ðdecedentðð)€and€Palma€DianeÏHarrison€(ð ðappelleeðð)€entered€into€a€Marital€Dissolution€Agreement€on€June€27,€1994.€ÏœThe›€divorce€was€granted€on€September€12,€1994,€and€the€final€decree€of€divorceÏincorporated€the€Marital€Dissolution€Agreement€therein.€€œIn›€pertinent€part,€the€MaritalÏDissolution€Agreement€provided:ÌÓÓà8 à11.€€All€parties€agree€to€execute€any€document€which€mayÏbe€or€become€necessary€to€effectuate€this€agreement,Ïincluding€but€not€limited€to€Quitclaim€Deeds€and€Titles.ÌÌÌÓÓà àœ›à àThereafter,€on€November€23,€1994,€decedent€and€appellee€came€to€theÏlaw€offices€of€James€Bradberry€wherein€Beverly€Skoda€was€employed.€€œDecedent›Ïrequested€that€Mrs.€Skoda€prepare€a€deed€of€trust€on€the€property€that€was€formerlyÏthe€residence€of€appellee€and€himself.€€œHe›€wanted€the€trust€deed€to€be€given€asÏsecurity€for€a€bond€which€he€desired€to€have€created.€€œHe›€importuned€Mrs.€Skoda€toÏrun€a€title€search€in€preparation€of€drafting€the€deed€of€trust.€€œAfter›€running€the€titleÏsearch,€Mrs.€Skoda€learned€that€the€property€in€question€was€titled€in€the€names€ofÏboth€appellee€and€decedent.€€œAfter›€further€reviewing€the€Chancery€Court€recordsÏpertaining€to€appellee€and€decedentððs€divorce,€Mrs.€Skoda€advised€Mr.€Harrison€of€hisÏright€to€have€appellee€quitclaim€her€interest€in€the€subject€property€over€to€him.€€œIn›Ïresponse€to€Mrs.€Skodaððs€admonition,€decedent€€insisted€things€were,€indeed,€just€howÏhe€wanted€them€to€be€and€that€he€wanted€nothing€changed.€€That€same€day,€the€trustÏdeed€was€executed€by€both€appellee€and€decedent.€Ì€Ìà àSome€time€later,€decedent€discovered€that€he€was€terminally€ill€with€cancer.€ÏFollowing€this€discovery,€decedent€had€several€conversations€with€family€membersÏand€€other€acquaintances€in€which€he€communicated€that€he€had€everything€just€theÏway€he€wanted€it€and€desired€no€changes€since€appellee€had€worked€for€the€subjectÏproperty€just€œas€he›€œhad.›€€In€addition€to€Mrs.€Skoda,€decedent€had€these€conversationsÏwith€his€brother,€Walter€Harrison;€his€sister„in„law,€Fay€Darnell;€his€sister„in„law€PatÏHarrison;€and€Jane€Dublin.€Ìà àÌà àNo€deeds€were€ever€prepared€which€indicated€a€transfer€of€the€interest€ofÏappellee€in€the€subject€property€to€decedent.€€Decedent€died€on€February€16,€1995.€ÌÌà àDecedentððs€estate€was€probated€and€Marie€Puckett,€daughter€of€decedent,€wasÏappointed€as€Administratrix.€€œOn›€January€25,€1996,€a€petition€was€filed€by€theÏAdministratrix€to€order€appellee€to€comply€with€the€provision€in€the€Marital€DissolutionÏAgreement€or€to€hold€her€in€contempt.€€œJoining›€in€this€petition€was€Robert€RonaldÏHarrison,€James€E.€Harrison,€Trina€Mansfield,€Relma€Kesterson,€Stephen€Harrison,ÏNellie€Cook,€and€Joseph€Harrison.€€œAn›€answer€to€this€petition€was€filed€by€appellee€onÏFebruary€23,€1996.€€This€matter€came€to€trial€on€February€5,€1997.