ThiscaseisbeforeuspursuanttothegrantoftwoRule9InterlocutoryAppeals,onetoPlaintiffRhondaLeeSmithandtheothertoLarryWallace,inhisofficialcapacityasDirectoroftheTennesseeBureauofInvestigation.  ThesuitgivingrisetotheseappealsstemsfromthedisappearanceofCharlesVernonSmithinJuneof1985,whilehewasmarriedtoMs.Baliles. d   ׀Priortohisdisappearance,Mr.SmithpurchasedawholelifeinsurancepolicyfromHomeBeneficialintheamountof$100,000withaccidentaldeathbenefitsinanadditionalamountof$100,000.ThispolicynamedMs.Balilesasthebeneficiary.ItisMs.Baliles'theorythatMr.SmithwasthevictimofacontractkillingbyBobbyChadwickattheinstanceofDenoMcKenzie.  AlthoughotherissuesareraisedinthisCourt,wemayonlyconsiderthoseissuesspecifiedintheTrialCourt'sordersgrantingtheseappeals:@ MS.BALILESAPPEAL         ItisthereforeORDERED,ADJUDGEDANDDECREEDTHATthemotionofthedefendantHomeBeneficialLifeInsuranceCompanytostrikethedepositionsofShirleyHamiltonandSpecialAgentGeraldPresleyoftheTennesseeBureauofInvestigationisgranted. ItisfurtherORDEREDthattheplaintiffisgrantedaninterlocutoryappealtotheCourtofAppealsastotheissuesofthestrikingofthedepositionsaswellastheplaintiff'smotionforsummaryjudgment,andthetrialdateofApril29,1996iscontinuedpendingthisappeal.@ MR.WALLACE'SAPPEAL ItisfurtherORDEREDthattheTennesseeBureauofInvestigationandSpecialAgentGeraldPresleyaregrantedaninterlocutoryappealtotheCourtofAppealsastotheissueofwhetherthedepositionsareprivilegedandnotsubjecttointroductionasevidenceattrial.       Ӏ  InaddressingthefirstpointsraisedbyMs.Baliles,wemustfirstlooktothedefinitionofhearsayfoundinRule801oftheTennesseeRulesofEvidence:        Rule801.Definitions.  Thefollowingdefinitionsapplyunderthisarticle:̀(a)Statement.A"statement"is(1)anoralorwrittenassertionor(2)nonverbalconductofapersonifitisintendedbythepersonasanassertion.̀(b)Declarant.A"declarant"isapersonwhomakesastatement.̀(c)Hearsay."Hearsay"isastatement, e   ׀otherthanonemadebythedeclarantwhiletestifyingatthetrialorhearing,offeredinevidencetoprovethetruthofthematterasserted.         AcursoryexaminationofthedepositionofShirleyHamiltonandSpecialAgentPresleydemonstratesthatcertaintestimonyelicitedisclearlynothearsay.Forexample,astoMs.Hamilton,shetestifiedastothefollowingfactsaboutthetimeofMr.Smith'sdisappearance:  1. Herthenhusband,BobbyChadwick,cameintotheirhomeand"hadblooddownhisshirt,downhispants."Additionally,onthisoccasion,"hehadabillfoldstretchedoutinhishand.IseenIdon'tknowifitwasadriver'slicenseoranIDorwhat.ItjusthadapictureofMr.Smith."Onthesameoccasion,hetookoutarevolverandlaiditonthecoffeetable.Forseveraldaysthereafter,Mr.Smithwassickandcouldnoteatnordrink.  2. Thatsometimelater,atherhusband'srequest,sheaccompaniedhimtothehomeofDenoMcKenzie,whereheremovedanenvelopefromMr.McKenzie'smailboxandhandedittoher.Whensheopenedtheenvelopeshefounditcontained$3000.  Itfurtherappearsthatevensomestatementsthatarehearsaymightbeexceptionstothegeneralrule.Rule803,TennesseeRulesofEvidence,3rdEd.WealsopointoutwithouttryingtomicromanagetheChancellor'strialofthiscasethatquestionsandcommandsareasageneralruleadmissible.Section801.9,TennesseeLawofEvidence,3rdEd.  Finally,astothatportionofMs.Baliles'appealwhichassertssheshouldhavebeengrantedasummaryjudgment,wecannotfindthattheundisputedproofshowsMr.Smithisdeceasedorthathisdeathresultedasallegedinthecomplaint"frombodilyinjuriessustainedthroughexternal,violent,andaccidentalmeans."̛̜  AstothedepositionofSpecialAgentPresley,werecognizethatmuchofitmightnotbeadmissibleasviolativeofthehearsayrulebutotherportionsareand,withthisdepositionaswiththedepositionofMs.Hamilton,therulingsoftheTrialCourtshouldbeonananswerbyanswerbasiswhichcouldverywellbeinfluencedbythetestimonyreceivedattrialpriortotheofferofthetestimonycontainedinthedepositions.̜  ItappearstheprincipalconcernastoMr.Wallace'sappealisthatMs.Hamilton'snamewouldbecomeknowntoMr.Chadwickwhichwouldplaceherinperil.TherecorddisclosesthatMr.ChadwickknewthatMs.Hamiltonwasfurnishinginformationtothelawenforcementauthorityandgrantingaprivilegetoprotectherwouldbefutile.WeaccordinglyconcludethatourgrantofaninterlocutoryappealastoMr.Wallacewasimprovidentandhisappealisaccordinglydismissed.
