Thisappealinvolvesadisputeoverastateprisonersreleaseeligibilitydate.AftertheTennesseeDepartmentofCorrectiondidnotrespondtohisrequestforadeclaratoryruling,theprisonerfiledadeclaratoryjudgmentactionintheChanceryCourtforDavidsonCountyseekingadeclarationthathisreleaseeligibilitydatewasSeptember2000.TheDepartmentfiledamotionforsummaryjudgmentsupportedbyanaffidavitsettingoutitsreleaseeligibilitydatecalculations.Afterthetrialcourtdismissedhispetition,theprisonerperfectedthisappeal.Weagreewiththetrialcourtsconclusionthatthematerialfactsarenotindisputeand,accordingly,affirmthesummaryjudgment.@ I.  LarryD._Turnley_ԀiscurrentlyincarceratedintheMorganCountyRegionalCorrectionalFacilityfollowingalengthycriminalcareer.InMarch1975hereceiveda16to30yearprisonsentenceafterbeingconvictedofgrandlarceny,seconddegreeburglary,robbery,andfourcountsofarmedrobbery.Mr.ϜTurnleywasparoledinApril1982butwasreturnedtocustodysevenmonthslateraftercommittinganotherarmedrobbery.Hewasconvictedofthisoffenseandreceivedanother35yearsentencetobeservedconsecutivelywithhisearliersentences. Mr._Turnley_ԀescapedfromcustodyinSeptember1983.BeforehewascapturedinVirginia,hecommittedanaggravatedrobberyinTennesseeandothercrimesinVirginia.WhilestillinVirginiascustody,heagreedtopleadguiltytotheTennesseeaggravatedrobberyandescapechargesandreceived8yearand1yearsentencestobeservedconcurrentlywitheachotherandconsecutivelywithhisearlierTennesseesentences._ 4   _ԀHewaseventuallyreleasedtoTennesseescustodyandreturnedtotheDavidsonCountyJailonApril14,1992.Asaresultofhislaterconvictionsforarmed  robbery,escape,andaggravatedrobbery,Mr._Turnley_Ԁisnowservinga16to73yearsentence. Afterbeinginformedthathewouldnotbeeligibletobeconsideredforreleaseuntil2007,Mr._Turnley_ԀsoughtadeclaratoryrulingfromtheDepartmentofCorrectionconcerningitscalculationofhissentenceeligibilitydate.WhentheDepartmentdeclinedtoissuearuling,Mr._Turnley_ԀfiledapetitionfordeclaratoryjudgmentpursuanttoTenn.CodeAnn.45225(Supp.1997)(formerlyTenn.CodeAnn.45224)intheChanceryCourtforDavidsonCounty.TheDepartmentrespondedwithamotionforsummaryjudgmentsupportedbyanaffidavitofthemanagerofSentenceInformationServicesdetailingtheDepartmentscalculationsofMr._Turnley_sreleaseeligibilitydate.Mr._Turnley_ԀrespondedbytakingissuewiththeDepartmentscalculations.ThetrialcourtgrantedtheDepartmentsmotionafterdeterminingthattherewerenogenuinedisputesconcerningthematerialfactsandthattheDepartmentwasentitledtoajudgmentasamatteroflaw.@ II.  ThesoleissueonthisappealiswhethertheDepartmentwasentitledtoajudgmentinitsfavorasamatteroflawbasedontheevidencesubmittedinsupportofandinoppositiontoitsmotionforsummaryjudgment.AsweunderstandMr.Turnleysprosebriefandpleadings,heinsiststhattheDepartmentwasnotentitledtoajudgmentasamatteroflawbecausetherecordcontainsmaterialfactualdisputeswithregardtothepercentageofhislaterarmedrobbery,aggravatedrobbery,andescapesentenceshemustservebeforebeingeligibleforreleaseclassificationstatusandtothecalculationofhissentencecredits. Thepartyseekingasummaryjudgmenthastheinitialburdenofsatisfyingthetrialcourtthattherearenogenuinedisputedfactualissuesfortrialandthatitisentitledtoajudgmentasamatteroflaw.SeeWyattv.ABest,Co.,910S.W.2d851,854(Tenn.1995).Oncethemovingpartyhasfiledaproperlysupportedmotion,theburdenshiftstothenonmovingpartytodemonstratebyaffidavitsorotherappropriateevidentiarymaterialsthatthereisagenuine,materialfactualdisputewarrantingatrialonthemerits.Byrdv.Hall,847S.W.2d208,211(Tenn.1993).Nonmovingpartiesshouldnottakeamotionforsummaryjudgmentlightly,seeFowlerv.HappyGoodmanFamily,575S.W.2d496,499(Tenn.1978),andshouldnotrelyonthedenialsorallegationsintheirpleadingstoestablishamaterialfactualdisputethatwillbesufficienttodefeatasummaryjudgmentmotion.SeeTenn.R.Civ.P.56.06. Mr._Turnley_sresponsetotheDepartmentsmotionforsummaryjudgmentdoesnotsetforthspecificfactsshowingthatthereisagenuineissuefortrial.Rather,itissimplyarestatementoftheallegationsinhisearlierpleadingsandotherpapersfiledwiththetrialcourt.HisassertionsaboutthecircumstancesofhisincarcerationinVirginiaandthetermsandconditionsofhissentencesforaggravatedrobberyandescapearecompletelyunsupportedandunsubstantiated.Likewise,hisassertionsrelatingtothecalculationofhissentencecreditsappeartooverlookthefactthatheisnotentitledtothesecreditsuntilheearnsthemandthatheisnotentitledtosentencecreditsduringthe deadtimewhenhehadescaped.SeeTenn.CodeAnn.4121236(a)(3)(1997).@ III.