€€œFinal›€judgment€inÏthis€matter€was€entered€on€March€26,€1997,€wherein€the€trial€court€found€œfrom€the€proofÏthat€decedent€had€reached€a€decision€on€his€own€or€with€appellee€that€he€would€notÏenforce€his€right€to€receive€a€quitclaim€deed€from€appellee€to€the€subject€property.€ÏThus,€the€trial€court€ruled€that€decedent€and€appellee€now€held€the€property€as€tenantsÍin€common.›€€Particularly,€the€trial€court€found€that€without€the€execution€of€a€quitclaimÏdeed€transferring€the€said€interest€of€appellee€to€decedent,€appellee€remained€one„half€owner€of€said€property.€€€€ÌÌà àOn€appeal,€appellants€œraise›€two€issues€for€review€by€this€court:ÌÓÓà8 àà8 à1.€€Whether€the€property€division€provisions€of€a€divorceÏdecree€as€incorporated€via€a€Marital€Dissolution€AgreementÏcan€be€modified€by€the€original€parties?ÌÌà8 àà8 à2.€€Whether€the€Statute€of€Frauds€œapplies›€to€the€introductionÏof€evidence€claiming€a€gift€or€other€oral€disposition€of€realÏestate?ÌÌÌÌÓÓà àInasmuch€as€this€case€was€tried€by€the€trial€court€sitting€without€a€jury,€thisÏCourtððs€review€on€appeal€is€governed€by€Tennessee€Rule€of€Appellate€ProcedureÏ13(d),€which€directs€us€to€review€the€case€òòde€novoóó.€€òòRoberts€v.€Robertson€County€Bd.€ofÏEduc.óó,€692€S.W.2d€863,€865€(Tenn.€Ct.€App.€1985);€òòHaverlah€v.€Memphis€Aviation,€Inc.óó,Ï674€S.W.2d€297,€300€(Tenn.€Ct.€App.€œ1984).›€œIn›€conducting€a€òòde€novoóó€review€of€theÏrecord€below,€however,€this€Court€must€presume€that€the€trial€courtððs€findings€of€factÏare€correct.€€Under€this€standard€of€review,€we€must€affirm€the€trial€courtððs€decisionÏunless€the€trial€court€committed€an€error€of€law€affecting€the€result€or€unless€theÏevidence€preponderates€against€the€trial€courtððs€findings.€€òòRobertsóó,€692€S.W.2d€at€865.€€€ÌÌà àœAppellants€›make€two€arguments€against€the€judgment€of€the€trial€court:€first,€thatÏa€property€division€provision€of€a€divorce€decree€cannot€be€modified€by€the€originalÏparties,€and€second,€that€the€Statute€of€Frauds€applies€to€the€introduction€of€evidenceÍclaiming€a€gift€or€other€oral€disposition€of€real€estate.€€We€find€that€both€arguments€lackÏsubstantial€merit.ÌÌà àThe€primary€cause€of€the€present€dispute€is€the€Harrisonsðð€uncounseledÏœdecision›€to€ignore€their€property€settlement€agreement€in€their€MDA.€€After€theirÏdivorce,€they€took€it€upon€themselves€to€depart€from€their€original€agreement€that€hadÏbeen€approved€by€the€trial€court.€€Ìà àÌà àA€œmarital›€dissolution€agreement,€is€essentially€contractual.€€It€is€not€binding€onÏthe€court.€€€òòAlden€v.€Presleyóó,€637€S.W.2d€862,€864€(Tenn.€1982);€€òòYouree€v.€Youreeóó,Ï217€Tenn.€53,€58,€394€S.W.2d€869,€871€(1965).€€However,€it€loses€its€contractualÏcharacter€and€becomes€binding€on€the€parties€once€the€trial€court€approves€it€andÏincorporates€it€into€a€final€decree.€€€òòPenland€v.€Penlandóó,€521€S.W.2d€222,€224€(Tenn.Ï1975);€òòGaines€v.