ÐÌà  àUnder€these€statutes,€the€trial€court€is€required€to€determine€whether€the€parents€have€equalÐ ô$D # Ðtime€with€the€child€or€not€(subsection€(c)).€€If€so,€the€trial€court€should€then€conduct€a€best€interestÐ à%0!$ Ðanalysis€to€determine€whether€to€allow€relocation.€€If€the€trial€court€determines€that€the€parents€doÐ Ì&"% Ðnot€have€equal€time€with€the€child,€then€the€trial€court€should€allow€the€relocation€unless€one€of€threeÐ ¸'#& Ðconditions€are€met€(subsection€(d)).€€If€the€trial€court€finds€one€of€these€three€conditions,€the€trialÐ ¤(ô#' Ðcourt€must€then€move€to€a€best€interest€analysis€(subsection€(e)).€€If,€standing€alone,€it€is€not€in€theÐ )à$( Ðbest€interest€of€the€child€to€move€despite€a€finding€of€one€of€the€subsection€(d)€factors,€then€the€courtÐ |*Ì%) Ðmust€make€a€fresh€custody€determination€using€the€factors€in€subsection€(e).Ð h+¸&* ЇÓ  Óò òIII.Ð ° Ðòòó óóóÓÉ:Óà  àÌò òó óà  àThe€record€shows€that€the€parties€were€not€spending€substantially€equal€intervals€of€time€withÐ ˆØ Ðthe€child.€€Mother€had€primary€custody€during€the€school€year.€€That€fact€required€the€court€to€moveÐ tÄ Ðto€subsection€(d)€and€the€court€did€find€that€the€relocation€did€not€have€a€reasonable€purpose.€€If€itÐ `° Ðwas€not€in€the€best€interest€of€the€child€to€relocate,€then€the€court€should€have€considered€changingÐ L œ Ðcustody,€basing€its€analysis€on€the€factors€in€subsection€(e).€€This€is€the€step€that€the€trial€court€leftÐ 8 ˆ Ðout.Ð $ t ÐÌà  àThe€trial€court€was€primarily€concerned€with€whether€a€change€of€circumstances€hadÐ ü L  Ðoccurred.€€Under€this€statute€that€question€does€not€arise.€€The€legislature€probably€assumed€that€anÐ è 8  Ðattempt€by€the€custodial€parent€to€relocate€to€a€point€more€than€100€miles€away€was€in€itself€a€changeÐ Ô$  Ðof€circumstances.€€But€passing€on€to€the€merits,€the€only€findings€in€the€record€that€relate€to€the€bestÐ À  Ðinterests€of€the€child€Ô_ÔareÔ_ÔÔ_Ô:Ô_ÔÐ ¬ü  Ðà8  àÐ Ð Ð  Ðà8  àà ` à€The€intent€of€the€legislature€ð!ð€I€wish€I€had€the€act€here€because€I€would€likeÐ „Ô  Ðfor€both€of€those€parents€to€hear€what€the€legislature€said€in€its€preamble€to€that€actÐ pÀ Ðabout€what€children€need,€what€the€child€needs,€but€I€donððt€have€it.€€And€I€donððt€thinkÐ \¬ Ðthat€the€child€needs€to€be€traveling€any€10,800€miles€per€year.ÐH˜Ð Ð  ÐÌà8  àà ` àFrom€the€preamble,€the€Court€understands€that€the€proper€perspective€forÐ  p Ðdetermining€who€gets€what€share€of€the€childððs€time,€the€perspective€is€whatððs€for€theÐ  \ Ðchildððs€best€interest,€what€would€work€best€for€the€child,€regardless€of€whether€itÐ øH Ðworks€best€for€mom€or€dad€or€either€or€both.€€And€itððs€the€Courtððs€opinion,Ð ä4 Ðcomparing€these€two€shared€parenting€plans,€that€the€fatherððs€shared€pertaining€[sic]Ð Ð  Ðplan€is€for€the€best€interest€of€the€child.м Ð Ð  ÐÌà8  àà ` àWhatððs€more,€the€Court€finds€that€the€fatherððs€shared€parenting€plan€moreÐ ”ä Ðparallels€ð!ð€and€I€think€thatððs€the€bottom€line€here€ð!ð€the€fatherððs€shared€parenting€planÐ €Ð Ðmore€parallels€the€partiesðð€own€marital€dissolution€agreement€executed€in€1996.€€AndÐ l¼ Ðthe€Court€has€no€reason€not€to€continue€that€intention€of€these€two€parties€to€giveÐ X ¨ Ðeach€other€equal€time€and€responsibility€with€and€for€the€minor€child.ÐD!”Ð Ð  ÐÌThis€is€the€extent€of€the€trial€courtððs€best€interest€analysis.€€The€trial€court€merely€mentions€theÐ #l!
