D9<26 Ї ` ThejudgmentoftheTrialCourtcontainsthefollowing:`    1. h TheCourtfindseachpartyhasgroundsfor  divorceandthereforedoesherebygrantadivorcetothepartiesandORDERSthepartiesaredivorcedpursuanttoT.C.A.364129.  2. h Asconcernsthedivisionofmaritalproperty, | t theJointStipulationofthepartiesisadoptedbytheCourt. ` }   ӄp| `   5. h TheCourtherebyfindsandORDERSthatthe @8  realpropertyoftheparties,whichpropertyisdescribedinthedeedsattachedherebyasExhibit AandExhibit B,includingallimprovementsthereonisfoundtohaveavalueof$116,500.00.Thetotalmortgagedebtencumberingsaidpropertyis$14,180.20,suchthatthereremainsequityinsaidpropertyof$102,319.80.TheWifeshallhavethirty(30)daysfromOctober14,1997topaytotheHusband,incertifiedfunds,thesumof$51,159.90forhisinterestintheequityofsaidproperty.IftheWifepaysthismoneytotheHusband,saidpropertyshallbequitclaimedbytheHusbandtotheWifetobehersabsolute.Ifwithinsaidthirty(30)dayperiod,theWifedoesnotmakethepaymentasreferencedabove,thepropertyshallimmediatelybeplacedforsaleatauctiontothehighestbidderwithBobParksRealty&Auctionandthepropertyshallbesoldnolessthan75daysfromOctober14,1997.ThepartiesshallownthepropertyastenantsincommonpendingtheequitybuyoutoftheWifeorthesaleofthepropertyasreferencedherein.  TheWifeshallberesponsibleforthemortgagedebtandallotherdebtsassociatedwiththerealpropertyuntilthesameissold.Ifthepropertyissoldatauction,thenfromtheequityproceedsofthepropertyshallbesubtractedtherealtorscommission,expensesoftheauctionandthemortgagedebttoSunTrusttoreachthenetequityaftersale.Eachpartyreceiveofthenetequity.  ӄ1  7. h TheWifeisawardedtheIRAaccountinthe *#& nameoftheHusbandvaluedat$7,219.49andshallberesponsibleforanytaxconsequencesthatflowwiththeownershipofthisIRAinanyform.U  ӄ^  8. h TheCourtfindsandherebyORDERSafterfull .'+ considerationoftheissueofalimony,includingthefactorssetforthinT.C.A.365101(d),thisisnotanappropriatecaseforrehabilitativealimonyorlongtermalimony.TheCourtdoes,however,findthatitisapropercaseforalimonyinsolidoanddoesherebyawardalimonyinsolidointheamountof$3,600.00totheWife.ThisamountshallbepaidtotheWifeatthetimeshepurchasestheequityinterestoftheHusbandbysubtracting$3,600.00fromhisportionoftheequity,orshouldthepropertybeauctioned,thenthe$3,600.00alimonyinsolidoawardedshallbepaidtotheWifeatthattime. 927   10. h TheWifesrequestforassistanceconcerning  herhealthinsurancehasbeenconsideredbythecourtandincludedwithinthealimonyawardandthereforethisrequestisdenied.  11. h Eachpartyshallpaytheirownattorneysfees   andtheirowndiscretionarycostsincurredinthismanner.  12. h Thecourtcostsofthiscauseshallbeequally h` paidbythepartiesforwhichexecutionmayissueifnecessary. `  FirstIssue :RehabilitiveAlimony    ` ThepartiesweremarriedMarch23,1986,atwhichtimethehusbandwas44yearsoldandthewifewas39.TheyseparatedinSeptember,1996.Thewifesufferedfromsomehealthproblems,butwasworkingatthetimeoftheseparation.Shewasearning$7.20perhouratthetimeofthetrial.Atthesametime,thehusbandearned$9.31perhour.Duringthemarriagethepartiesaccumulatedaconsiderablemaritalestatewhichwasdividedequally.Theportionallotedtothewifeissubstantial.QGconsideringthebrevityofthemarriage.QG ` Thefactualdeterminationsofatrialjudgesittingwithoutajuryarereviewedonappealdenovowithapresumptionofcorrectnessunlesstheevidencepreponderatesotherwise.TRAPRule13(d). ` TrialCourtshavegreatlatitudeofdiscretionastotheawardofalimony.Lancasterv. *#& Lancaster,Tenn.App.1984,671S.W.2d501.Theawardofalimonydependsupontheunique +$( factsofeachcase. ` T.C.A.365101(d)providesthatacourtmay(notmust)awardrehabilitativealimonytoadisadvantagedspouse. ` Appellantarguesthatsheiseconomicallydisadvantagedbecausethehusbandmakes$2.11moreperhourthanshemakes.Thestatutedoesnotrequirethatspousesshareequally 816 theirjointincomesaftertheyaredivorced.Moreover,theamountrealizedfromthedivisionofmaritalestateisofconsiderableweightindeterminingtheallowanceofsupporttoadisadvantagedspouse. ` Thewifeinsiststhatherearningabilityisimpaired,butsheadmitsthatsheisworkingandoffersnomedicalevidenceofherpresentorprobablefutureimpairment. ` TheTrialCourtdidnotcommitreversibleerrorindenyingrehabilitativealimony.