€Gainesóó,€599€S.W.2d€561,€565€(Tenn.€Ct.€App.€1980).€€A€final€decreeÏembodying€a€property€settlement€agreement€must€be€respected€and€followed€like€anyÏother€court€order.ÌÌà àParties€who€ignore€their€court„approved€property€settlement€agreement€do€œso€at›Ïtheir€peril.€€An€individual€party€who€unilaterally€chooses€to€ignore€the€agreement€mayÏbe€held€in€contempt.€€When€both€parties€ignore€their€property€settlement€agreement,Ïthe€courts€will€reorder€their€rights€and€obligations€in€light€of€both€the€terms€of€theirÏoriginal€agreement€and€their€post„divorce€agreements€or€conduct.€€òòSee€Mitchell€v.ÏMitchellóó,€1993€WL€33765€(Tenn.€Ct.€App.€Feb.€10,€1993).€€ÌÌà àHere,€the€trial€court€had€multiple€witnesses€before€it€testifying€that€decedentÏœappellee›€had€œdecided€to€forego›€the€property€settlement€provisions€œin›€the€MDA€andÏallow€appellee€to€retain€her€one„half€interest€œin€the€subject€property.›ÌÌà àParticularly,€Mrs.€Beverly€Skoda€testified€that€decedent€and€appellee€came€intoÏher€office€wherein€the€following€conversation€took€place:ÌÓÓà8 àà8 àI€reminded€him€that€the€quitclaim€deeds€from€Diane€had€notÏbeen€done€and€that€both€their€names,€were,€in€effect,€on€aÏdeed,€that€they€owned€it€together,€and€I€told€him€I€couldÏprepare€those€if€he€would€like€to€while€we€were€waiting€forÏMrs.€Harrison€to€come,€and€he€said,€ð ðNo,€itððs€just€like€I€wantÏit.€€I€donððt€want€anything€changed.ððÌÌÌÌÓÓà àWalter€Harrison,€brother€of€decedent€testified€in€pertinent€part:ÌÓÓà8 àà8 àQ.€€And€what€statements€did€Mr.€Harrison€make€to€you€aboutÏthe€property€and€the€status€of€the€property€at€that€time?Ìà8 àà8 àÌà8 àà8 àA.€€We€talked€about€it€two€or€three€different€times.€€An€heÏwould€just€tell€me,€you€know,€that€he€had€everything€fixedÏjust€the€way€he€wanted€it€and€said€Diane,€said,€she„„well,Ïshe„„she€worked€for€it€and€helped€pay€for€everything€justÏlike€I€did€and€it€was€hers€as€much€as€it€was€mine.ÌÌÌÌÓÓà àPat€Harrison,€sister„in„law€of€decedent,€testified€that€decedent€stated€to€her€thatÏhe€had€everything€just€how€he€wanted€it.ÌÌà àFay€Darnell,€sister€of€appellee,€testified€that€in€part:ÌÓÓà8 àà8 àQ.€€Did€you€and€Mr.€Harrison€have€any€conversations€aboutÏthe€real€property€that€was€owned€by€Mr.€Harrison?ÌÌà8 àà8 àA.€€Yes.ÌÌà8 àà8 àQ.€€And€would€you€relate€what€that€conversation€was?ÌÌà8 àà8 àA.€€I€said€something€about€I€guess€yððall€will€be€splitting€upÏœyour›€property€now.€€And€he€said,€ð ðNo,ðð€said,€ð ðIððm€going€toÏkeep€it€sitting„„I€want€it€left€just€like€it€is.ððÌÌÌÌÓÓà àJane€Dublin,€relative€of€appellee,€attended€church€with€decedent.€€She€testifiedÏin€part€as€follows:ÌÓÓà8 àà8 àQ.€€And€did€you€have€an€opportunity€to€visit€with€her€formerÏhusband,€Robert€Harrison,€prior€to€his€death?ÌÌà8 àà8 àA.€€Yes,€I€did.€€We€were€close.€€We€attended€churchÏtogether.ÌÌà8 àà8 àQ.€€Okay.€€Did€you€have€conversations€with€Mr.