KathyL.Mabry,theformerwifeoftherespondent,DavisA.Reed,filedapetitionagainstherexhusbandseekingϜadditionalchildsupport.Withoutstatingitsreasonsfordoingso,thetrialcourtenteredanorderdismissingthepetition.Ms.ϜMabryappealed.Shearguestwopoints:first,thatthetrialcourterredinbasingitsrefusaltoawardadditionalchildsupportonthefactthatMs.Mabrybankruptedanobligationuponwhichsheandherformerhusbandwerejointlyobligated,thusnecessitatingthelatterspaymentofthedebt;andsecond,thatthetrialcourterredinrefusingtoincreaseMr.Reedschildsupportobligationinlightofanincreaseinhisincomeandhisfailuretoexercisevisitation.  Ms.MabryspetitionwasbeforethetrialcourtonJune12,1997.Therecordbeforeusincludesa22pagetranscriptofϜthathearing.Thattranscriptcontainsthestatementsandargumentofcounselforthepartiesregardingtheirrespectivepositions.Italsocontainscommentsofthetrialcourt.Whatitdoesnotcontainisthetestimonyofanywitnessesorastipulationoffacts.Furthermore,liketheorderofdismissal,thetranscriptdoesnotcontainanyoralcommentsbythetrialjudgeastohisreasonsfordismissingthepetition.Infact,thetranscriptfailstoreflectthatthehearingwasevercompleted.Thelast13linesofthetranscriptareasfollows: 8 THECOURT:Whydontyoutakeaminuteandshowhimwhatyouvegot.Andthenafteryoualllookatit,bringtheminhere,andletmeseethem.Imgoingtoconsiderthat.Imeanifhepaid$4,000tosellthehouse,andthenshebankrupteditonhim,IthinkthatssomethingtheCourtneedstoconsider. 8 Wellbeinrecessforafewminutes.Youletmeknow,andbringitbackandletmelookatit.  (Briefrecess)  (Recesstakenandproceedingsthereuponended).Thereisnothingintherecordtoindicatewhethertherewasanyfurtherdiscussionamongcounselandthecourt,orevidenceintroduced,beforethecourtreacheditsdecision.Whilethelastcommentsofthetrialjudgequotedabovewouldleadonetobelievethatfurtherproceedingswerecontemplatedbythetrialcourt,itisnotclearwhethertherewasafurtherhearing,informalorotherwise.Thecourtsorderdismissingthepetitionstatesthatthematterwasconsidered upon...thetestimonyofwitnesses...;however,counselagreedatoralargumentthatnowitnessestestifiedinthiscase.  Sincethisisanonjurycase,ourreviewisdenovoupontherecordwithapresumptionofcorrectnessastothetrialcourtsjudgment,unlessthepreponderanceoftheevidenceisotherwise.Rule13(d),T.R.A.P.; Hackettv.SmithCounty ,807ϜS.W.2d695,699(Tenn.App.1990).  Apartywhoraisesissuesonappealmustfurnishanappellatecourtwitharecordthatwillenablethecourttoreachthoseissues. InreIndemnityIns.Co.ofNorthAmerica ,594S.W.2d705,707(Tenn.1980); Wordv.Word ,937S.W.2d931,933(Tenn.App.1996).Ifthoseissuesarefactuallydriven,wemustbeinapositiontoreviewthepertinentfacts. Id .; Sherrodv.Wix ,849S.W.2d780,783(Tenn.App.1992).Inthiscase,theappellanthadtheburdenofshowingusthattheevidencepreponderatesagainstthetrialcourtsjudgment.Rule13(d),T.R.A.P.; Galbreathv.Harris ,811S.W.2d88,91(Tenn.App.1990).Thisshehasfailedtodo.Thetrialcourtappearstohavedecidedthiscasebasedsolelyonthecommentsofcounsel.Theattorneys talkedaboutthecaseandapparentlyacquiescedinthetrialcourtdecidingtheissuesbeforeitbaseduponthatdiscussion.Asfarastherecordbeforeusreveals,theappellantdidnotcallanywitnesses,didnotextractastipulationoffactsfromtheappellee, .   ׀didnototherwiseofferanyproof,and,significantly,didnotcontesttheprocedureutilizedbythetrialcourttoresolvethismatter.Thus,theappellantcannotclaimthatshewasdeprivedofaplenaryhearingbelow.Assumingthattheprocedureutilizedbythetrialcourtwasirregularinnature,theappellantsfailuretoobjecttothetrialcourtsinformalprocedureconstitutesawaiverofthaterrorasfarasthisappealisconcerned.Rule36(a),T.R.A.P.( Nothinginthisruleshallbeconstruedasrequiringreliefbegrantedtoapartyresponsibleforanerrororwhofailedtotakewhateveractionwasreasonablyavailabletopreventornullifytheharmfuleffectofanerror.)  Inrulingaswedo,wedonot,inanyway,meantoindicatethatweapproveoftheprocedureapparentlyutilizedbythetrialcourt.Ifmaterialfactsareindispute,thereshouldbeaplenarytrial.  Theappellanthasnotpresentedarecordonthisappealtoshowusthat thepreponderanceoftheevidenceisotherwise.SeeRule13(d),T.R.A.P.(emphasisadded).Therefore,wemusthonortheRule13(d)presumptionthatthetrialcourtsjudgmentiscorrect.
