Ðsufficiently€proximate€in€time€and€place€to€Horseshoeððs€gambling€activities€as€to€be€presumed€forÐ $X" Ðgambling€purposes.€€Therefore,€we€find€that€the€transaction€at€issue€was€a€gambling€contract.Ð àWe€must€now€examine€Tennessee€public€policy€on€the€issue€of€gambling.€€First,€section€29„Ð 4„ Ð19„101€of€the€Tennessee€Code€states,€ð ðAll€contracts€founded,€in€whole€or€in€part,€on€a€gambling€orÐ  p Ðwagering€consideration,€shall€be€void€to€the€extent€of€such€consideration.ðð€€Tenn.€Code€Ann.€ðð€29„Ð  \ Ð19„101€(1999).€€Additionally,€one€form€of€gambling,€a€lottery,€is€specifically€proscribed€by€our€stateÐ øH Ðconstitution€at€Article€11,€section€5.׃×Ý ƒ #ÃÝòòÚ  Ú5Ú  ÚóóÝ  Ý×  ×€€Thus,€if€the€transaction€at€issue€were€entered€into€in€Tennessee,Ð ä4 Ðâ âit€is€evident€that€the€contract€would€be€void€and€unenforceable€in€a€Tennessee€court.€€It€is€importantÐ Ð  Ðto€remember,€however,€that€the€transaction€at€issue€was€not€entered€into€in€Tennessee.€€It€was€enteredÐ ° Ðinto€in€Mississippi€where€such€transactions€are€legal.€€Ð œì Ðâ âÌà  àThis€court€has€dealt€with€a€similar€question€on€two€prior€occasions.€€First,€in€òòHotel€Ô_ÔRamadaÔ_ÔÐ tÄ ÐInc.,€v.€Ô_ÔThakkarÔ_Ôóó,€No.€03A019103CV00113,€1991€WL€135471€(Tenn.€Ct.€App.€1991)€(perm.€app.Ð `° Ðdenied),€the€defendant€was€a€Tennessee€resident€who€had€executed€seven€negotiable€checks€totalingÐ L œ Ð$19,000.00€in€return€for€chips€at€a€Nevada€casino.€€The€Defendant€lost€all€of€the€money€gamblingÐ 8 ˆ Ðat€the€casino.€€Thereafter,€the€Ô_ÔRamadaÔ_Ô€Casino€obtained€a€judgment€in€a€Nevada€court€and€sought€toÐ $ t Ðhave€the€judgment€enforced€in€Tennessee.€€While€òòÔ_ÔThakkarÔ_Ôóó€is€slightly€different€from€the€case€at€barÐ  ` Ðin€that€the€casino€in€òòÔ_ÔThakkarÔ_Ôóó€was€seeking€to€enforce€a€pre„existing€judgment€from€another€state,€theÐ ü L  Ðpublic€policy€analysis€is€still€the€same.€€This€court,€in€òòÔ_ÔThakkarÔ_Ôóó,€held€that,€ð ð[Ô_Ôo]urÔ_Ô€review€of€the€caseÐ è 8  Ðlaw€leads€us€to€conclude€that€enforcement€of€a€debt€incurred€in€the€purchase€of€gambling€chips€inÐ Ô$  Ða€state€where€gambling€is€perfectly€legal€does€not€violate€the€strong€public€policy€of€this€State.ðð€€òòId.óóÐ À  Ðat€*3.€€Moreover,€in€discussing€Tennessee€public€policy€on€the€issue€of€gambling,€this€court€inÐ ¬ü  ÐòòÔ_ÔThakkarÔ_Ôóó€noted€that,€ð ðthe€Tennessee€legislature€has€specifically€provided€for€horse€racing€with€theÐ ˜è  Ðattendant€pari„Ô_ÔmutuelÔ_Ô€betting,€which€leads€one€to€believe€that€gambling€per€se€is€not€violative€ofÐ „Ô  ÐTennessee€public€policy.ðð׃ ×Ý ƒ #ÃÝòòÚ  Ú6Ú  ÚóóÝ  Ý×  ×€€òòId.óó€at€*3.Ð pÀ ÐÌà  àAdditionally,€this€court€dealt€with€another€similar€case€in€òòMirage€v.€Pearsallóó,€02A01„9609„Ð H˜ ÐCV„00198,€1997€WL€275589€(Tenn.€Ct.€App.€1997)€(perm.€app.€denied).€€In€òòMirageóó,€the€defendant,Ð 4„ Ða€Tennessee€resident,€executed€eight€separate€negotiable€instruments€to€a€Nevada€casino€totalingÐ  p Ð$100,000.00€in€exchange€for€game€chips.€€The€defendant€lost€all€of€his€game€chips€playing€black€jackÐ  \ Ðat€the€casino.€€The€eight€instruments€were€subsequently€dishonored.€€The€casino€then€sued€andÐ øH Ðobtained€a€default€judgment€against€the€defendant€in€Nevada.€€Thereafter,€the€casino€sought€to€haveÐ ä4 Ðthe€Nevada€judgment€enforced€in€Tennessee.€€The€defendant€in€òòMirageóó€asserted€the€same€argumentÐ Ð  Ðthat€the€defendant€asserted€in€the€present€case;€gambling€is€against€the€public€policy€of€TennesseeÐ ¼  Ðand€therefore€full€faith€and€credit€should€not€be€extended.€€This€court,€however,€in€òòMirageóó,€rejectedÐ ¨ø Ðthat€argument€and€held€that€Tennessee€must€give€full€faith€and€credit€to€the€Nevada€judgment.Ð ”ä Ðà  àThe€full€faith€and€credit€clause€of€the€United€States€Constitution€provides€as€follows:Ð €Ð ÐÌÓ
