DefendantsfiledmotionsforsummaryjudgmentsandsummaryjudgmentsweregrantedonbehalfofalldefendantsbytheTrialJudge.Plaintiffhasappealed.  Uponreviewingtherecord,weconcludeitisnecessarytoaddressonlyoneissue,thatis,whethertheTrialJudgeshouldhavegrantedplaintiffsmotiontostaytheproceedingspriortotheentryofthesummaryjudgments.Agroundsetforthinplaintiffsmotionis:0 0 PlaintiffalsohaspendingbeforetheCriminalCourt,apetitionforpostconvictionreliefwhichwasfiledonFebruary12,1996andamendedonMay31,1996,andisscheduledforanevidentiaryhearingonAugust28,1996.Plaintiffspetitionforpostconvictionreliefseeksvacationofhispleaandsentenceduetotheineffectiveassistanceofcounsel,andhewillberequiredtopresentevidencetotheTrialCourtofhisclaimofineffectivenessofcounselintheupcomingevidentiaryhearing.0 0 ...0 0 Plaintiffhasaconflictbetweenthecivilandcriminalproceedingspending,andmaybeprejudicedinthecriminalproceedingsscheduledforAugust28,1996.Theresponsefiledbydefendantstothismotionstates,inpertinentpart:0 0 Withrespecttoplaintiffsmotiontostayproceedings,hepointsoutthathehasapostconvictionreliefhearingscheduledonAugust28,1996.Hepointsoutthathehasaconflictbetweenthecivilandcriminalproceedings,andthathemaybeprejudiced,acontentionwhichisnotunderstoodbycounselforthesedefendants.Shouldthatbethecase,however,itisobservedthatplaintiffistheauthorofanysuchallegedmisfortune,andthathewaswhoinitiatedeachofthetwojudicialproceedings.  Wearerequiredtotakethestrongestlegitimateviewoftherecordonbehalfoftheopponentofthemotionforsummaryjudgment,anddefendantsessentiallyconcedethepossibilitythatplaintiffmaybeprejudicedifthecivilactionistriedaheadofthepetitionforpostconvictionrelief.  Inourview,theTrialJudgeabusedhisdiscretion,andshouldhavestayedthecivilactionuntiltheactiononthepetitionforpostconvictionreliefwasconcluded.Itwasplaintiffsrighttofileboththecivilactionandtheactionforrelieffromthecriminalconviction.Webelievefailuretograntastayinthiscaseresultsinprejudicetothejudicialprocess,andweaccordinglyvacatethesummaryjudgments.SeeRule36,T.R.A.P.  Uponremand,astaywillbeenteredinaccordancewiththisopinion.Uponfinalresolutionofthepostconvictionpetition,thestaywillbeliftedandthepartiesmayproceedwiththisaction.
