Theappellanthaspresentedfiveissuesasfollows:   ` A. Whethertheappellantwasdeniedhisminimaldueprocessrightstobeheardonlyonthesentencehewaseligibletobeheardforparoleonorfrom?B. Whetherthehearingofficercommittedsignificantproceduralerrorswhenherefusedtocontinuethehearingaftertheappellantadvisedhimthathewasnotbeingheardonthesentencehewaseligibletobeparoledonorfrom?C. WhethertheBoardofParolesanditsmemberscommittedsignificantproceduralerrorswhentheyapprovedand/ormodifiedthehearingofficersrecommendations,inlightofthefactthattheappellanthadraisedtheissuethathewasnotbeingheardonthesentencehewaseligibletobeparoledonorfrom?D. WhethertheBoardofParolesand/oritsappointeddesignee,JosephStepbach,actedarbitrarily,illegallyandfraudulentlywhentheyrefusedtoaddressand/orheartheappellantsappealandremandhisparoleeligibilityhearingbacktothehearingofficerforadecisiontoberecommendedonlyonthesentencetheappellantwaseligibletobeheardforparoleon?E. WhetherthedecisionrenderedinHowellv.State,569S.W.2d428(Tenn.1978)canbenefittheState,whenparoleisviolatedondeterminateconsecutivesentences,totheprejudiceoftheparolee?     OnOctober5,1989,appellantwasconvictedoftwocrimes,seconddegreemurderandassaultwithintenttocommitmurder,andwassentencedtotwentyyearsconfinementfortheformeroffenseandtwelveandonehalfyearsforthelatteroffense,tobeservedconsecutively,thatis,atotalofthirtytwoandonehalfyearsconfinement. OnDecember2,1996,appellantsapplicationforparolewasheardbyahearingofficerwhorecommendedthattheapplicationbedenied.OnDecember23,1996,theBoarddeniedtheapplication,and,onJanuary17,1997,appellantappealedtotheBoardonthegroundthatthehearingofficererredinconsideringhisaggregatesentenceofthirtytwoandonehalfyears,whenheshouldhaveconsideredonlythetwentyyearsentencestatedintheapplicationforan institutionalparolefortheremainingtwelveandonehalfyears.TheappealwasdeniedbytheBoard,andtheprisonerinstitutedthepresentjudicialreview. TheTrialJudgedismissedthepetitionforcertioraribecausetheCriminalSentencingReformActof1982,T.C.A.Title40,Chapter35,4035112,underwhichappellantseligibilityforparolemustbecomputedbyaddingtogethertheeligibilityperiodofeachconsecutivesentence.ThisCourtagreeswiththeTrialCourtthattheactmakesnodistinctionbetweena custodialparoleandoutrightreleasefromcustody. Theforegoingdisposesofthefirstfourissues. Thefifthissuepresentsassumedfuturecriminalactsoftheappellant,andisconsideredmoot. ThejudgmentoftheTrialCourttaxed LitTaxcoststothepetitioner.Anaffidavitofpovertydoesnotexcusealitigantfrompayingallcosts.ThejudgmentoftheTrialCourtismodifiedtorenderjudgmentagainstthepetitionerforallcostsaccruedinthatCourtandtoawardexecutiontherefor.Asmodified,saidjudgmentisaffirmed.Costsofthisappealaretaxedagainsttheappellant.ThecauseisremandedtotheTrialCourtforfurtherproceedingsconsistentwiththisopinion.
