àThe€parties€were€divorced€in€the€Circuit€Court€for€Hamilton€County,Ïby€decree€entered€on€the€œ14th›€day€of€July,€1992.€€The€decree€of€the€courtÏincorporated€by€reference€a€marital€dissolution€agreement€entered€into€byÏthe€parties.€€Among€other€things,€the€marital€dissolution€agreementÏprovided€that€the€wife€(plaintiff)€would€have€custody€of€the€parties'Ïminor€children€with€the€defendant€having€specified€visitation€privileges.€ÏBy€subsequent€decree€entered€on€July€7,€1993,€the€court€modified€theÏdefendant's€visitation€privileges€granting€expanded€privileges€to€œhim.›ÌÌà àOn€April€22,€1996,€the€defendant€filed€the€petition€giving€rise€toÏthis€appeal.€€The€verified€petition,€among€other€things€averred€that€theÏdefendant€was€now€incarcerated€in€the€Morgan€County€Regional€CorrectionalÏFacility€in€Wartburg,€Tennessee.× ƒ. ××  ×€€He€further€avers€that€since€his€incar…ceration€in€March€1994,€he€has€been€unable€to€visit€with€his€children€andÏhas€been€able€to€successfully€communicate€with€one€of€the€children€on€onlyÏone€single€occasion.€€He€further€alleges€that€the€facility€in€which€he€isÏincarcerated€offers€inmates€Saturday,€Sunday€and€holiday€visitation€fromÏ8:00€a.m.€to€3:30€p.m.,€and€provides€outside€visitation€areas€for€picnicsÏand€barbecues€and€a€children's€play€area.€€He€asks€that€the€court€modifyÏvisitation€to€allow€visitation€on€two€Saturdays€or€Sundays€per€month€andÏon€alternating€holidays.€€He€further€asks€that€the€court€enter€an€orderÏmandating€that€the€children€be€transported€by€an€"agreed€upon€œparty"›€toÏthe€Morgan€County€Regional€Correctional€Facility€or€other€place€whereinÍthe€petitioner€is€incarcerated€for€the€express€purpose€of€visiting€withÏpetitioner.ÌÌà àIncarceration,€in€and€of€itself,€is€not€grounds€for€denying€orÏsuspending€visitation€by€the€inmate€with€his€children.€€òòSuttles€v.ÏSuttlesóó,€748€S.W.2d€427€(Tenn.€1988).€€Visitation€may€be€suspended€for€theÏperiod€of€incarceration€under€proper€circumstances.€€òòSuttlesóó,€supra.€ÏAlthough€we€find€no€authority€touching€the€point,€we€hold€as€a€matter€ofÏlaw€that€incarceration€for€a€crime€committed€voluntarily€is€œinsufficient›Ïto€constitute€a€œchange›€of€circumstances€which€would€warrant€a€change€inÏœvisitation€favorable€to€the€inmate.Ì›€€Ìà àThe€defendant€asked€the€trial€court€and€now€this€court€to€requireÏthat€the€children€be€brought€to€his€place€of€incarceration€so€that€he€mayÏexercise€his€visitation.€€Specifically,€he€asks€that€the€court€enter€anÏorder€mandating€that€the€children€be€transported€by€œan›€"agreed€upon€party"Ïto€the€Morgan€County€Regional€Cor‚rectional€facility€so€that€he€may€exer…cise€visitation€privileges.€€Additionally,€he€charges€that€the€plaintiffÍblocked€communication€with€his€children€and€he€is€unable€to€maintain€aÏmeaningful€relationship€with€his€children.ÌÌà àUnder€the€circumstances€set€out€in€òòSuttlesóó,€the€trial€court€andÏCourt€of€Appeals€allowed€òòSuttlesóó€reasonable€visitation€privileges€œ"onÏwhatever€basis€the€Department€of€Correction€would€allow."€€òòSuttlesóó,€pageÏ429.€€The›€œcircumstances€of€òòSuttlesóó€were›€not€altogether€materially€differ…ent€from€this€case.€€The€Supreme€œCourt›€reversed€the€trial€court€and€theÏCourt€of€Appeals.€€In€so€doing,€the€Court€found€that€suspension€of€visita…tion€privileges€was€appropriate,€however,€the€court€stated:€€"...€toÏprevent€the€bonds€between€the€defendant€and€child€from€being€severedÏcompletely,€he€is€free€to€communicate€with€his€child€by€telephone€or€mailÏor€other€means€approved€by€the€trial€court,€but€may€not€utilize€theseÏopportunities€to€harass€or€threaten€either€his€former€wife€or€his€child."€ÏIn€a€footnote€œto›€the€foregoing€quotation€the€court€stated:€"Nor€mayÏplaintiff€attempt€to€interfere€with€the€relationship€between€defendant€andÏtheir€son."ÌÌà àWe€are€of€the€opinion€that€there€is€a€viable€issue€of€fact€raised€inÏthe€pleadings€and€that€a€œsummary›€œdismissal€was›€error.€€Specifically,€weÏhold€œthat,€at€a€minimum,›€there€should€be€a€hearing€allowed€on€the€matterÏof€communication€between€the€defendant€and€his€children€œpursuant€to›€theÏguidance€of€òòSuttlesóó.ÌÌà àThe€ensuing€section€provides€for€depositions€in€criminal€casesÏand€Sec.€41„606€T.C.A.€[now€T.C.A.€Sec.€41„21„305]€authorizesÏthe€presiding€judge€of€any€court€to€order€the€warden€of€theÏpenitentiary€to€bring€a€convict€before€the€court€to€giveÏtestimony€for€the€state€in€criminal€cases,€and€the€nextÏsection€makes€it€the€duty€of€the€warden€to€produce€the€convictÏwitness.€òòThere€are€no€such€provisions€in€our€law€relating€toÏcivil€suitsóó.€(Emphasis€added.)ÌÌà8 àWe€hold€that,€absent€unusual€circumstances,€prisoners€who€haveÏfiled€their€civil€complaints,€unrelated€to€the€legality€ofÏtheir€convictions€...€will€not€be€afforded€the€opportunity€toÏappear€in€court€to€present€their€cases€during€their€prisonÏterms.€Instead€such€matters€will€be€held€in€abeyance€until€theÏprisoner€shall€have€been€released€and€present€his€case.€WeÏhold€that€in€a€proper€case,€and€upon€a€proper€showing€ofÏparticularized€need,€the€trial€judge,€in€his€discretion,€mayÏissue€an€appropriate€directive€requiring€the€attendance€of€theÏprisoner.€ÌÓÓÌà
