawinthestateofNew \ Jersey,wasservedwithprocessandfailedtotakeanyactionregardingthematter.Evenaftera H defaultjudgmentwasentered,Defendantfailedtotakeanyactionforanother8months,atwhich 4 timehefiledaRule60.02MotiontoVacate.Noappealwaseverfiledfromtheactualdefault  p judgment.Assuch,thiscasecouldnothaverightfullybeenbeforethecircuitcourt.Thetimefor  \ appealhadrun,andRule1oftheTennesseeRulesofCivilProcedurespecificallystates, These H rulesshallnotbeapplicabletocourtsofgeneralsession.Thus,theRule60.02motionwas 4 improper.     However,thisissuewasneverdealtwithbythecircuitcourt,asDefendant,onceagain,failed  tofollowcourtrulesanddidnotfileamotiontosetwithing45dayspursuanttoLocalRule20(b).