€HarrisonÏabout€the€property€that€he€owned?ÌÌà8 àà8 àA.€€To€the€point€of€I€asked€him€did€he€have€everything€likeÏhe€wanted€it€stating€about€the€house€and€everything.€€AndÏhe€said,€yes,€he€did€have€it€fixed€like€he€wanted€it.ÌÌà8 àà8 àQ.€€Did€you€know€what€he€meant€when€he€said€fixed€like€heÏwanted€it?€€Do€you€know€what€the€status€of€the€property€wasÏat€that€time?ÌÌà8 àà8 àA.€€Yeah.€€I€understand€that€the€deed€was€still€in€his€nameÏand€in€Dianeððs€name,€and€he€stated€that€she€had€workedÏand€helped€pay€for€it.ÌÌÌÓÓœà àOn›€appeal€from€a€judgment€rendered€by€a€court€without€a€jury,€any€conflict€inÏtestimony€requiring€a€determination€of€the€credibility€of€witnesses€is€for€the€trial€court,Ïand€this€determination€is€accorded€great€weight€by€this€Court€unless€other€realÍevidence€compels€a€contrary€conclusion.€€òòLinder€v.€Littleóó,€490€S.W.2d€717€(Tenn.€Ct.ÏApp.€1972);€€òòSee€also€Duncan€v.€Duncanóó,€686€S.W.2d€568€(Tenn.€Ct.€App.€1985);òòÏHaverlah€v.€Memphis€Aviation,€Inc.óó,€674€S.W.2d€297€(Tenn.€Ct.€App.€1984).€€TheÏfindings€of€the€trial€court€in€a€non„jury€case€are€entitled€to€great€weight€where€the€trialÏcourt€saw€and€heard€the€witnesses€and€observed€their€manner€and€demeanor€on€theÏstand€and€was€therefore€in€a€much€better€position€than€the€appellate€court€to€judge€theÏweight€and€value€of€their€testimony.òò€€Smith€v.€Hooperóó,€œ59€Tenn.€›App.€167,€438€S.W.2dÏ765€(Tenn.€Ct.€App.€1968);€òòDuncan€v.€Duncanóó,€686€S.W.2d€568€(Tenn.€Ct.€App.€1985).ÌÌà àWe€recognize€that€the€evidence€concerning€whether€decedent€œdecided€toÏforego€certain€provisions€in€the€MDA€thereby€waiving€his€right€to€have€appelleeÏquitclaim€her€intererst€in€their€marital€residence€was›€disputed€at€trial.€€These€conflictsÏrequired€the€trial€judge€to€evaluate€the€credibility€of€the€witnesses€who€appearedÏbefore€him.€€He€resolved€these€credibility€issues€in€favor€of€appellee.€€Not€having€seenÏthese€witnesses€in€person,€we€are€not€in€a€position€to€say€that€he€was€wrong€in€hisÏassessment€of€the€witnesses'€credibility.€€Considering€the€importance€of€credibility€inÏthis€case,€we€cannot€say€that€the€evidence€preponderates€against€the€trial€court'sÏfindings€of€fact€supporting€its€conclusion€that€œboth€decedent€and€appellee€ignored€theÏprovisions€of€the€MDA€which€resulted€in€decedent€surrendering€his€rights€to€haveÏappellee€transfer€to€him€her€interest€in€the€subject€property€thereby€allowing€the€statusÏof€the€property€to€remain€unchanged.€€The€trial€court€correctly€reordered€decedent€andÏappelleeððs€rights€under€the€MDA€in€light€of€their€conduct€and€the€testimony€ofÏnumerous€witnesses.€€›ÌÌà àœAppellants€further€contend€that€even›€if€there€was€an€attempt€€œbilaterally€to›€modifyÏthis€MDA,€œthis›€agreement€violates€the€Statute€of€Frauds€as€codified€in€Tenn.€Code€Ann.Ïðð€29„2„101€which€states:ÌÓÓà8 àà8 à(a)€No€action€shall€be€brought:Ìà8 àà8 àà8
