âHusband€was€ordered€to€pay€all€of€the€health€care€and€dental€expenses€for€the€partiesðð€children.€€TheÐ œì Ðcourt€further€found€that€there€was€no€need€for€an€educational€trust€fund€because€Husband€hadÐ ˆØ Ðsufficiently€set€aside€funds€for€this€purpose.׃  ×Ý ƒ#ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×€€The€court€later€amended€this€finding€and€orderedÐ tÄ ÐHusband€to€pay€an€additional€one€thousand€dollars€per€child€per€month€into€an€educational€trust€fundÐ `° Ðfor€the€children.Ð L œ ×€In€addition,€tÔ#†XXXX"##ÔÔ‡XXXXÔhe€court€awarded€Wife€assets€worth€approximately€58.73%€of€theÐ è 8  Ðmarital€estate.€€This€award€included€all€of€the€investment€accounts€($1,521,745);€$251,527€ofÐ Ô$  Ðretirement€accounts;€$24,791€of€bank€accounts;€vehicles€worth€$18,679;€and€other€assets€valued€atÐ À  Ð$35,529.€€In€making€the€award€the€court€acknowledged€Wife€received€an€additional€one€hundredÐ ¬ü  Ðthousand€dollars€from€Husband€as€a€down„payment€for€a€house€prior€to€the€final€decree€of€divorce.€Ð ˜è  ÐÌà  àHusband€was€awarded€the€remaining€41.27%€of€the€marital€estate.€€His€award€included€theÐ pÀ Ðfollowing:€real€property€($689,000);€retirement€accounts€worth€$555,131;€bank€accounts€worthÐ \¬ Ð$16,135;€a€vehicle€valued€at€$10,000;€and€other€assets€worth€$100,934.€Husband€appeals.Ð H˜ ÐÌà  àOn€appeal,€Husband€asserts€the€trial€court€erred€in€awarding€Wife€alimony€in€futuro€ratherÐ  p Ðsources€of€income€available€to€the€dependant€spouse.€Tenn.€Code.€Ann.€ðð36„5„101(d)(1)(A).€Ð 4„ ÐTherefore,€we€must€analyze€the€alimony€award€in€light€of€Wifeððs€award€of€nearly€two€million€dollarsÐ  p Ðof€marital€assets.€€In€doing€so,€we€find€the€award€of€seven€thousand€dollars€alimony€in€futuro€isÐ  \ Ðimproper.€€Accordingly€we€hereby€reduce€Wifeððs€alimony€award€to€five€thousand€dollars€per€monthÐ øH Ðinvestment€accounts€already€in€place,€the€educational€trust€is€unnecessary€and€improper.€€We€do€notÐ ˆØ Ðagree.€€For€the€following€reasons,€we€hold€that€the€educational€trust€is€proper.Ð tÄ ÐÌà  àWhile€the€trial€courtððs€findings€of€facts€are€entitled€to€a€presumption€of€correctness€on€appeal,Ð L œ ×€€The€court€below€limited€that€amount€to€thirty„two€hundred€dollars€per€month.€€The€courtÐ  p Ðbased€its€deviation€from€statutory€guidelines€on€Husbandððs€payment€of€the€childrenððs€medical€andÐ  \ Ðdental€expenses€as€well€as€all€educational€expenses.€€Ô#†XXXX P#ÔÔ‡XXXXÔIn€addition,€the€court€required€Husband€toÐ øH Ðcontribute€one€thousand€dollars€per€month€per€child€into€educational€trust€to€provide€for€the€collegeÐ ä4 Ðexpense€of€the€children.€€Therefore,€Husbandððs€total€child€support€obligation€totaled€fifty„twoÐ Ð  Ðhundred€dollars€per€month.Ð ¼  Ðâ âÐ ¨ø Ðà  àWhile€this€amount€may€seem€both€excessive€Ô#†XXXXgU#ÔÔ‡XXXXÔand€unnecessary€to€Husband,€we€find€that€theÐ ° Ðâ âtrial€courtððs€decision€is€proper.€€In€ordering€Husband€to€contribute€to€the€educational€trust,€the€courtÐ œì Ðnoted€that€its€decision€was€affected€by€both€the€uncertainty€of€the€investment€funds€growth€potentialÐ ˆØ Ðand€the€rising€costs€of€education.€€Upon€review,€we€find€this€presents€adequate€justification€for€theÐ tÄ
