Hewasnevereligibleforthem. #X" @) B.  $0!$   Mr.Tayloralsoassertsthatheisentitledtoadditionalsentencecreditsforthetimehespent &#& incarceratedintheShelbyCountyjailbeforebeingtransferredtoastateinstitution.Mr.Taylorwas '#' confinedtotheShelbyCountyjailfromDecember22,1981throughApril11,1984.Duringthis ($(  time,Mr.Taylorwasbothconvictedandsentenced.ThesentencingtookplaceonJanuary20,1983, )%) andMr.TaylorremainedattheShelbyCountyjailforapproximatelythreemonthsthereafterbefore  histransfertoastateinstitution.     Mr.TaylorandtheDepartmentareinagreementthattheeffectivedateofhissentenceis  December22,1981.Accordingly,pursuanttoTenn.CodeAnn.4023101(1997),Mr.Taylorwas p entitledtopretrialjailcreditforeverydayhespentintheShelbyCountyjailfromDecember22, \ 1981!theeffectivedateofhissentence!toJanuary20,1983!thedatethesentencingdecision H  wasactuallyhandeddownbythetrialcourt.Mr.TayloracknowledgesthattheDepartmentproperly 4 t creditedhimwith394daysforthistime.  `   Mr.Taylorwasnot,however,givenpretrialjailcreditforthetimehewasincarceratedinthe  8  ShelbyCountyjailfollowinghissentencing.ThedayshespentintheShelbyCountyjailbeginning  $  January20,1983,havebeencreditedtohimnotaspretrialjailcreditbutratherasstraighttime   served.ContrarytoMr.Taylorsassertions,theDepartmenthascalculatedhispretrialjailcredits   correctlyandappropriatelygavehimthecreditforthetimeheremainedintheShelbyCountyjail   followinghissentencing.
